A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on January 8, 2020 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were: Alex Rodolakis, David Hirsch, Jacob Dewey, Paul Pinard and Mark Hansen. Attorney Christopher Kirrane presented the application before the Board. I also consulted with Anna Brigham concerning the status and requirements of the Amnesty program. My findings are as follows: The subject property is 483 Maple Street, WB. The property is located in the RF single family zone. The property was developed in 1993 with a 2-story single family, post& beam dwelling containing 9 rooms(2% baths). FYI: Later permits identify only 6 rooms. Building permit#6670/36443 & septic permit#93-474 were issued for the original construction. OKH approved the plans. The lot consists of 2.64 acres in an unusual configuration. The property currently has the benefit of an Amnesty unit contained within the primary dwelling issued to a former owner, Seacat. That approval occurred in 2003 for a one bedroom unit not to exceed 2 people. The property transferred in 2016 to Charles& Rebecca Wood. A stable permit for one horse was approved on 9/15/18. There is no rescission or transfer request the street file for the Amnesty unit. Anna Brigham confirmed that the comp permit has not been rescinded and the new owners have not requested it to be transferred. Anna emailed the monitoring agent, Arden Cadren today concerning the status of the permit. The existing septic system is unable to accommodate additional bedrooms. The governing comp permit required the reduction of viable bedrooms on the upper floor in order to create the bedroom for the Amnesty unit. 11/14/19 A septic installer inquired about installing a separate septic system for the proposed structure identified as a cottage on a preliminary plan submitted to Health. The property has adequate land mass in order to add to the number of bedrooms on the subject site. It remains unclear how this proposed structure_ (cottage) is to be used and what if any relief is being sought in order for it to be constructed and occupied. A proposed detached garage was also noted on the plan next to the cottage. No floor plans for the cottage and garage were available for inspectors to review. The two proposed structures are on opposite ends of the lot but next to each other. It is also unclear whether or not the total habitable units on this lot are intended to be three or more. The Owner shall annually deliver to the Municipality and to the Monitoring Agent,as designated by the Town Manager,proof that the Designated Affordable Unit is rented,the tenant's income verification,a copy of the lease agreement and the rent charged for the unit or units. Such information shall also be forwarded to the Monitoring Agent within 30 days of the occupation of the dwelling unit or units by a new tenant. The Owner shall notify the Monitoring Agent,as designated by the Town Manager,within thirty(30) days of the date that a tenant has vacated the Designated Affordable Unit. IV. MUNIQPALITY 00VENANTS AND RESPONSIBILITIES 1. The MUNICIPALITY,through the monitoring agent designated by the Town Manager agrees to perform the duties of verifying that the Designated Affordable Unit is being rented in perpetuity to a household with a maximum income of 80% or less of the Area Median Income (AMI) of Barnstable-Yarmouth Metropolitan Statistical Area(MSA) and that rent(including utilities) shall not exceed the rents established bythe Department of Housing and Urban Development(HUD) for a household whose income is 80% of the median income of Bamstable-Yarmouth Metropolitan Statistical Area.In the event that utilities are separately metered, the.utility allowance established bythe Barnstable Housing Authority shall be deducted from HUD's rent level. V. RECORDING OF AGREEMENT: Upon execution,the OWNER shall immediately cause this Agreement and any amendments hereto to be recorded with the Registry of Deeds for Barnstable County or,if the Project consists in whole or in part of registered land,file this Agreement and any amendments hereto with the Registry District of the Barnstable 2 Bk 17.126 PS210 "072243 Land Court(collectively hereinafter the"Registry of Deeds"),and the Owner shall pay all fees and charges incurred in connection therewith. Upon recording or filling,as applicable,the Owner shall immediatelytransmit to the Municipality evidence of such recording or filing including the date and instrument,book and page or registration number of the Agreement. VI GOVERNING OF AGREEMENT: This Agreement shall be governed bythe laws of the Commonwealth of Massachusetts. Any amendments to this Agreement must be in writing and executed by all of the parties hereto. The invalidity of any clause,part or provision of this Agreement shall not affect the validity of the remaining portions hereof. VIII. NOTICE: All notices to be given pursuant to this Agreement shall be in writing and shall be deemed given when delivered by hand or when mailed by certified or registered mail,postage prepaid,return receipt requested,to the parties hereto at the addresses set forth below,or to such other place as a parry may from time to time designate