Weiss , On or about Friday , August 15 , 1986 , the owners and/or tenants of 1064 Main Street , West Barnstable committed yet another violation against the Old King ' s Highway Regional Historic District Act . Large doors were installed in the ell of the house without a Certificate of Appropriateness or a Certificate of Exemption . This is the second time a violation of the Historic District Act has occurred at this property . The first occurred in May of 1985 with the attempted demolition of the historic Chipman Barn which continues to stand in a partially razed condition . Complaints from neighbors , members of the Old King ' s Highway Regional Historic ,.District Committee and the Historical Commission have l ailed to produce any satisfactory response from the Building Inspector ' s Office . In a letter dated June 13 ' 1986 , Mr . DaLuz stated that negotiations- were in process with Dr . Doriss concerning the purchase of the barn . In a subsequent conversation with Dr . Doriss , he clearly indicated to me that he did not want the barn and was anxious to see the building restored on its present site .. Fifteen months have passed since Old Stage , Inc . began to demolish this barn without permission from either the O.K .H.R.H.D .C. or a permit from the Building Inspector ' s Office . In view of this current violation as well as the unresolved prior offense , the Historical Commission feels that prompt legal action against the owners of this property is long overdue . (OSI) began to demolish the Chipman Barn located at 1064 Main Street , West Barnstable , Mass . without approval of the town ' s Old King ' s Highway Regional Historic District Committee . Demolition of the barn , which is listed in the town ' s inventory of historic buildings (See Enclosed) , was halted after Committee Chairman , Elliott B. MacSwan , sent OSI a cease-and-desist order . OSI later applied to the local Old King ' s Highway Regional Historic .' District Committee for a permit to continue razing the historic barn and was turned down . OSI appealed this decision to the Old King ' s Highway Regional Historic District Commission which unanimously upheld the local Committee ' s determination based on five excellent reasons (See Enclosed) . Allan Green , attorney for OSI , filed an appeal with Barnstable First District Court , however OSI forfeited the case because of their failure to return documentation required by the court . In March of 1986 correspondence to you from Elliott B. MacSwan indicates that court action against .OSI be pursued in an effort to restore the barn (See Enclosed) . The Historical Commission fully concurs with the Old King ' s Highway Regional Historic District Commission ' s decision regarding this building which historically and architecturally adds to the distinctive character and setting of this portion of the Historic District . A year has passed and the barn remains in a partially razed state . OSI knowingly violated the rules and regulations of the Old King ' s Highway Regional Historic District and continues to practice demolition by negle.c.t by their failure to replace what was removed without permission . Failure to take appropriate action regarding OSI ' s blatent disregard of the Historic District ' s laws is potentially precedent-setting and threatens the continuation of the Historic District itself . . Under the Old King ' s Highway Regional Historic District Rules and Regulations , Violations , Section IV Court Jurisdiction and Penalties : Violators of the Historic histrict Act are guilty of a misdemeanor and may be fined anywhere from a minimum of $100 Mr . This office has tried to work with both parties in an effort to negotiate this matter. When it first came to my attention the Old Stage Inc. had referred the matter to their attorney, Mr. Allan Green. From your correspondence I understand that due to their failure to appear at the hearing, a. decision was rendered in favor of the Commission. On March 25, 1986 I received correspondence from the then chairman of the Commission, Mr: Elliott MacSwan, in which he mentioned that, if necessary, this case should be taken to court. I, then, again contacted Atty. Allan Green and was informed that one of the principals of the Old Stage Inc. was hospitalized at Cape Cod Hospital, and that he would pursue the matter and get back .to me with a decision. Although I have spoken with Mr. Green, I have nothing in writing from his office concerning the barn. I did, however, speak to Mr. William Meagher about the barn, and have received a letter from him which states that negotiations are in process for the purchase of the barn by Dr. Doriss who lives directly across the street. He asked that no further action be taken until a decision has been made by Dr. Doriss. Another reason that no action has been taken is the request by Atty. Green that nothing be done with the barn without further approvals. They would, of course, have to go before the Old King's Highway Regional Historic District Committee for approval before authorization would be given for this newest venture. Although Mr. MacSwan's letter suggested that court action be taken, if necessary, I believe that