The use does not involve the production of offensive noise,vibration,smoke,dust or other particular .matter,odors,electrical disturbance,heat,glare,humidity or other objectionable effects. A person who constructs more than one home in a two-year period shall not be considered 'a homeowner. Lot 2 on said plan consists of 37,490 square feet with frontage on Plum Street of 165 feet . Lot 2 conformed with RE zoning (35 ,000 square feet, frontage of 165 feet) in effect at the time of the P`s Page 2 k submission. Precinct 2 was rezoned to an RF zone (43, 560 ? square feet, frontage 150 feet) in 1974. Said Plan received approval under the Subdivision Control Law and was endorsed on October 3, 1977. Lot 2 was conveyed together with six other lots to Sara and Rebecca ' s Land Company, Inc. on May 25th. , 1984, Barnstable Registry of Deeds in Book 4121 , Page 340. Thereafter on the same date but recorded on May 31 , 1984, in Said Registry, Book 4126, Page 230, Sara and Rebecca' s Land Company, Inc. conveyed only Lot 2 . to the Gorals. Finally the Gorals conveyed Lot 2 to the present owner , Said Deeds in Book 4613, Page 027 , by deed dated July 2, 1985 . M.G.L. , Chapter 40A, Section 6, Paragraph 5 . . The grandfathered status of a lot approved under the subdivision control law is governed by the above cited section of the Massachusetts General Laws (supra. ) . As the Plan for this subdivision was submitted prior to January 1 , 1976' the lots thereon are only protected for seven years from the Planning Board' s endorsement . In this case the endorsement was October 3, 1977. Thus a lot would only be protected if prior to October 3, 1984 , it was held in 3 ownership not in common with abutting lots . Lot 2 is a buildable lot and should be issued a building permit . Although Lot 2 does not conform with an RF zone as to square feet , it was properly approved under the Subdivision Control Act in effect at the time of submission as an RE zoned Lot . Said approval under Massachusett ' s Law protected said lot until seven years from the endorsement of the Planning Board. .