by written notice. IX HOLD HARMLESS: The Owner hereby agrees to indemnify and hold harmless Municipality and/or its delegate from any and all actions or inactions by the Owner,its agents,servants or employees which result in claims made against Municipality and/or its delegate,including but not limited to awards,judgments,out-of-pocket expenses and attorneys fees necessitated by such actions. X. ENTIRE UNDERSTANDING: A- This Agreement shall constitute the entire understanding between the parties and any amendments or changes hereto must be in writing,executed by the parties,and appended to this document. B. This Agreement and all of the covenants,agreements and restrictions contained herein shall be deemed to be for the public purpose of providing safe affordable housing and shall be deemed to be,and by these presents are,granted by the Owner to run in perpetuity in favor of and be held by the Municipality as any other permanent restriction held by a governmental body as that term is used in MGL Ch. 184,Section 26 which shall run with the land described in Exhibit"A" hereto annexed and shall be binding upon the Owner and all successors in title. This Agreement is made for the benefit of the Municipality and the Municipality shall be deemed to be the holder of the restriction created by this Agreement. The Municipality has determined that the acquiring of such a restriction is in the public interest. The Municipality shall not be subject to the defense of lack of privity of estate. The covenants and restrictions contained in this Agreement shall be deemed to affect the title to the property described in Exhibit"A". XI. TERM OF AGREEMENT. The term of this Agreement shall be perpetual,provided,however,that the Owner of a Designated Affordable Unit or Units may voluntarily cancel the granted Comprehensive Permit and the terms and restrictions imposed herein. Such cancellation shall only take effect after. 1) expiration of the lease terms entered into between the Owner and Tenant occupying said unit and 2) notification by the Owner of said dwelling to the Zoning Board of Appeals of his/her desire to cancel the Comprehensive permit upon a date certain and the recording of said notice at the Barnstable County Registry of Deeds or Barnstable County Registry of the Land Court as the case may be,thus rendering said Comprehensive Permit void. The applicant has been renting it off and on to friends. The applicant heard about the program through the local media and decided to apply for it. The proposed accessory unit will be converted within a pre-existing basement apartment. It is a one- bedroom and approximately 600 square feet. The locus is in the AP Aquifer Protection Overlay District. The unit qualifies for the Accessory Affordable Housing Program as an Amnesty unit. Procedural Summary: This application for a Comprehensive Permit was filed at the Town Clerk's Office and the Office of the Zoning Board of Appeals. A public hearing before the Zoning Board of Appeals Hearing Officer was duly advertised and notice was sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on April 23,2003,at which time the Hearing Officer took a question from a neighbor,Bonnie McNally on Title V regulations. After a brief explanation of how public health approves a septic system based on its capacity to handle the property's bedrooms,and reviewing the competed application,the Comprehensive Permit was granted. The Hearing Officer,Gail Nightingale,presided over the public hearing. Also present were Paulette Theresa-McAuliffe,Accessory Affordable Housing Program Coordinator,and Michelle McKinstry,Barnstable Housing Authority. The applicant is Dona Seacat with an address of 483 Maple Street,W. Barnstable,MA.- Ms. Seacat has owned the property since September 15, 1993 as documented and recorded at the Registry of Deeds in Book 8796,page 317. Ms. Seacat is requesting the Comprehensive Permit to convert a pre-existing unit into an accessory affordable apartment. The unit qualifies for the"Accessory Affordable Housing Program" as an Amnesty unit that existed prior to January 01,2000. 2. The applicant was issued a Project Eligibility(site approval) letter dated March 28,2003 from Kevin Shea,Director,Office of Community&Economic Development,qualifying the application for the Accessory Affordable Housing Program. The source of the subsidyis the federal Community Development Block Grant(CDBG) program 3. The rental unit is approximately 600 square feet and has one bedroom: It is-in the-basement of the single-family Colonial style home. 4. According to the Assessor's record,there is a total of four bedrooms on the property. The property is in the AP Aquifer Protection Overlay District.The Public Health Division has:verified that the proposed property meets the conditions of the State's Title V Environmental Code;and approved the septic system at the site for a total of five bedrooms as per the"Housing Amnesty/Public Health"Form dated April 2,2003. 