Dear Attorney Watt, This letter is in response to your documentation of July 16, 2009 regarding the above. While this lot may pre-date the 1929 adoption of zoning by the Town of Barnstable, this lot still lacks frontage which is a basic requirement of Chapter 40 §6 and also §240-91(A). Both of these require that for a lot to be protected it must have: 1. 5000 square feet of area which this lot contains. 2. 50 feet of frontage. This lot lacks frontage. This lot is not located on a road or street and was never located on a.road or street. This lot to be developed would require a variance from the Zoning Board of Appeals. You have the right to appeal this decision to the Zoning Board of Appeals. Should you require additional information, please do not hesitate to contact me.
