Catalano, has appealed to the Board of Appeals from a decision of the Building Inspector and petitions for a Special Permit under PA4, extension or alteration of a non-conforming use, Barnstable Zonis By-Law as revised August 24, 19739, to allow construction of a building for housing at most 28 dogs at Main Street, klest'Barnstable in a Village Business B Zoning District. The Petitioner was represented! by Attorney Stephen Jones of Hyannis who stated that this kennel has been in operation ,fdr W years; that it was opened with a valid, unlimited: kennel license by the farmer cnmers, the Listers, while this area was zoned for Business; that it has since been c'.an&ed to Village Business B and, there- fore, this is a valid non-conforming use; that this could be a personal service business, which is pe-ndesible in a Village Business B. On April 25, 1985 at 11 :00 a.m. , the Board convened a hearing to receive testimony on' the alleged noise problems emanating from Bayvi.ew Kennels. Based upon said testimony, and evidence submitted to the Board on April 25,. 1985, the Board of Selectmen rendered the following decision and required recommendation to the Commissioners under Section 137C on May 2, 1985. Although evidence and 'testimony t ring on Bayview Kennels would indicate that unreasonable enoise 1problems shave emanated from the premises over the past few years, the owner has recently taken action to minimize the noise resulting from barking at the kennel . In the Board's view, Bayview Kennels .should ' be given an opportunity to continue their operation under the newly installed "sound proofing" and thus allow for a reasonable period of time to assess the effectiveness of such measures. Therefore, we would not recommend suspension or revocation of Bayview Kennel 's license at this time. However, because this kennel is located in close proximity to a number of residences and problems have arisen in the past, we believe it would be well advised to restrict Bayview's license as follows: 1 . No 'dogs shall be boarded .in, buildings other than the sound %,-proofed_"main_bui lding" ------ 2 Dogs sshall not be allowed to run outside between the hours of 6 p.m. and 8:30 a.m. . 3. The total number of .dogs to be boarded on any given day shall not exceed 30. r 2. Chapter 140, Section 137C, the Selectmen, based on testimony and evidence submitted to the board on April 25, 1985, recommended three regulations ( #l , #2, and #3 ) for the operation of the kennel, and forthwith . forwarded their decision to the County Commissioners . Dear Mr. Daluz, t Pursuant to Chapter 40 A, Section 7, of -the lass. General saws regarding the enforcement' of the zoning by-laws of the Town of Barnstable, I am asking you to investigate the expanded use of the old garage building which has been converted into a kennel building with two outside wire dog runs having been added to each end of the building (a total of four) and dog entry doors cut to allow the dogs entry from the building to- the runs. The Board of Selectmen, following an open hearing April 25, 1985, ordered the wood frame garage building not be used for the purpose of kenneling dogs and the County Commissioners concurred. (See enclosed copy entitled "Complaint Against Bayview Kennels" item #1.) This kennel business is allowed by Special Permit from the hoard of Appeals, Town of Barnstable, Appeal rr1974-11 which states the building; shall be soundproofed, etc. The plans filed with the application show a single building with 28 spaces. to house dogs. The request for a single building was made to eliminate the various individual dog houses scattered about the back yard at that time. M;rs. Gould, according to a copy of your letter to Attorney Ford of A7ov.8,19849 is aware of the Special Permit and the restrictions imposed by the Board of Appeals. However, she continues to go before the County Commissioners with requests for changes in the conditions of her license. The Commissioners have granted her requests without any public hearings or notification to abbuttors. She appears to be continually expanding her business and is currently seeking ayproval from the Old King's i:ig•hway Historic Committee for an addition to the rear of the house which clearly indicates further expansion. Regardless of the outcome of -the Cornrlissioners rulings she is still mandated to stay within the fraaework of the Special Permit granted by the Board of Appeals. r Beyview Kennel - page 2 . Attorney Daniel Mullin, representing Peter Ungerland, spoke in opposition and stated that a non-conforming use has not been established here; that the license has no validity in determining legality of use in regard to zoning by-laws (Meadows ve. Joseph Melish and Arthur Harper, both of West Barnstable, also stated that this was a public nuisance. Mrs. Lister, the kennel's former owner, spoke and stated that before they purchased the property, they made sure that a kennel could be operated -there and that this neighborhood is changing in character from Village Business� to straight business; and that this was always an unlimited kennel. Mrs. Krooks, an abutter, spoke and stated that she had been led to believe that there would only be 10 dogs. In rebuttal, Attorney Jones stated that this is a valid non-conforming use; that this has been a kennel and has every right to continue as a kennel and that the proposed structure would reduce any disturbance IN. and that the proposal that a kennel is valid only in an industrial : area is ridiculous; that this is a service and, therefore, a permitted use. Mr. Williams stated that he would be unable to sit on the Capewide Industries appeal,- number 1974-14, because of a possible conflict of interest, and, since Mrs. Strayer would be out of town, both alternates, Mrs. Nightingale / and Mr. Frank would have to be contacted to sit on May 1st. Lister informs me, '..and she has records to verify this, that as of this-date she began operating a kennel on the property and continued to do so until she sold the property to Mr. Catalano in February of this year . Since this is prior to the zoning change it seems to establish to me conclusively that it was a pre-existing non-conforming use and that the Board has the power to grant a special permit to allow con- struction of the building . On July 2, 1974, the Board of Appeals of the Town of Barnstable issued a special permit allowing for the extension of a nonconforming use •for the kennel which required in part that the new buildings erected on the premises were to be soundproofed and airconditioned. As of this writing, although an attempt has been made to soundproof the building, the building has yet to be soundproofed and the noise emanating from the kennel causes great disturbance to the immediate abutters and to others in the area. The noise caused by the kennel and its lack of soundproofing has been the subject of many complaints to the Barnstable Police, complaints to and hearings before the Board of Selectmen, and the County Commissioners of the County of Barnstable pursuant to General Laws Ch. 140 §137C. Relief. has been sought from the Building Inspector to enforce the terms of the special permit referred to above, but to no avail . Request is hereby made that some action be taken by the Board of Appeals to enforce the provisions of the special permit issued in 1974. As' you may recall, I wrote to you on April 29, 1985 and to that letter I have had no reply. I enclose a copy of that letter to you for your review. Since the Board of Selectmen conducted their hearing and made recommendation, and since the recommendation of the Board of Selectmen was substantially adopted by the County Commissioners, problems have persisted with the conduct of the kennel operation. The owner of the kennel, Priscilla Gould, has made representations both to the Board of Selectmen and the County Commissioners that the "main building" is in fact soundproofed. It is my client's experience, and that of other neighbors, that although work was performed on the main building and the noise has been muffled, it is by no means soundproof. On many instances since the County Commission' er.s-' ruling, and for that matter since the Board of Selectmen's ruling, it has been " necessary for my client and other neighbors to call the Barnstable Police to report excessive noise. Furthermore, it has been brought to my attention that over the past weekend at least one dog was boarded in the old garage, contrary to the special permit of 1974, the Board of Selectmen's decision and that of the County Commissioners. In addition, it is my client' s belief that on Sunday, July 7, 1985, alth'ough a claim has been made that the kennel building has been airconditioned, the doors and windows of the kennel building were opened, allowing substantial noise to emanate from the main building. i MGNULTY AND HOPKINS, P.
