Both buildings are in an advanced state of deterioration , are open to the weather and are structurally unsound. They both should be torn down as soon as possible. P � v Page 1 draft - 5/7/96 SANDY NECK POLICY PLAN RECOMMENDATIONS I. GOAL: To preserve the present character of Sandy Neck for the future, especially, its vast open space and distinctive buildings A. Policy: To acquire all vacant, privately owned, developable parcels Strategies: • Acquire land that may be in tax title. Several parcels on Sandy Neck are in tax title. • Use funds from grant programs such as the Open Space Bond Bill'for acquisition of open space on Sandy Neck. Leverage these funds with contributions from land trusts and larger land conservation organizations if possible. • Investigate through the Town Attorney the feasibility and legal issues involved in negotiating conservation restrictions or purchase of development rights from Sandy Neck property owners B. Policy: Ensure that any new building, expansions or reconstruction is compatible with existing styles of building on Sandy Neck Strategies: • Zoning should be adopted to restrict the height of buildings to that which would be consistent with the existing small cottages and gunning shacks. • Expansions should be restricted to the same footprint area and enclosed air space volume of the present building. Enclosed air space should be defined in the ordinance to exclude sleeping porches and similar partially enclosed areas. • Changes and expansions to existing buildings should be reviewed by boards of applicable historic districts, preferably using special design guidelines which reflect this area's distinctive building styles. • The town should stipulate that its leased cottages, and privately owned cottages on land leased from the town, stay as they are, without enlargements; and that these buildings be maintained; • Repair or reconstruction of cottages or gunning shacks should be exempt from the I.:j,O requirement to raise the bottom floor to the base flood elevation as currently INV / provided for buildings on the National Register in the Zoning Ordinance. All of the /✓ buildings on Sandy Neck are on the State and National Register of Historic Places. C. Policy: Foster a sensible approach, appropriate to the characteristics of this area, to enforcement of regulations Strategy: • Educate Sandy Neck property owners with regard to federal, state and local regulations which may affect their properties such as building code, flood insurance, etc. II. GOAL: Protect Sandy Neck's natural resources including barrier beach and associated land forms, wetlands, groundwater, and plant and wildlife habitat. Extend similar protection to archaeological resources. A. Policy: Limit the amount of new development in this area to a minimum. Strategy. • Increase the minimum lot size to protect the dunes and maintain the quality of drinking water if additional development does occur. B. Policy: Protect plant and wildlife habitat by reducing opportunities for disturbance from vehicle traffic and pedestrians Strategies: • Review provision of access near the most sensitive habitat areas and archaeological sites. Make reasonable efforts to direct access to avoid impacts on these resources. • Maintain a 300 foot buffer zone to identified habitats for rare and endangered species • Adopt appropriate guidelines for management of habitat and incorporate in all management plans for Sandy Neck. • The Conservation Commission should tighten requirements for building on Sandy Neck to protect resources in the ACEC. Policies concerning clearing, excavation and grading of land, buffers between activity or construction and wetlands, vernal pools and other resources, should be adopted. C. Policy: Protect groundwater, particularly on beach point where this is used as a source of drinking water. Strategy: • The Board of Health should continue to investigate methods for wastewater disposal for the Beach Point area which should be capable of handling major variations in flows, with limited needs for maintenance.. This may include obtaining state acceptance of existing outhouses. D. Policy: Promote responsible aquaculture which considers affected resources Strategies: • The town should support grant programs for purchasing shellfish seed • The town should investigate involving the schools in assisting to raise shellfish seed to learn about this resource in a practical way Ill. GOAL: To encourage uses or activities on Sandy Neck which have a general benefit for town residents A. Policy: Expand selected facilities which support educational programs Strategies: • An interpretive center, as proposed in the Local Comprehensive Plan, should be built near the entrance to Sandy Neck to provide information about Sandy Neck and educational programs for visitors • The town should investigate attracting "Dune tours" similar to those available in Provincetown to provide information about the area to tourists and other visitors. • Educational uses should be encouraged, and