Filed August 7, 1996 Public Hearing September 11, 1996 Decision Duel 00 days from Filing Background: The locus of this appeal is shown on Assessor's Maps as two parcels, identified as Map 216, Parcels 70 and 71 and addressed as 22 and 28 Ridge Road, West Barnstable, MA. The property is located in an RF Residential F Zoning District. There is an existing 2,168 sq. ft. single family dwelling on Lot 70. The applicant is proposing to build an additional house on Lot 71. The lots are presently combined for zoning purposes. The two lots appear to have merged by the fact of common ownership. They were owned by David Troe,jointly with • Christina Rodanas or Christina Troe, since the 1970's. Zoning in this area was changed to one acre in 1974. According to Section 4-4.2 2) of the Zoning Ordinance, property owners holding two or three adjoining undersized lots have.a period of five years to build from the date of a zoning change which would make them nonconforming but must meet certain requirements. Requirements for this"grandfathering" provision include 1) Lots must have at least 7,500 sq. ft. and 75' of frontage; 2) Lots must have been recorded or endorsed on a plan that conformed to zoning when legally created and 3) Must have conformed to applicable zoning requirements as of January 1, 1976. The size and frontage of these lots fits the first criterion; as for the second the lot was created by a plan approved by the Board of Survey in 1955, so it would technically not have'conformed to zoning when legally created, although the applicability of this section is questionable; and as for the third, one acre zoning was authorized by Town Meeting on April 4, 1974, so these lots would not have conformed to zoning in 1976 and would not have the five year protection. Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. Staff Comments/Recommendation: Although the lot in question appears not to have the benefit of any grandfathering protection, it is one of many additional lots of about 20,000 sq. ft. in this area which have all been built on (see attached diagram.) All other lots in the Board of Survey plan which created this lot are built on. If the Board should find to grant these Variances, it may wish to consider the following condition to be imposed on both lots: 1. On-site wastewater disposal septic shall conform to all requirements of Title V without variances from the Board of Health.