at this time a follow-up to insure satisfactory disposition of this property as soon as possible would be preferable. Organization Barnstable Historical Comm. district Date March 1983; revised 1985 Photo #77-7-B39 (Staple additional sheets here) ARCHITECTURAL SIGNIFICANCE (Describe important architectural features and evaluate in terms of other buildings within the corrawdty.)This Cape Cod style half Cape, story and a half features a closed entrance to the off center entry on the facade facing the street. It also has an ell on the East gable and an ell ex- tending from the north facade with a narrow chimney near the end of the roof peak. The house had a shallow kitchen gable roof and the off centered chimney to the west end of the peak is of -moderate size. The iwindows were,until recently, .original 6/6 sash with narrow trim and blinds. The other trim is of moderate width and the house foundation is low in height and constructed of brick. In 1985 6/6 sash was replaced with modern 1/1, altering the visual characteristics of the building. (cont. below) HISTORICAL SIGNIFICANCE (Explain the role owners played in local or state history and how the building relates to the development of the commmity.) The original owners of the property developed it for farming and raising of livestock, as was typical in West Barnstable in the 17th, 18th and 19th centuries. An ancient way through the property runs due north to the "Great Marshes" for access to the available resources used by the early settlers and farmers. The property is located on the north side of the "Old County" Road. Elder John Chipman was the first of the family to own the property, purchasing 45 acres in 1672 from Lieut. John Howland. It was bounded east by the- Otis property and north by the "Great Marshes". His son, Deacon Samuel Chipman, was the next owner. A later owner, Elder Timothy Chipman, was active in village religious and social affairs in the 18th century. The house appears to have been built in the. first half of the 19th century (brick foundation, 6/6 sash), possibly at the time of the property transfer to William Chipman from Timothy Chipman in 1838. A barn has been shown to the. rear of the house on .the several 19th and early 20th century atlases (1858, 1880, 1907). While the current barn may represent a remodeling or reconstru- ction of the original, its materials and construction, indicate an age of at least .100 years. Thus, the structure has long been a part of the Chipman property and greatly enhances its cur- rent interpretation as a 19th century farmstead. This office has tried to work with both parties in an effort to negotiate this matter. When it first came to my attention the Old 'Stage Inc. had referred the matter to their attorney, Mr. Allan Green. From your correspondence I understand that due to their failure to appear at the hearing, a decision was rendered in favor of the Commission. On March 25, 1986 I received correspondence from the then chairman of the Commission, Mr. Elliott MacSwan, in which he mentioned that, if necessary, this case should be taken to court. I, .then, again contacted Atty. Allan Green and was informed that one of the principals of the Old Stage Inc. was hospitalized at Cape Cod Hospital, and that he ,would pursue the matter and get back to me with a decision. Although I have spoken with Mr. Green, I have nothing in writing from his office concerning the barn. I did, however, speak to Mr. William Meagher about the barn, and have received a letter from him which states that negotiations are in process for the purchase of the barn by Dr. Doriss who lives directly across the street. He asked that no further action be taken until a decision has been made by Dr. Doriss. Another reason that no action has been taken, is the request by Atty. Green that nothing be done with the barn without further approvals. They would, of course, have to go before the Old King's Highway Regional Historic District Committee for approval before authorization would be given for this newest venture. Although Mr. MacSwan's letter suggested that court action be taken, if necessary, I believe that at this time a follow-up to insure satisfactory disposition of this property as soon as possible would be preferable. This Cape Cod style.half Cape, story and a half features a closed entrance to the off center entry on the facade facing the street. It also has an ell on the East gable and an ell ex- tending from the north facade with a narrow chimney near the end of the roof peak. The house had a s-hallow kitchen gable roof and the off centered chimney to the west end of the peak is of moderate size. The Windows were,until recently, original 6/6 sash with narrow trim and blinds. The other trim is of moderate width and the house foundation is low in height and constructed of brick. In 1985 6/6 sash was replaced with modern 1/1, altering the visual characteristics of the building. The original owners of the property developed 'it for farming and raising of lives.t-ck, as was typical in West Barnstable in the 17th, 18th and 19th centuries. An ancient kIa,y_ through the property runs due north to the "Great Marshes" for access to the available