5. The Barnstable Housing Authority completed an inspection of the unit on December 4,2002. The unit received a Pass inspection. It was noted that the heating for the unit is separately metered. The applicant is aware that a final inspection by the Building Division will be required and that the Building Division also has to perform all necessary inspections to assure that the unit meets applicable minimum state and local code requirements. 6. On December 9,2002,the applicant signed an Accessory Affordable Housing(Amnesty]Program Affidavit agreeing to comply with the programs requirements,including owner occupancy of the principal dwelling unit and further agreeing to'complywith the provisions set forth in Article LXV (65) of the Town Ordinances that include their signing and recording of the Regulatory Agreement &Declaration of Restrictive Covenants. The subsidizing agency has determined that the signing and recording of the regulatory agreement qualifies the applicant as a"limited dividend organization" as that term is used under M.G.L.c.40B §§20-23. 7. Under Chapter 3,Article LXV"(65) of the Town Ordinances,the affordable unit must be rented at an affordable rent to a person or family whose income is 80% or less of the Area Median Income (AMI) of Barnstable-Yarmouth Metropolitan Statistical Area(MSA). 8. The Barnstable Housing Authority has agreed to serve as the monitoring agent for this affordable rental unit. 9. According to the Massachusetts Department of Housing and Community Development,as of October 1,2001,4.7%of the town's year-round housing stock qualified as affordable housing units. The town has not reached the statutory minimum under M.G.L. c.40B §§20-23 or its implementing regulations. Under the Town of Barnstable's Local Comprehensive Plan, the use of existing housing to create affordable units and the dispersal of these units throughout the town is encouraged.' 10. Ruling and Conditions: Based upon the findings,the applicant,Dona Seacat,is granted a Comprehensive Permit to permit the conversion of an accessory apartment of 600 square feet within a single-family owner-occupied residential dwelling, subject to the following conditions: 1. The property owner shall occupy the principal dwelling as her year-round residence. 2. Occupancy of the affordable unit shall not exceed two people. 3. This unit shall not be occupied by a family member. 4. To meet the requirements of affordability,the applicant must rent the unit to a person or family whose income is 80% or less of the Area Median Income (AW of Barnstable-Yarmouth Metropolitan Statistical Area(MSA),adjusted by household size. The monthly rent payable by a household inclusive of utilities shall not exceed 30% of the monthly household income of a household earning 80% of the median income,adjusted by household size. In the event that utilities are separately metered,the utility allowance established by the Barnstable Housing Authority shall be deducted from rent level so calculated. 5. All leases shall have a minimum term of one year. 6. Before the issuance of an occupancy permit for the accessory affordable unit,the building commissioner must determine that the unit both conforms with the approved plans as submitted to the file and meets state building and fire codes,plus,complies with applicable state on-site wastewater discharge requirements. 7. The applicant may select their own tenant(s) provided the tenant(s) meet all requirements of the program and provided that person(s) income is reviewed and approved by the Barnstable Housing Authority as a qualified individual. The applicant will be required to work with the Housing Authorityto provide information necessaryto document that,the tenant(s) qualify. To insure that the unit is rented in an open and fair basis to an income eligible individual or family,the unit must be listed with the Barnstable Housing Authority(BHA) and the Housing Assistance Corporation (H Q whenever a vacancy occurs. Also,the applicant must notify the monitoring agent of a vacancy whenever it occurs. 8. Every twelve months the applicant shall review the income eligibility of those individuals occupying the unit. No later than a year from the date of issuance of this Comprehensive Permit the applicant shall file with the Barnstable Housing Authority an annual affidavit listing the rent charged and income level of the occupant(s) of the unit. The applicant shall provide the Barnstable Housing Authority any additional information it deems necessaryto verify the information provided in the affidavit. DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. According to Fred Schlegel of the Engineering Dept, Maple Street has town road status from Rte 6A to the railroad. After that, it retains a private road status because there was never a taking by legislative action (town meeting). He referenced an 1856 map they use regarding road takings. Per Rita, she checked the records and the Town is currently plowing Maple St. Ext. 790-1721 ext 5777 Dick French, Commonwealth Electric, the pole on the street which is numbered 76/27 is a Com Electric pole. He said the least expensive way for you to go is to hire a private contractor to put in the power and you can run it from the Com Electric pole. Com Electric can do it for you but itwill cost more. Whitney Wright 362-2123,771-4912-former buyer of lot; said he had it under agreement in the$80s price range about 2-3 years ago; he did not buy it because of title problems. Says he sold his engineering work to the current owner. 