The site is located in a RF Residential F Zoning District north of Route 6A in West Barnstable. The RF District requires a minimum lot size of one acre. It is unclear from the materials submitted if the applicants are proposing to unite all 7 lots or only 4 of the seven lots into one. The application cites 7 lots as the locus of the appeal, however, the proposed site . plan cites only 4 lots(1.41 acres total)while the 1995 Board of Health Septic permit cites 5 lots(4.4 acres total) as comprising the site upon which a two-story 4 bedroom single-family residence is being proposed. Section 2-3.3 -Lot Size Requirements-states"Wetlands shall not be included in the lot area (sq. ft.) requirement for zoning compliance." In addition, Section 2-3.5-Contiguous Upland Required -requires that all lots shall have one hundred percent(100%)of the minimum required lot area as contiguous upland. The locus does not comply with these provisions of the Zoning Ordinance; being less than 100% of contiguous upland for the minimum one acre required. The majority of the locus is classified as wetlands. The applicants are seeking a Variance from these provisions of the Zoning Ordinance in order to permit construction of a single-family dwelling on this locus. The applicants are specifically applying for a Variance to the following Sections of the Zoning Ordinance: • Section 2-3.3 Lot Size Requirements • Section 2-3.5 Contiguous Upland Required • Section 3-1.4(5) Bulk Regulations-Minimum Lot Area Staff Review&Comments: Zoning & Lot History: The property was subdivided in 1963 (see attached plan). At that time, the property was zoned RC-1 which had a minimum lot area requirement of 15,000 sq. ft. The majority of the lots in this subdivision Town of Barnstable-Planning Department-Staff Report Appeal Number 1998-137-Yuskaitis Variance to Section 2-3.3,2-3.5 and 3-1.4(5) average between 0.35 and 0.36 of an acre. There was no contiguous upland requirement in 1963. In 1973, a requirement for 70%of the required lot area to be upland (ATM 3/29/73, Art. 156)was added to the Zoning By-laws. In 1974, this was changed to"contiguous" upland (ATM 3/27/74, Art. 100). Finally, in 1987 the 70%contiguous upland requirement was changed to 100% (STM 4/7/87, Art.4). Many of the lots in this subdivision are presently vacant. Access to these lots, including the subject site, is from Packet Landing Way; a private subdivision road which consists for the most part of a gravel surface. The lots that abut the subject site are all vacant with the exception of the 1.1 acre lot to the southwest which is improved with a single-family residence. Upland Area: The majority of the 7 acre locus is within the A5 and C Flood zones. The applicants have not provided an area calculation for the amount of contiguous upland for the entire site, but staff has estimated it to be approximately 0.56 of an acre. The applicants should provide the Board with a more precise figure on the amount of contiguous upland. The new dwelling is proposed to be constructed on Lots 8 and 52 (Parcels 43 and 42 respectively), approximately 60 feet from that portion of the site subject to flooding. All construction is proposed to be further than 50 feet from any wetland area. According to the assessor's record, the assessed value of all 7 lots totals$18,200. Most of the value ($16,400) is contained within the 4 smaller lots fronting on Packet Landing Way. Past Permitting Activities: The application states"All applicable town permits and approvals have been granted". The proposal has received a Certificate of Appropriateness from the Old King's Highway Historic District Committee on August 5, 1998 for a two story colonial home with a one-story 2 car garage attached by an open air breezeway. According to the architectural plans submitted, the building has an overall front dimension of 76 feet long. The engineering site plan submitted with the application dimensions the structure at 48 feet long. The Conservation Commission issued an Order of Conditions on August 16, 1996. In 1998, that Order of Conditions was extended to the year 2001. The Notice of Intent filed with Conservation cites the proposed plan as being"Site Plan of Yuskaitis Residence August 5, 1995". That plan, also submitted with the Zoning Board of Appeals application, shows 4 lots in combination and dimensions the length of the proposed structure as being 69 feet. The plan also states that no surface water body is within 150 feet. That is true for the 4 lot plan but the 7 lots in combination border Spring Creek within the Great Marshes of Barnstable Harbor. According to Attorney Michael Ford, the applicant's representative, the applicant may be considering disposing of the 3 lots not shown on the plan to some conservation group. All of that land appears to be wetlands. Board of Health: The applicants have also received a permit for construction of an on-site septic disposal system from the Board of Health for a lot with on-site well water. That application and permit is dated March 30, 1995 and was issued for a septic system that met the provisions of Title V for a 4 bedroom house in March of 1995. The Board of Health application cites 5 lots with a total area of 4.4 acres (192,280 sq. ft.). A Board of Health septic permit is valid only for three years. The new Title V regulations were adopted in March of 1995 and went into effect after the issuance of that permit. Unless the applicant has an extension on the 1995 permit they will be required to secure a new permit of an on site septic system. 