kept available to students of a wide range of abilities and backgrounds. B. Policy: Improve access to Sandy Neck for all town residents and provide appropriate support for visitors Strategies: • Use some type of signage (budget permitting) to indicate what activities are allowed in different areas at the gatehouse. • Signage for trails, including walking trails, would be helpful, as long as it is very low key in style. • Some type of benches should be provided along trails. A simple, rustic, natural style bench made from a log, with a slice sawed off the top for a seat, would be appropriate, but formal wooden or metal benches, would not. • Motorized and off-road bikes should be prohibited on Sandy Neck except for authorized patrol vehicles. • Boardwalks should be constructed over fragile areas, and the concession area reconstructed. • When funds for rebuilding the parking are available, the town should consider an appropriate arrangement of parking that respects the potential for erosion on the front beach. Handicapped parking should have priority for any spaces that remain in this area. To reduce the need for parking at the site, some type of shuttle bus should be considered. This would require a centrally located parking lot that could serve as a starting point for the service. The Cape Cod Community College could serve this need, but wherever the facility is finally located, it should be north of Route 6A and reasonably close to the beach. • The beach at Sandy Neck should be made handicapped accessible. This could be accomplished using portable mats that are laid down on the sand once a path is laid out, but whatever the method, costs will be a concern. Sandy Neck would be a good place to use the special wheelchairs that have been developed that can go in the water. IV. GOAL: To consider the town's potential financial gain from Sandy Neck without compromising other goals Strategy: • When the present leases for land and/or buildings expire, these should be renegotiated at fair market value. There should be ample time allowed to inform leaseholders and help them understand the reason for this policy. The transferability and potential sale of leases should be carefully reviewed. Abutters also have input through Notice of Intent filing procedures. Permit requirements will effect economic use. • Leases will not produce large sums of revenue unless modified to fair market value and competitively bid. • Dichotomy between recreation and conservation agendas may limit enterprise opportunity. Policy plan will help. • User fees could be a source to generate additional dollars but might negatively.impact the traffic flow. • Evaluating the time period of collecting revenue may increase dollars in the parking lot program. Recommendation - Enterprise Operation • Presently, the Sandy Neck Cash Flow Program is not solid enough to support an Enterprise Operation. • Discussion is taking place of how to protect the Neck that brings into play policy with respect to use which must be finalized. • Local, State, and Federal discussion is taking place in determining flexibility with traffic involving Section 10 (plover protection), this will directly impact the revenue stream. Presently, the Sandy Neck Operation is not in a financial position to involved themselves in a land taking program. • Suggest we review this enterprise scenario further when the finances are more solid with respect to all operational expenditures and when the policy direction of protecting the Neck is in place. APR 2 .4 (1995 Town of Barnstable Zoning Board of Appeals 6 AE Decision and Notice ,4 Special Permit — Change in Non-Confor ningilElse P 3 3 Appeal Number 1995-29—Lyons Summary Granted with Conditions Applicant&Owner Jack Lyons Address: 9725 Wyman Way,Upper Marlboro,Maryland 20772 Property Location: Trail No. 5 Sandy Neck,in West Barnstable,MA Assessor's Map/Parcel: 303 -007 Zoning: RF-I Residential F-I Zoning District Applicant's Request: Special Permit in accordance with Section 4-4.2 Change of a Non-Conforming Use to remodel an existing cottage and add a second floor. Background Information: The 6.03 acre lot located on the south side of Sandy Neck borders on the Great Marshes and Barnstable Harbor. According to the Assessor's Record,the lot is developed with an 825 sq.ft.one story,unheated cottage structure and a 32'by 44'detached garage. The five room cottage contains two bedrooms,one bath and no basement. The applicant has been before the following Boards and Commissions: • Old King's Highway Regional Historic District Committee of the Town of Barnstable-Approved June 01, 1994. • Cape Cod Commission Development of Regional Impact-Approved with Conditions May 12, 1994 • Town of Barnstable Conservation Commission-Order of Conditions issued October 17, 1994 • Town of Barnstable Board of Health-Variance for on-site sewage disposal system,March 07, 1994 This applicant was directed by the.Building Commissioner to the Zoning Board of Appeals due to the fact that the lot upon