This firm represents James A. Jenkins, Trustee of the Jenkins Nominee Trust, and Fred
Jenkins with respect to the property known as and numbered 471 Parker Road in West
Barnstable, Massachusetts (the"Jenkins Property"). To provide brief background, on March 21,
2014, Gregg and Rebecca Anderson purchased property abutting the Jenkins Property, known as
and numbered 441 Parker Road (the "Anderson Property"), which is also shown as Lot 3.on the
enclosed Approval Not Required Plan (the "ANR Plan"). As you will see from the ANR Plan,
there is an easement to the electric company that encompasses a large portion of the Anderson
Property (the "Electrical Easement Area"). In addition, the driveway which is supposed to serve
the Anderson Property is shown as "Easement 1" over Lot 2 (which is owned by Ruth E. Jenkins
et al.). As you may be aware, that driveway has been constructed and is available to access the
Anderson Property.
I have also enclosed a copy of Plan Book 284, Page 18 (the"Traveled Way Plan"), which
shows a"traveled way" within the Electrical Easement Area, and which used to serve as my
client's access to their cranberry bogs. The use of that"traveled way"by my clients was
permitted as part of the cultivation of their bogs, per the language of the electrical easement. My
clients' firm belief is "good fences make good neighbors" and so, after discovering that the
"traveled way" is in fact located.on both parcels (and not mostly on the Anderson Property, as
depicted on the Traveled Way Plan), rather than agreeing to a reciprocal easement to share use of
the"traveled way", my clients moved the access to their.bogs so that it is entirely within the
boundary of the Jenkins Property, such that they did not have to travel over the Anderson
Property. We were in touch with Northeast Utilities as part of this process. Further, my clients
notified the Andersons that they were not permitted to use the portion of the "traveled way" on
the Jenkins Property. From the beginning, the Andersons have used the "traveled way" to access
the Anderson Property.

My clients feel confident that the Andersons intend to use the portion of the "traveled
way" on the Anderson Property as their primary driveway access and not the "Easement 1"
shown on the approved ANR Plan. After speaking with Northeast Utilities, it is our
understanding that the use of this area as a driveway within the Electrical Easement Area is in
violation of Northeast Utilities policies. I am also contacting Northeast Utilities with respect this
matter to confirm whether they plan to install a locked gate for the second driveway in the
approximate location of the old"traveled way".
In addition to concerns about traffic and runoff so close to their cranberry bogs, my
clients are very concerned that third parties will use the Anderson driveway within the Electrical
Easement Area via ATVs, bicycles, horses, cars,.or otherwise to access their cranberry bogs and
cause property damage to their bogs and/or equipment. The purpose of this letter is to put the
Town on notice of the Andersons' use of the driveway within the Electrical Easement Area,
which is not shown on the ANR Plan, so that, if the Town receives any permit and/or other
applications for the Anderson Property which do not accurately reflect the Andersons' use of this
area, it will be known, to the extent it has any bearing on the Town's decisions with respect to
any such permitting/approval process.
If there is any other information`that would be helpful for your review of this matter,
please do not hesitate to contact me. For planning purposes, I note that I will be out of the office
starting Friday, August 8th, returning Monday, August 181h

With regard to the property identified as Assessor's Map 275, Parcel 010 (located
at 471 Parker Road, West Barnstable, MA), please be advised that there is LARGE,
ILLEGAL , METAL, COMMERCIAL WAREHOUSE TYPE OF
BUILDING/STRUCTURE on that property that does not show up on the
Assessor's records or in the files of the Barnstable Building Department. This is
because "a building permit was never issued"for the construction of this
particular building. In addition, the property in question is mistakenly classified as
vacant land by the Assessor's office because they were never officially notified of
its existence.
The building in question is located in an RF Zoning District, is adjacent to a pond,
and sits within an area covered by the Old King's Highway Historic District. With
these facts in mind, it is strongly believed that not only a building permit should
have been applied for, but that the matter needs to be reviewed by the Zoning
Board of Appeals, the Conversation Commission, as well as The Old King's
Highway Historic Commission.,Please verify this information, and take any and all
appropriate action to see that this matter is brought into compliance with state law
and local ordinances.
This matter has also been reported to the Town Manager as well as the
Massachusetts State Building Inspector.
This matter will be followed up on to make sure that it is properly addressed.

Relative to the above-noted matter, enclosed please find an aerial photograph of the
subject property from the Town of Barnstable, Geographical Information Systems
(GIS) office, and the "field card" of said property from the Town of Barnstable
Assessor's office. The aerial photo clearly shows the presence of the illegal
building, and the field card shows no record of any approved structure for that
property. In addition, your office has no file or record of any legally approved
construction for the site in question.
The dimensions of the metal warehouse-type building are approximately
75 feet X 38 feet.
Again, please take all necessary action to bring this property into compliance with
state and local laws.

With regard to the property identified as Assessor's Map 275, Parcel 010 (located
at 471 Parker Road, West Barnstable, MA), please be advised that there is LARGE,
ILLEGAL., METAL, COMMERCIAL WAREHOUSE TYPE OF
BUILDING/STRUCTURE on that property that does not show up on the
Assessor's records-or in the files of the Barnstable Building Department. This is
because "a building permit was never issued"for the construction of this
particular building. In addition, the property in question is mistakenly classified as
vacant land by the Assessor's office because they were never officially notified of
its existence.
The building in question is located in an RF Zoning District, is adjacent to a pond,
and sits within an area covered by the Old King's Highway Historic District. With
these facts in mind, it is strongly believed that not only a building permit should
have been applied for, but that the matter needs to be reviewed by the Zoning
Board of Appeals, the Conversation Commission, as well as The Old King's
Highway Historic Commission,Please verify this information, and take any and all
appropriate action to see that this matter is brought into compliance with state law
and local ordinances.
This matter has also been reported to the Town Manager as well as the
Massachusetts State Building Inspector.
This matter will be followed up on to make sure that it is properly addressed.