790-6245 Kendall Ayres, Conservation Commission. Conservaton filing dated December 7, 1990; expires three years from that date. File No. SE32182; their records do not indicate this has been recorded. It would need to be recorded in order to obtain a building permit. 775-2244 Stephen Wilson,Engineer. Per my phone conversation with him: We should check with the Board of Health to determine if they will allow us to use the current septic design because requirements for septic systems within 250 of wetlands have changed within the last few months. The new ruling requires a large leaching field, about 50 x 12 and in this case it would be about 18-20 feet deep. The result of this is that the septic system will cost much more than the one which was designed on this plan. i I i The engineer also said that the system which is designed on this plan would cost much more than our guess of$3000 to$5000 because it has to be so deep in the ground. If you look at the test information, they didn't hit sand until around 20 feet. He says we need an !` estimate on the system from an installer who works in that area and who is familiar with installing these larger systems now required around wetlands. Part of the expense for either of the systems would be taking away the dirt because you are not supposed to dump it on the site now. He said that he could use the existing engineering plans except you would need to hire him to redesign the system if the town won't go with the one already designed. Hewould also be needed for additional work regarding staking out the house foundation after it is �! built, which is required for your building permit, and obtaining a release of the order of i conditions. After you have satisfied the requirements of the order of conditions, an engineer has to go out and inspect and certify to the Conservation Commission that the i conditions have been met. He obtains a release which is recorded. He would not give me an estimate on the above until he knew exactly what you wanted him to do. The following question needs to be asked at the Board of Health. Based on this Order of Conditions, was septic permit pulled and will they still honor it, or will they require that you re-design the system to new requirements. The argument for using the design on the plan is that it would be less disturbing to the land. The engineer also said you should figure extra landscaping costs into your expenses because the Order of Conditions requires replanting along the driveway. You would need an estimate from a landscaper on this. This engineer appears to be very knowledgeable and helpful about this situation. I would recommend that you talk with before proceeding any further so that you clearly understand the process and costs. I also think that anyone giving you an estimate on the driveway should see this plan and the requirements of the conservation commission. All of the above is usually coordinated by the builder and engineer but I want you to have a clear understanding of the costs. He can use the existing plan and change the footprint of the house. Additional engineering work will be required. This includes staking the work limit and area of hay bales. Conservation then comes out to review the location of such and must approve it before any work can begin. The engineer would also be certifying location of well, septic and foundation. The engineer files an"as built"plan showing where the foundation was installed in order for you to obtain your final building permit. Also, after you have done the replication, he would need to certify that part of the work to the Conservation Commission in order for you to eventually get a Certificate of Compliance. You can get an occupancy permit without the Certificate of Compliance. You need to contact a well driller to pull a well permit. This requires testing the water first. The plan shows an existing well, but the well permit is usually only good for a year. The engineer also needs a letter from Whitney Wright saying all the engineering work done on this lot has been released to the current seller because Whitney Wright was the engineer's client. You or your builder should obtain an estimate for the balance of the engineering work to be done. Per the engineer, he would be charging you for new work being done, not for i work previously done for White Wright,providing he gets a release from Whitney. i According to Whitney Wright's attorney,Peter O'Keefe, all the engineering work was forwarded to Arnold and Kangis, Concord, 508 369-0001 and they or the seller should have the original Order of Conditions. Also, the enginer Stephen Wilson did not do a perimeter plan. He did a topographical i J plan for the purpose of conservation filing. You need to check with an attorney to determine if the perimeter plan done by an engineer named Ed Kelley should be recorded when you buy this property. As you will recall, he started the work on this property and then it was shifted to Stephen Wilson. Also, your attorney should coordinate the title issue with Attorney Bernie Kilroy.