which the building is located does not have road frontage as required today. Procedural Provisions: The application was filed on January 24, 1995 and scheduled for hearing before the Zoning Board of Appeals on March 15, 1995. This application is requesting a special permit to remodel an existing cottage and add a second floor. Board members sitting on these appeals are:Tom DeRiemer,Dexter Bliss, Richard Boy,Emmett Glynn and Chairman Ron Jansson. Leslie Ann Morse,Esq. representing the applicant explained that Mr.Lyons would like to demolish the whole cottage except the gunning shack. They would like to turn that sideways to preserve and maintain it. Chapter 40A, Section 6 allows for reconstruction where alteration or reconstruction does not increase the non-conformity as does Section 4-4.2 of the Zoning Ordinance. According to the petitioner,Mr.Lyons'family has owned the property for generations. It was part of the 59th lot and was not owned by town. They have OKH, Cape Cod Commission, Conservation Commission and Board of Health approvals. This property was deeded sometime around 1879 and a gunning shack was built prior to the adoption of Zoning in this town,but it had no frontage. Therefore it was and still is non-conforming. The house complies with the Zoning Ordinance other than the problem of frontage. Zoning Board of Appeals Decision and Notice Appeal Number 1995-29—Lyons All of Sandy Neck is a barrier beach and upland dunes and coastal dune barrier beach. Public Comment: There was no comment either in favor or opposed although a letter of opposition was read into the record from Rob Gatewood. Ralph Crossen commented that this property is on the marsh side and abuts the marsh. It is essentially all waterfront. This is considered a coastal zone and cannot have flood insurance any more under the new federal rules. It is considered uninhabitable by federal standards. It is rare to have structures in this zone. However this plan is a substantial improvement from what is there now. Mr.Hayes tried to reassure the Board that as part of the Conservation Commission's Order of Conditions they had set up descriptive protocol regarding the impact to the sand dunes and the wildlife. FINDINGS: Dexter Bliss made a motion to accept the following findings: Regarding Appeal Number 1995-29: 1. There is no intended change in use from residential use on this parcel of land. 2. The applicant has testified as to not being in violation of the yard setbacks or any other Zoning Ordinance except the frontage. 3. The applicant has obtained approvals from OKH,Cape Cod Commission, Conservation Commission and Board of Health relative to the proposed modification and he will save the gunning shack which has historical significance. 4. As this is residential use the proposed modification would not result in a substantial detriment to the area nor is the granting of this permit in contradiction of the Zoning Ordinance. 5. This parcel lacks frontage which is common to all dwellings on Sandy Neck and it does not represent a significant detriment. Seconded: Emmett Glynn VOTE: AYE:Tom DeRiemer,Dexter Bliss,Richard Boy,Emmett Glynn and Chairman Ron Jansson. NAY: None Based upon the positive findings of this Board a motion was made by Dexter Bliss to grant the relief requested in Appeal Number 1995-29 with the following conditions: 1. Background Information: The 0.25 acre parcel is located on the south side of Sandy Neck bordering on the Great Marshes, Scorton Creek. According to the Assessor's Record,the lot is developed with a 380 sq.ft. one story,unheated cottage structure. The one room wood frame cottage has no indoor bathroom facilities,no basement and no heat. The land upon which the structure is located is controlled by the Town of Barnstable and is apparently under a lease agreement with the Town. Standing appears to be granted the applicant by the December 2, 1994 letter from the Town Manager to Mr. Norman Hayes. The applicant has been before the following Boards and Commissions: • Old King's Highway Regional Historic District Committee of the Town of Barnstable-Approved January 26, 1994. • Town of Barnstable Conservation Commission Order of Conditions -Issued June 24, 1994 • Town of Barnstable Board of Health,approval for reconstruction without a new on-site septic disposal system-November 03, 1994 The applicant was directed by the Building Commissioner to the Zoning Board of Appeals due to the fact that the lot upon which the building is located does not have frontage as required today. The proposed structure to be added was a previous"lean-to"and was apparently destroyed in 1991 by Hurricane Bob. The 12 month limitation on rebuilding of damaged non-conforming structures(Section 4-4.3(1))has expired and the proposed,reconstruction is now being considered as an expansion of a non-conforming structure under Section 4-4.2. Procedural Summary: lie application was filed on January 31, 1995 and scheduled for hearing before the Zoning Board of Appeals on March 15, 