resources used by the early settlers and farmers. The property is located on the north side of the "Old County" Road. Elder John Chipman was the first of the family to own the property, purchasing 45 acres in 1672 from Lieut. John Howland.. It was bounded east by th-e Otis property and north by the "Great Marshes". His son, Deacon Samuel Chipman, was the next owner. A later owner, Elder Timothy Chipman, was active in village religious and social affairs in the 18th century. The house appears to have been built in the. first half of the 19th century (brick foundation, 6/6 sash) ,.' possibly at the time of the property transfer to William Chipman from 'Timothy Chipman in 1838. Barnstable. The ,complaintant , namely, Mr. J. Kitteredge. In 1984 I purchased the property with a partner- ship. Then in 1987 I became sole owner. At that time, I began trying to upgrade the property and turn it into a lovely, quaint , courtyard with professional offices and retail stores . As soon as my plans became known the harrassment began. Having been robbed three times I had spotlights mounted on the property. "Mr. Kitteredge complained, we then arranged the time clock for the lights to go off at nine p.m. but he still complained. My back door and window were smashed in, resulting from robbery, I replaced them. . .Mr. Kitteredge comp- lained again. He liked the old steel door better. I mounted the spotlights because Mr. Kitteredge used to walk around my office building in the dark and frighten my associates . Here is a list of harrassments by Kitteredge: 1 . ) four women in the office leaving at night would be frightened by Kitteredge walking around the premises in the dark - which I consider tres- passing. 2 . ) Having mounted the spotlights - Kitteredge complained - arranged for timer to go off at 9 :00 p.m. he still complained to everyone in the village, Town Hall, and including my attorney, Bruce P. Gilmore. `f 3 . ) Complained about removal of brush on. my property 4 . ) Complained to Town Engineer about loam pile that ' s been there four years ( like cement ) now all of a sudden on his property (we wondered who had been removing the loam with a wheelbarr oW? ) 5 . ) Opposition to development of commercial complex! My attorney and I met with him before and after meeting with the Planning Board and offered to re- locate the road and buildings . He wasn ' t happy! He said he didn ' t want any buildings there and would do .anything he could to stop me . 6. ) Complained constantly to the Town and Old King' s Highway about the remodeling of the barn -- (every board removed had to .be inspected before we could continue with the construction. ) This proved very costly both materials and health wise. I never knew which inspector would show up with a new complaint each day. The stress of this situation caused some embarrassing tears in front of strangers . 7 . ) After the barn was completed he complained that it didn ' t comply with approved plans . I even had to .give up a second story outside balcony that I con- sidered - a safety factor in case of fire because he could see it from his workshop. 8 . ) Complained about tree falling on his house after driveway was constructed. I offered to cut the tree down , he complained he would lose his shade. 9 . ) When equipment came the first time to cut the drive- way he ran out screaming it was illegal and stopped the. operation even though he had illegally built a fence on my property before he received approval by Old King' s Highway. I had a state approved curb cut in hand. 10 . ) Called Joe DaLuz to complain about the bousehouse. He didn ' t like the looks of it on my property. 11 . ) Spotlights constantly being smashed. . . 12 . ) HIS rubbish blows onto my land. . . r I have NOT bothered him, nor, reported he and his wife for their loud, foulmouthed, shouting matches that all our clients can hear. Nor have I requested an exp- lanation as to why he is allowed an indusztrialus.e on village business zoned,- property ( storing boats all over his yard. ) You can see them from Rte. 6A and I can def in- etly see them from my office. It is not a pleasant sight at all. I think the same zoning and rules should apply to all. This is just a small sampling of what this one person has done. I could write many more pages . I thank you all in advance for any and all help that you can give me in correcting this situation. One other concern that I would like to bring to your attention is the so called Duck Camp at the end of my drive, on conservation land. This person that uses the premises owns no land - he is living on the Great Marsh - junk all over the place. Where ' s his septic system? His well? This is the place that people are always trespassing over to get to. Kids going out to have wild parties ( I 've que- stioned them) and old cars left on my property, too. Could you please do something about this unsanitary hide away? I 'm surprised Old King ' s Highway allows this after all it is within the Historic confines . I would just like to pursue my plans for Old King' s Court and build that beautiful, small, colonial complex in a democratic atmosphere where liberty and justice are meant for all.