2 Town of Barnstable-Planning Department-Staff Report Appeal Number 1998-137-Yuskaitis Variance to Section 2-3.3,2-3.5 and 3-1.4(5) According to the Health Division, the well must be installed and tested prior to the issuance of the septic permit. The applicant has stated on his application that"clearing, excavating and engineering have been completed". Building Permit Application: A building permit application was applied for apparently sometime in early 1997 (January or March). That application was signed off by Conservation and the Health Divisions. That application cites the size of the lot as being "61,599 sq. ft. (7.21A)". Only one lot number is given on the application. Application Needs: The applicant should be prepared to justify that all of the permits are valid and in proper order. The applicant will need to submit or identify which of the layout plans showing the dwelling is to be the development plan and what will be the final lot configuration and area upon which the dwelling and all improvements are to be located. If the Board should find to grant relief, the Board should require that an Approval Not Required (ANR) Plan be approved by the Planning Board and recorded with any variance. This will assure that all lots that are the subject of this permit be united into one lot only. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, r financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variance, they may wish to consider the following. conditions: 1. The property shall be developed in accordance with the submitted site plan titled"Site Plan of Land in West Barnstable Mass. of Lots 8, 52, 53 &54 Depicting the Proposed Yuskaitis Residence", prepared by Stephen J. Doyle and Associates, and dated August 5, 1995. 2. An Approval Not Required (ANR) Plan shall be prepared showing the combination of the(4 or 7) lots and submitted to the Planning Board for approval. That ANR Plan shall reference and be recorded with this variance. 3. The property shall be landscaped in accordance with the proposed landscape plan, a copy of which is in the file. 4. The locus shall comply with all Building Division and Health Division regulations, and all requirements of the Old King's Highway Regional Historic District Commission and Conservation Commission. For the landscape restoration of the existing disturbance within the 50' buffer shown on the plan,the following additional conditions shall apply: 16. Natural regrowth shall not be impeded by cutting or other means. 17. The landscaping plan shall be implemented. Shrubs shall be planted at a minimum density of 4 1/2'on center. Once planting occurs,the area shall be allowed to return to thicket growth. 18. Shrubs shall be no smaller than 2 1/2-3'tall when planted. 19. Shrubs that fail to survive through two full growing seasons shall be replaced in kind. Therefore, the Barnstable Conservation Commission hereby finds that the following conditions are necessary, in accordance with the Performance standards set forth in the regulations, to protect these interests checked above. The Commission orders that all work shall be performed in accordance with said conditions and with the Notice of intent referenced above. To the. extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. General Conditions: 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this order. 2. The site is located in a RF Residential F Zoning District north of Route 6A in West Barnstable. The RF District requires a minimum lot size of one acre. It is unclear from the materials submitted if the applicants are proposing to unite all 7 lots or only 4 of the seven lots into one. The application cites 7 lots as the locus of the appeal, however, the proposed site plan cites only 4 lots (1.41 acres total)while the 1995 Board of Health Septic permit cites 5 lots (4.4 acres total)as comprising the site upon-which a two-story 4 bedroom single-family residence is being proposed. Section 2-3.3 -Lot Size Requirements-states"Wetlands shall not be included in the lot area(sq. ft.) requirement for zoning compliance." In addition, Section 2-3.5-Contiguous Upland Required-requires that all lots shall have one hundred percent(100%) of the minimum required lot area as contiguous upland. The locus does not comply with these provisions of the Zoning Ordinance; being less than 1 DO% of contiguous upland for the minimum one acre required. The majority of the locus is classified as wetlands. The applicants are seeking a Variance from these provisions of the Zoning Ordinance in order to permit construction of a single-family dwelling on this locus. The applicants are specifically applying for a Variance to the following Sections of the Zoning Ordinance: • Section 2-3.3 Lot Size Requirements • Section 2-3.5 Contiguous Upland Required • Section 3-1.4(5) Bulk Regulations-Minimum Lot Area Procedural Summary: This appeal was flied at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 24, 1998. A 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The s Town of Barnstable-Zoning Boafd of Appeals-Decision and Notice Appeal Number 199&137-YuskaitPs yananoe to Seddon 2-3.3,2-3.5 and 3.1.4(5) I hearing was opened December 16, 1998, at which time the Board granted the requested relief with conditions. �a Hearing Summary: Board Members hearing this appeal were Gene Burman, Gail Nightingale, Ron Jansson, Elizabeth Nilsson, and Chairman Emmett Glynn. Attorney Michael Ford represented the applicants, Mark and Kelly Yuskaids,who were present Attorney Ford submitted a memorandum in support of this appeal and displayed a plan for review. As history,Attorney Ford explained,when the Petitioners applied for a building permit in 1994,the Petitioners had been informed by the previous building inspector, Joe Daluz,that if they combined Lots 8, 52, 53 and 54,that a building permit would be issued. Based on that information, the Petitioners proceeded with permitting and currently hold a valid Order of Conditions for the construction of the proposed dwelling, a Certificate of Appropriateness from the Old IGngs Highway and a septic permit fromflihe Board of Health which is good until the year 2001. There is a discrepancy with the plans because the applicant went to Old Kings Highway first-got their approval-and then proceeded onto the Conservation Commission where they made the applicants"shrink"the