1995. Regarding the standing:' �p The owner of the land is the Town of Barnstable. i a Zoning Board of Appeals Decision and Notice Appeal Number 1995-30—Hayes The owner of the camp is the Hannah Wickes Island Trust. Mr.Hayes is the trustee of the Hannah Wickes Island Trust. Mr.Hayes said the Trust leases the camp from the Town of Barnstable. Mr.Hayes submitted a copy of the lease and addendum to the file. The lease is good until June 30,2002. There is a letter from Town Manager Warren Rutherford in the file dated December 2, 1995 clearing Mr.Hayes to proceed. The shed and the attached building were used as a hunting camp and pre-dated Zoning. Mr. Hayes said the shed was destroyed by the hurricane. It was 6 feet by 14 feet and it will be put back exactly the same in size. Approvals have been obtained for the shed reconstruction from Old King's Highway, Conservation Commission and the Board of Health. A discrepancy was brought to light by Building Commissioner Ralph Crossen. The Old King's Highway approval stipulated a lean-to 4 feet by 8 feet now the plan shows 6 feet by 14 feet. An amendment to the OKH approval appears necessary. OKH has approved one additional window. There is no access into the shed from the camp. Ralph Crossen,Building Commissioner continued that this area is considered a Coastal Area Barrier Beach Zone. No insurance can be obtained for a flood plane here. He is at his own risk. i Mr.Hayes said the house was built by Mr. Sergeant in 1878 as researched by Pat Anderson of the Historic Preservation Department. He was unsure about the addition of the shed but when he started as Chief Ranger of Sandy Neck in 1971 the shed was there. Chairman Ron Jansson asked for Public Comment. No one spoke in favor or in opposition. FINDINGS: Dexter Bliss In appeal 1995-30—Hayes 1. The applicant has testified to us and the records of the assessing department indicate that there was a 6 feet by 14 feet shed attached to a main cottage at locus. 2. The applicant testified the shed was destroyed by storm or an act of God. 3. The applicant testified that he could have rebuilt the structure within a year as a right but for one reason or another this period of time was exceeded. 4. The applicant has given evidence that he has complied with the requirements of the Conservation Commission and the Board of Health and the Old King's Highway on this shed. 5. There is a discrepancy between the OKH decision and the application which is before us. 6. The reconstruction of this shed would not be detrimental to the area nor would it be substantially in derogation of the intent of our Zoning Ordinance. 7. According to the Assessor's Record,the lot is developed with an 825 sq.ft.one story,unheated cottage structure and a 32'by 44'detached garage. The five room cottage contains two bedrooms,one bath and no basement The applicant is seeking a Special Permit to allow for the redevelopment and maintenance of a Windmill in connection with a proposed expansion and improvement of the seasonal cottage(Appeal No. 1995-29). Procedural Provisions: This application was filed on January 24, 1995,a public hearing duly notices and advertised in the Barnstable Patriot was held March 15, 1995. The Board reached its decision to grant this 'request at the close of that public hearing on this appeal. Board members hearing this appeal were:Tom DeRiemer, Dexter Bliss,Richard Boy,Emmett Glynn and Ron Jansson, Acting Chairman. Leslie Ann Morse,Esq. representing the applicant submitted pictures to the Board of the windmill as it exists today. She explained that the windmill has existed since 1930 and that it was the applicants intent to re-establish a new windmill as the existing windmill is not structurally safe. The existing windmill base is 6 feet by 8 feet and its height is 28'feet. The applicant would like to rebuild the structure and add a wind generator with three blades and a rotor. Mr. Lyons explained his plan was to get the windmill back as it was during the 40s and 50s,when it was used to generate electricity.The proposed changes would minimize the use of a asoline generator. Mr. Lyons is an electrical engineer and would like to retire to Sandy Neck during t1t summer months. The proposed windmill tower would be 28 feet high not including the blades. The Board requested public comment. There was no comment either in favor or opposed. Findings: At the hearing of March 15, 1995,the Board unanimously found the following findings of facts regarding Appeal Number 1995-28--Lyons for a Special Permit to allow a Conditional Use of a Windmill: Zoning Board of Appeals Decision and Notice Appeal 1995-28—Lyons 1. There has been,based on the testimony of the applicant and his representatives,in the past an operating windmill on the site,evidence of which we have seen in photographs as a framework for a tower. 2. A windmill is allowed by Special Permit as an accessory use to a residence. 