This letter is in response to your documentation of July 16, 2009 regarding the
above. While this lot may pre-date the 1929 adoption of zoning by the Town of
Barnstable, this lot still lacks frontage which is a basic requirement of Chapter
40 §6 and also §240-91(A). Both of these require that for a lot to be protected it
must have:
1. 5000 square feet of area which this lot contains.
2. 50 feet of frontage. This lot lacks frontage. This lot is not located
on a road or street and was never located on a.road or street.
This lot to be developed would require a variance from the Zoning
Board of Appeals.
You have the right to appeal this decision to the Zoning Board of Appeals.
