Originally when built, it went through your local zoning and building permit process.The two Burger King complexes in Bridgewater on Route 24 also went through local permitting. Not sure why,whether it was through a lease agreement or other, but I will be consistent with how it was permitted in the past. In addition to the hood being out of date, one of the hood filters was missing.The hood fan was in use at the time of the inspection with active cooking operations under the hood at the time.The hood and deep frying operations were ordered to be shut down. During the inspection,one of the exits was blocked with a hand cart which appeared to contain trash.Staff removed cart upon notice. A violation F051-053152 was issued under 527 CMR 1.00.for operation of the hood unit without a filter in place and past due for inspection/cleaning and a blocked exit. Prior to leaving the manager set up a re-inspection time for June 11,2019 at 0600HRS. June 11, 2019,0545HRS, Re-inspection of the Burger King located at 2145 lyannough Road, West Barnstable, MA 02668;the Hood unit over the deep fryers was labeled with an orange label indicating inspection/cleaning done on June 10,2019. Inspection of the hood revealed a large section that had not been cleaned.A replacement filter had not arrived for the hood.The hood and cooking operations under the hood to remain shut down until all the corrections were made. June 11,2019 1710HRS, Chief Maruca re-inspected the hood system at the Burger King located at 2145 lyannough Road,West Barnstable, MA 02668; Inspection indicated the hood had been cleaned and all filters were in place.The business was allowed to resume full cook operations. June 18, 2019 1400hrs,Contact with State Fire Marshals code compliance officer. DAVID PAANANEN Deputy Chief Business: 508-362-3241 Fax: 508-362-3683 Emergency:911 June 19,2019 Gene Mulligan We investigated the Burger King located at 2145 lyannough Road after you provided us with the statement indicating the possibility that hot oil had dripped on your wife's car during the month of May from the Burger King in the drive through area. Our investigation focused on the area of the cooking hood vents located on the drive through side of the roof.The drive through was temporarily shut down to allow for access to the roof. From the ground there was an appearance of residue on the roof,gutter,and down spout. Further investigation revealed that the residue is the result of accumulation of dust/dirt within the condensation runoff from the HV/AC units and rain water.A small collection of condensation/rain water and additional dirt and dust accumulation was found on the flat section of roof where the HV/AC units and the hood vents are located.There is no evidence of oil or grease on the roof surface in this area.The management was advised that the area could use some cleaning to remove the accumulation of dirt/dust. When she pulled up to the pick up window a greasy discharge spilled over onto her car from above. As a result, she went through the car wash several times and had it professionally detailed. They were informed by detailer that the discharge was likely a hot oil/water mix and seems to have damaged the finish on the car. Caller is concerned that someone in a convertible or with an open moon roof could have been injured. WBFD was contacted and the DC was notified to check. Health responded as well but informed caller about limited jurisdiction . Violations under state and local regs will be addressed Inspectional Services and WBFD. Caller stated he wants to ensure that what ever malfunctioned is corrected to prevent others from being hurt or damaged. He will pursue damages directly with BK. UPDATE: RA spoke to the DC -WBFD. He is currently addressing some violations with regards to fire code. Unsure if these are related to reported incident. He is scheduling a follow up inspection next week. Health is communicating with FD concerning the matters identified within the restaurant. There has been no definitive assessment made as of this date. 6119/2019 andersor Spoke to WBFD on this date. DC David Paananen. He inspected the roof of BK and found no grease or greasy conditions on the surface. He advised that the surface moisture appears to be condensation dripping across roof to gutter system. The condensation seems to be attracting dust and dirt that settles on the surface but is not greasy. A FD report will be issued concerning the findings/repairs on the issues identified for the hood sytem and annual inspection 6/27/2019 florencb I inspected the subject property on 6/21/19. 1 was unable to determine for certain that any components of the ventilation system for the hood system had failed. Of particular note is that the property is owned by the Commonwealth.The matter is outside of Barnstable's jurisdiction this matter is closed in our system due to jurisdictional authority.