3. The applicant has indicated to this Board that at a center point on the wind generator the maximum height would be 32 feet. 4. The applicant has indicated to this Board that there is minimal noise from this windmill except at high wind speeds and that in any event the sound will not be heard by cottages in the area as they are remote from this location. 5. The utilization of a windmill being powered by a renewable resource would be more beneficial to the area than the utilization of gas or other type fuel generators. Decision: Based upon the affirmative findings of the Board a motion was duly made and seconded to grant the Special Permit requested in Appeal Number 1995-28 with the following conditions: 1. The windmill or any part thereof,shall not exceed 30 feet in height from the ground to the highest point. 2. The design of the windmill shall meet the requirements of the Old King's Highway Historic District Committee. 3. The sound created by this windmill shall not exceed the noise limits of the Town of Barnstable Anti Noise Ordinance. Background Information: The 6.03 acre lot located on the south side of Sandy Neck borders on the Great Marshes and Barnstable Harbor. According to the Assessor's Record,the lot is developed with an 825 sq.ft.one story,unheated cottage structure and a 32'by 44'detached garage. The five room cottage contains two bedrooms,one bath and no basement. ' The applicant has been before the following Boards and Commissions: • Old King's Highway Regional Historic District Committee of the Town of Barnstable-Approved June 01, 1994. • Cape Cod Commission Development of Regional Impact-Approved with Conditions May 12, 1994 • Town of Barnstable Conservation Commission-Order of Conditions issued October 17, 1994 • Town of Barnstable Board of Health-Variance for on-site sewage disposal system,March 07, 1994 This applicant was directed by the Building Commissioner to the Zoning Board of Appeals due to the fact that the lot upon which the building is located does not have road frontage as required today. Procedural Provisions: The application was filed on January 24, 1995 and scheduled for hearing before the Zoning Board of Appeals on March 15, 1995. This application is requesting a special permit to remodel an existing cottage and add a second floor. Board members sitting on these appeals are:Tom DeRiemer,Dexter Bliss,Richard Boy,Emmett Glynn and Chairman Ron Jansson. Leslie Ann Morse,Esq. representing the applicant explained that Mr.Lyons would like to demolish the whole cottage except the gunning shack. They would like to turn that sideways to preserve and maintain it. Chapter 40A, Section 6 allows for reconstruction where alteration or reconstruction does not increase the non-conformity as does Section 4-4.2 of the Zoning Ordinance. According to the petitioner,Mr.Lyons'family has owned the property for generations. It was part of the 59th lot and was not owned by town. They have OKH, Cape Cod Commission,Conservation Commission and Board of Health approvals. This property was deeded sometime around 1879 and a gunning shack was built prior to the adoption of Zoning in this town,but it had no frontage. Therefore it was and still is non-conforming. The house complies with the Zoning Ordinance other than the problem of frontage. r Zoning Board of Appeals Decision and Notice Appeal Number 1995-29—Lyons All of Sandy Neck is a barrier beach and upland dunes and coastal dune barrier beach. Public Comment: There was no comment either in favor or opposed although a letter of opposition was read into the record from Rob Gatewood. Ralph Crossen commented that this property is on the marsh side and abuts the marsh. It is essentially all waterfronL This is considered a coastal zone and cannot have flood insurance any more under the new federal rules. It is considered uninhabitable by federal standards. It is rare to have structures in this zone. However this plan is a substantial improvement from what is there now. Mr. Hayes tried to reassure the Board that as part of the Conservation Commission's Order of Conditions they had set up descriptive protocol regarding the impact to the sand dunes and the wildlife. FINDINGS: Dexter Bliss made a motion to accept the following findings: Regarding Appeal Number 1995-29: 1. There is no intended change in use from residential use on this parcel of land. 2. The applicant has testified as to not being in violation of the yard setbacks or any other Zoning Ordinance except the frontage. 3. The applicant has obtained approvals from OKH, Cape Cod Commission,Conservation Commission and Board of Health relative to the proposed modification and he will save the gunning shack which has historical significance. 4. As this is residential use the proposed modification would not result in a substantial detriment to the area nor is the granting of this permit in contradiction of the Zoning Ordinance. 5. AUTHORITY OF THE SANDY NECK GOVERNING BOARD At the November 1, 1980 Town Meeting, the Town of Barnstable amended its Charter by adding a new section 6 to Article XVII. This amendment, subse- quently approved by Special Act of the Legislature and by the Governor, became effective cal April.9, 1981. The rent hereunder shall be Three Hundred ($300 .00) Dollars annually through June 30 , 1987; Four Hundred ($400 . 