Checks have been deposited but will not know until Monday or Tuesday, November 23/24 if they actually cleared! Mr. Noone was apologetic but we only spent a few minutes talking since I did not want to say anything I would regret later. You and i chatted on November 16th about my dog Cooper(yellow Labrador)who had spent three weeks at,Matt-Noone's West,Barnstable.home.for board.and train. I picked Cow open up on i November 6th from Mr. Noone's address at 116 Parker Rd,West Barnstable (this was a Friday)and he had on a shock collar,a regular collar and W Seresto tick and flea collar. Got him home and took off the shock collar but left the other two on Cooper. Saturday morning-November 7th-I took him over to his day care (Paws Dream in Yarmouthport) just to see the ladies there since they had missed him and Renata,one of Cooper's favorites, noticed his neck. We both inspected It and realized Cooper had what looked IIke burns across his throat area. I was shocked as also was Renata. We came home. I called Mr. Noone at 11:16AM to tell him what I had found. He responded that it must have been Cooper's drool that stayed In the collar and created this "wound". Sunday, November 8th I was petting Cooper and felt a hard mass on the back of his neck so Inspected this and noticed he had dry blood there and touching around (he has a lot of hair around his scruff) noticed two areas that seem to have dried blood around them. Took him to day care for the day and, again, Renata noticed the same two holes and investigating further her finger went i right into one of the holes!I I And there was oozing going on down there so she realized there must be an Infection. When 1 picked Cooper up that Sunday she told me about It....said she would have called me but since it was Sunday and vets are closed and I would have gone nuts,she waited until I picked him up. Got home with Cooper and,again,called Matt Noone and told him what we found and told him he had to come to the house to see this. Monday, November 9th called the vet first thing and took Cooper over at 9AM .....Dr. Mary Ware saw him and was shocked and immediately said all the wounds were from the shock collar and, actually,she found another two perforations. All of them were symmetrical. She asked that Cooper be bathed and then shaved the areas and treated them. I brought Cooper home and called Matt Noone again at 11:13 AM and told him to come and see the dog. Tuesday, November 10. He did come that afternoon around 4:30 and immediately said it was not j the collar but a bite. I told him the vet had categorically said It was from the shock collar but he continued to argue it was a bite. So I mentioned it had to be one of his dogs(he had told me he had three large dogs)that had bitten him and he then said it couldn't be because he only had ONE dog and it was old and had no canines. He did apologize for the dog being in that condition,that he had trained Cooper the first two weeks but, because of his wife's illness, had passed Cooper on to someone else for the last week. As he left he said he would give Cooper private lessons to make up for everything(and thought....like heck you will!1). Thursday, November 12th called Matt at 9:33 and told him I was getting a report from the vet in the next couple of days. Tuesday, November 17th at 10:45AM called Matt(left message on voice mail....he never answers his cell phone)and told him I had waited long enough for him to come to me with a check for the vet expenses and reimbursement of the three weeks of training and I expected repayment by this coming Friday, November 20th or I would go the next step. To facilitate this discussion/description, I have numbered the site's major vegetated wetlands 1 through 6 running clockwise from the east side of the driveway entrance (graphic attached). To this point activities on this previously developed site have included: brushing areas between wetlands 2 and 3, predominantly but not entirely outside Commission jurisdiction; selected removal of±20% of standing trees in same area without stump removal; construction of temporary movable fencing associated with the goats; construction of a log cabin-type goat shed on a pre-existing concrete pad; brushing pre-existing bog roads and agricultural access trails around wetlands 3 and 4; resurfacing the barn driveway and parking areas with crushed stone; removing abandoned construction debris dumped around the site including significant amounts around wetland 3, south of wetland 3, around the cottage and barn; and work undertaken by the Cape Cod Mosquito Control project to clear debris and vegetation from the intermittent stream outletting No Bottom Pond, running through the site's various abandoned bogs and running offsite to the north. During our site visit you expressed special concerns for: clearing which apparently has occurred within 100' of the southwest portion of wetland 2; maintenance of the old bog road below the goat shed at the northerly side of wetland 3, and cleared trail areas south of the barn where wetland 4 appears to come within ±130' of the barn, itself. We agreed that the best way to handle the situation would be to file a Notice of Intent covering alterations-brushing, goat shed construction, trail maintenance, etc. - 11/26/2013 i Message Page 4 of 4 using the Town's GIS topographic mapping and aerial photography in lieu of an on- site survey, together with on-the-ground photographic documentation. For this filing, only portions of the site's wetlands will be flagged, specifically: the southerly side of wetland 2; wetland 3, and the northwesterly portion of wetland 4. A field report will r be provided with the NOI and the marked BVW limits will be approximated on the GIS topo together with buffer/jurisdictional limits and areas of alteration. A. M. Wilson Associates, Inc. will be providing a proposal for this work to Mr. Finley within the next 2 weeks. In the meantime, we agreed that Mr. Finley can: dispose of the brush piles currently on the property; relocate the portable goat fencing to the south side of the stone wall which runs east/west south of wetland 2; and continue removal of abandoned construction debris so long as no tree cutting within 100' of any wetland resource is required for its removal (i.e. machines will be staged on existing bog roads and agricultural trails and debris will be removed using hand labor and/or chain winches). Existing permanent animal enclosures may be maintained and used. Dog training may proceed in open areas of the site in accordance with zoning limitations, and other normal residential site uses in but requiring no further alteration of areas under wetland jurisdiction may proceed. In fact, Matt was to be looking to secure a commercial location for the training of his client's dogs. I would caution all parties to be mindful that an approval of any plan with that type of notation should not be construed to be the approval of the noted use-that would be left strictly to the Building Commissioner or the ZBA.. I will also add that during my last inspection I did not find any violation outside nor did I hear any noise indicative of kennels or an inordinate number of dogs. I spoke to the tenant who admitted it was his intention to construct a training facility. We discussed the zoning restriction preventing him from doing this as of right as well as kennel license requirements and restrictions (state) for breeding (private citizen vs.. commercially). He was informed about the number of dogs he may keep (by Charlie) and I explained that he cannot have other dogs on site for training. I reminded him that even though he has 26 acres of land, we still received noise complaints and that is why kennel licenses are no longer granted to residential addresses. While we were there we heard a pack of dogs in the garage (the tenant said they were puppies about 5 months old). We did not see the pups but they sounded larger than a litter of young pups. We heard a couple of dogs in the house and there were two shepherds in two temporary crates on the side of the house. These crates were deemed to be too small by Charlie (I agree) and certainly did not seem secure enough to hold a large aggressive dog. I was a little worried when I walked over to check them and one became quite agitated the sight of me. I was not too sure it would hold him back so I stepped out of sight and he calmed right down. At the conclusion of this inspection, the tenant understood he needed to immediately license the 4 adult dogs he admitted to owning, could not increase the number of dogs, could not temporarily accept another dog for training purposes, could not train animals for others for profit or not on this site, cannot construct a training facility, cannot breed dogs for profit or donation and the site is strictly and clearly limited to a single family home use. Furthermore, he was also advised to notify the landlord to register the property as a rental and immediately follow up on leads provided to him for appropriately zoned locations that would accommodate his intended commercial uses. It is my understanding that the landlord has contacted the Health Div and has agreed to register the property as a rental per the requirement. I am also informed that the landlord will be provided with my contact information in order that I may review the restrictions cited above directly with him and respond to any questions he may have. You should know that previous reports of guns shots and fireworks may not have actually occurred on this site but may have been from the training range which was in operation during the alleged timeframe. I did not see any evidence of training activities, weapons or remnants of fireworks (launching residue).