house from that which was approved at the OKH. If there is a need to correct the Order of Conditions or the Certificate of Appropriateness,the Applicants will return for further permitting. The plan the Applicants are currently using is the plan that was approved by the Conservation Commission. After obtaining all the proper permits,the applicants applied for a building permit, however, the Building Commissioner indicated that he did not believe that the lots met the test of either time state grandfather clause, General Laws Chapter 40A, Section 6, or the Town of Barnstable grandfather clause under Section 4-4.2. Attorney Ford Is not appealing that decision of the Building Commissioner because he was not hired by the Petitioner until after the time frame allowed to appeal that decision and after the Applicants had already applied for a Variance. With that in mind,Attorney Ford felt the Board could make a determination that no variance is required. In order to make that determination the Board would have to find that the lots in question,as combined, meet the requirements of General Laws Chapter 40A, Section 6, or Section 4-4.2 of the Barnstable Zoning Ordinance. There is no question that the lots, as combined, (1)met the zoning requirement at the time they were formed(15,000 sq.ft.)and 125'of frontage,(2)contained in excess of 5,000 sq.fL of area and 15'of frontage and(3)have been separately owned at the time of every zoning change which rendered the property nonconforming(zoning changes to upgrade minimum lot area in 1985 and,70%contiguous upland, and 100%upland requirements in 1972, 1973 and 1987, respectively). The sole issue is whether or not the Petitioners loss of Parcel B,which was contiguous to the seven lots now at issue,for nonpayment of taxes,disqualifies this combined lot under the provision that it was not held in common ownership with any adjoining land even though Parcel B was held in common ownership at the time of all zoning changes that made it nonconforming. The Building Commissioner is of the opinion that the Petitioners lost their grandfathering rights when they lost that parcel. However,Attorney Ford would suggest that Parcel B, being entirely wetlands,could never have been utilized by the Petitioners to bring the seven lots now before the Board into any greater degree of conformity than currently exists, as Parcel B,which was previously contiguous with the seven parcels currently before the Board, is no longer owned by the Petitioners and,as a result,they cannot satisfy the requirement that the parcel in question was not held in common ownership with any adjoining land. Attorney Ford suggested no variance is necessary as the oommon ownership rule only has application to other land which could be used by a props ty owner in bringing the lots)in question into a greater degree of conformity and because this parcel is all wetlands,that could not happen in this case. The Building Commissioner indicated that based on the history of the lots, the lots as they exist now are not the same as they were in the 1960s when they were held in common ownership and therefore the grandfathering rule can not be utilized. He does not feel this is a merger problem. There was a extensive discussion among the Board Members, the Building Commissioner, and Attorney Ford about whether or not, under the doctrine of merger, the ability of a lot to make the lot in issue less nonconforming matters. Does the wetland status matter? There was a discussion about the taking of the land by the.Town and not the actual selling of the property. Attorney Ford stressed the buildable portion j of this area has not changed and that is all that should be considered under the issue of f Building Commissioner stressed the land must be ins eparate ownership from the der. The adoption of zoning provision until now-and that Is not true in this case. Because this appeal is not an appeal Commissioner,the Board asked Attorney Ford to proceed with the Variance Section and list Variance Building Conditions. Public Comments: No one spoke in favor or in opposition to this appeal. It contains certain topographical conditions not conducive to meeting the minimum upland requirement. As a direct result of the condition, if literally, the Petitioners cannot use the parcel(s)for buildingthe Ordinance is enforced considerable sums of money to acquire the purposes. The Petitioners having spent Property and obtain all other necessary permits for the house in question and,as a result, would suffer a great financial hardship if the relief is denied. The utilization of this large parcel would have no detrimental effect on the public good as it has been property conditioned by the Conservation Commission and the Board of Health and is located in an AP Groundwater Protection District and,therefore,would not negatively impact groundwater. He also stressed that the granting of a Variance for a large parcel such as this one which is disqualified from the grandfather clause only by virtue of a tax title foreclosure, particularly where the parcel taken for taxes could not possibly have contributed to making this lot more conforming, would not be a nullification of the purpose and intent of the Ordinance. For ventilated ceilings, insulating sheathing must be placed between the conditioned space and the ventilated portion of the roof. 'Wall R-values represent the sum of the wall cavity insulation plus insulating sheathing (if used). Do not include exterior siding, structural sheathing, and interior drywall. For example,an R=19 requirement could be met EITHER by R-19 cavity insulation OR R-13 cavity insulation plus R-6 insulating sheathing. If, however, these lots were owned by an abutter and sold after August, 1963, then it appears that zoning relief would be required. Lot 30 appears to have the required frontage on I Packet Landing Way making this lot buildable. There are two ways for application. 1.