00) Dollars annually for* the next five (5) years through June 30 , 1992 ; Five Hundred ($500 .uu) Doiiars annually for the next five (5) years through June 30 , 1997 ; and Six Hundred ($600 . 00) Dollars annually for the final five (5) years of the term hereof. Additional rent may become payable hereunder if the' i5 used for rental purposes , which additional rent will be determined, billed and paid as provided in paragraph ' 8 (C) ' of this Lease Agreement. At the end of said twenty (20) years , or sooner ; in the, event the tenancy is earlier terminated under the provisions of this lease , or the cottage is more than Fifty percent damaged or destroyer i -2- by fire, storm, Act of God or other casualty under paragraph 16 ' below, the cottage or remaining portion thereof shall be removed from the said Lot, by the Cottager, within one hundred eighty (180) days , unless a further agreement has been executed by the Board and the Cottager, prior to such expiration, termination or destruction. The parties hereto hereby j agree to enter into discussions, as an act of good faith, on an extension, I renewal or termination of this lease no later than January 2001. (1) Quiet Enjoyment The Board agrees that the Cottager, on paying said rentals and per- forming the covenants, agreements and conditions herein contained to be I observed and performed by the Cottager, shall and may, peaceably and quietly have, hold and enjoy the Lot for the term of this Lease. It is understood and agreed that the Cottager, his family and guests , shall have the right to pass and repass on foot, vehicle and otherwise, over such trails on Sandy Neck adjacent to the subject lot, which trails are owned or controlled by the Board, subject to the right of the Board to control. the same, provided, however, this shall not constitute a Sandy Neck vehicular permit or any right to one contrary to the applicable rules and policies of the Board•. (2) Improvements , Alterations or Changes of a Cottage The Cottager may make improvements , alterations , changes and additions to the cottage at the Cottager ' s expense. No such improvements , alterationE or changes may be made contrary to any applicable law, code, regulation of guideline including any of such promulgated by the Board which are of gen- eral application to all cottages on Sandy Neck , including those on private .}. owned land, nor shall any such be made without all necessary permits . The Cottager will notify the Board in writing concurrently with making appli - cation for any and all permits and will deliver or file with the Board, copies of all documents submitted in aid of any such application and will -3- give the Board .notice by telephone, confirming by letter as to the time, date and place of any relevant hearings or conference with public author- ity relating to such application, but the Cottager will refrain from taking any one or more of such steps to the extent the Board shall have waived any such requirement. (3) Maintainance and Compliance With the Law The Cottager agrees to keep and maintain .the cottage in a neat and attractive manner and to keep and maintain the lot free of rubbish and debris all in consonance with the Board's purpose to preserve the prim- itive, rustic, barrier beach nature of Sandy Neck, which is its most unique feature. The Cottager likewise agrees to maintain the cottage and the lot in compliance with all applicable laws, rules , regulations and guidelines of all Federal, State and Municipal Governments having juris- diction and to indemnify and- save harmless the Board from and against any and all claims, liability, fines , penalties and costs arising out of any violation of any thereof. (4) Use of Cottage The Cottager agrees the cottage will be used only as a place of single family residence and recreation to be occupied only by the Cottager, his family and non-paying guests. This shall not . prevent the Cottager from renting his cottage for similar use by his tenant if such renting is other-. wise permitted hereunder. (5) Public Liability Protection The Cottager agrees to indemnify and save harmless the Board from and against any and all claims , liabitities , losses and damage out of injuries to persons , including injuries resulting in death or damage to property of others , caused by or resulting therefrom the use and occupancy of the cot- tage and the lot by the Cottager , the Cottager ' s guests or tenants . The Cottager agrees to procure and maintain at his own expense and without cost -4- or liability on the part of the Town of Barnstable or the Board therefor, public liability insurance with a reputable and financially responsible insurance company safeguarding the Town of Barnstable, the Board and the Cottager against liability for injuries to persons , including injuries resulting in death caused by or resulting from the use and occupancy of the cottage or the lot with a single-combined limit of $250 ,000 .00 for injuries sustained by any one or more persons in any one accident, and $25, 000 . 00 for damages to property or injuries sustained. (6) Destruction of the Cottage If the cottage is more than fifty percent (50%) damaged or destroyed by fire, storm, Act of God, or other casualty, as determined by an inspect- ion by the Building Inspector• of the Town of Barnstable and an independent agent of the Lessee, said inspection to be made within thirty (30) days of the casualty loss, and a written report on same to be delivered to the Board within fourteen (.14) days thereafter, then it is understood between the parties hereto that the Cottager will not have the right to rebuild the said cottage. If such damage or destruction occurs to the subject premises, this lease shall cease and terminate and the Cottager shall. be liable for rent only up to the time of such damage or destruction. (7) Default - Board's Election tc Terminate If default is made by the Cottager in the payment of the rent -due hereunder, and such default shall continue for a period of thirty (30) days after the Board shall have made demand of the Cottager for payment of such past due rent, or if default be made by the Cottager in the observance, or performance of any of the other covenants , agreements and conditions herein contained to be observed or performed by the Cottager , and such default shall continue for sixty (60) days (or such reasonably longer period as the circumstances may require) after written notice thereof shall have been given by the Board to the Cottager, or if the -5_ Cottager be adjudged bankrupt, or insolvent by any Court, or if a pet- ition in bankruptcy shall be filed by the Cottager, or if the Cottager shall make an assignment for the benefit of creditors ,, or if a Receiver shall be appointed for the Cottager, then and in any such case, it shall be lawful for the Board at its election to declare this Lease terminated Whereupon the Cottager's rights hereunder shall forthwith cease and be at an end. (8) Guests - Renters The idenity and character of the lessee of any lot is determined by the Board ( and recognized by the Cottager) to be a matter of significance. Generally speaking, the Board has determined that the use of the cottage as a single-family residence and for recreation by the Cottager is consistent with the conservation goals applicable to Sandy Neck. Commercial use thereof is determined by the Board (and acknowledged by the Cottager) to present the possibility of serious detriment to such goals . To provide reasonable flexibility to the Cottager, but to insure furtherance of the Board's goals , the following terms and conditions shall apply. a) Guests No Board approval is required for non-paying house guests while the Cottager is in actual residence. When the Cottager is not in actual re idence, he may, with prior written notification, permit use of the cottage to non-paying guests , so long as such does not extend to more than seven (7) consecutive days within any thirty (30) day period. Written notifi - cation to. the Chief Ranger or Gate House will be acceptable in this is- stance only.. b) Casual Renters of Cottage The Cottager may , with prior written notice to the Board, and with- out payment of additional rent, rent the cottage to others , but this pri- vilege may not be exercised by the-Cottager for a period in excess of seventy two (72) hours during any thirty ( 30) consecutive days . -6- c) Long-Term Renters Except as provided in paragraph 18 (b) ' , the Cottager may not rent the cottage to others except in conformance with' the following provisions : 1. The Cottager may, with prior written approval of the Board, rent the cottage to others for such periods and upon such terms as the Cottager may determine, in which case the Cottager will pay additional rent annually, equal to the annual rent from time to time in force hereunder for a total annual rental of twice the amount specified on page one of this Lease. Unless the Cottager's tenant is identified in an additional addendum here- to, initialed by the Board and the Cottager, the Cottager shall advise the Board in writing at least ten (10) days prior to occupancy, as to the ident- ity of any prospective tenant and the time and term of the tenant's occup- ancy and shall provide any additional information which the Board may reasonably require. The Board shall, if circumstances warrant, prohi.bit occupancy by such tenant, but such prohibition will not be issued unrea- sonably. d) Use by Family Members Anything herein to the contrary notwithstanding, the Cottager may permit the cottage to be used by his parent, grandparent, child, grand- child, brother or sister, or any person standing in such relationship to his spouse, provided that such person' s occupancy shall be limited to the use stated in paragraph' 4 ' above. (9) Transfer or Sale of Cottage (a) Transfer of Cottage - Assignment of Lease The Cottager may, without further approval of the Board, assign all the Cottager ' s rights under this Lease in a transaction attended by the Cottager' s transfer of all his right, title and interest in the cottage if the transferee of the cottage is a person specifically identified in an addendum attached hereto. -7- (b). Transfer of Cottage to Other Than Permitted Transferee The Cottager may, with prior written consent of the Board, transfer the cottage and therby assign this Lease if the prospective buyer is a resident or taypayer of the Town of Barnstable... A transfer hereunder must be preceeded by at least ninety (90) days written notice to the Board, identifying the prospective transferee and spelling out in reasonable detail, the circumstances and terms of the transaction. The Cottager shall furnish to the Board such additional relevent information as it may reason- ably request. At the expiration of such ninety (90) day period, the Cot- tager may proceed to implement the transfer and assign this Lease unless prior thereto, the Board, with written notice to the Cottager, shall have decided to exercise its first refusal rights.. (c) The Board's First Refusal -Rights Upon Transfer of Cottage In any case in which the Cottager proposes to transfer the cottage to someone other than a permitted transferee, ' 9 (a) ' , the Board shall have the right of first refusal- whereby it may, within ninety (90) days from the Cottager' s notice of intent to transfer, state its intention to purchase whatever rights the Cottager may have in the cottage at a price no less than the price .specified in good faith in the Cottager' s notice of intention . The right of first refusal shall expire upon the failure of the Board to tender a check in the amount of the purchase price within sixty (60) days following the adjournment of the next Town 'Meeting for which the warrant is closed at least two (2) weeks after the Cottager' s notification of in- tent to transfer. (10) Death of Cottager The Cottager may by Will bequeath his rights in the cottage to any I: Permitted Transferee who shall thereupon be substituted as Cottager for the . balance of the original term. (See Paragraph 19 (a) ' Premitted Transferee) i J f -8- (11) No Mortgage, etc. by Cottager The Cottager covenants and agrees that he will not suffer or permit a mortgage or lien or any other .encumberance to be attached to the cottage or the Cottager' s rights or any part of them hereunder. (12) Notice to Parties It shall be a sufficient giving of any notice, request or other communication in writing hereunder by a party to this agreement to the other party desiring to give such notice, request or other communication shall deposit a copy of the -same in the Post Office for transmission by e Registered. Mail or Certified Mail in an envelope properly addressed, postage prepaid, to the other party at the address herein set forth . The date of giving of any such notice or other communication in writing shali be construed to be the date on which. said copy was so deposited in the Post Office, properly addressed. as aforesaid. The Post Office receipt. showing the deposit of such envelope and the date of such deposit shall he prima facie evidence of these facts . Any notices to the Town shall be addressed to the Board at: Sandy Neck Governing Board P.O. Box 243 West Barnstable, Massachusetts 02668 Notices to the Cottager shall be addressed to' each Cottager at the address shown in the dxecution clause hereof. The foregoing address for, notices may be changed from time to time by the prospective addressee by written. notice addressed to the other party as herein provided. (13) No Personal Liability of Board Members The Members of the Board, in executing this Lease, are acting as officers of the Town and are not in their individual capacities , and shall. . have no personal liability to the Cottager hereunder. (14) Cottager ' s Reservation of Rights - Eminent Domain If the cottage shall be taken or condemed by any competent authority for any public use or purpose , the Cottager waives any right to prosecute a claim for any award based on his leasehold interest in the Lot , but -9- reserves unto himself all rights in respect to the cottage and to any alterations and improvements thereto. (15) Consents , Waivers Not to Extent to Future Events No consent or waiver, by either party, expressed or implied, in any instance shall operate as a consent or to waiver of the same or any dif- ferent matter on another occasion, a mere delay or failure to act in any case shall not constitute a waiver. (16) Payment of Taxes The Cottager shall pay all taxes imposed at any time during the term of this Lease upon the cottage. However, this shall not prevent the Cot- tager from initiating and prosecuting any proceedings permitted by Law for the purpose of obtaining an abatement or of otherwise contestinq the I validity or the amount of taxes assessed to or levied against the cottage .
