I have been asked to look into issues relating to the ability to obtain a building permit for the development of said parcel. The subject matter parcel is shown as Lot 2 on a Plan recorded at the Registry of Deeds in Plan Book 269, Page 38. It is also referenced as Lot 26 on Assessors Map 178. That Plan was endorsed by the Planning Board of January 15, 1973 and the Covenant Released on January 4, 1979 (copies attached). In order to address the issue of buildability, it became necessary to review the chains of title of three (3) abutting parcels given the fact that the locus parcel is non-conforming. We reviewed the title to Lots.1 and 3 on the same subdivision plan and a larger parcel which abuts the subdivision. Lot 1 (178/24) was deeded by the developers Peter,Nilda and Marie Underland to William Lieberman on May 15, 1973 (Book 1860, Page 58). William Lieberman then deeded to William Lieberman, Trustee of the White Cap Lane Realty Trust on October 17, 1973 (Book 1953, Page 39). William Lieberman, Trustee deeded the property back to William Lieberman on October 2, 1974 (Book 2104, Page 47), who on the same date deeded the Lot to Meeting House Hill Co- Operative Bank(Book 2104, Page 49). The Bank deeded the property to N. Robert Olander on Aguust 5, 1975 (Book 2220, Page 70) and N. Robert Olander deeded the property to the Olander Family Revocable Trust,Nils Robert Olander, Trustee, the current owner on July 5, 2006 (Book 21162, Page 55). Lieberman deeded to himself as Trustee of the Packet Landing Realty Trust on October 17, 1973 (Book 1953, Page 49). William Lieberman, Trustee deeded it to Beverly Lieberman on October 2, 1974 (Book 2104, Page 51). A previously granted mortgage was foreclosed and the property deeded to Meeting House Hill Co-Operative Bank on September 15, 1975 (Book 2248, Page 82). The Bank subsequently deeded to Ann E. Landsman on December 14, 1976 (Book 2441, Page 189). Ann Landsman deeded to John N. Reilly on December 11, 1978 (Book 2837, Page 141). John Reilly deeded to White Cap Corporation on January 22, 1979 (Book 2861, Page 137). White Cap Corporation deeded to John A. Irwin on April 25, 1979 (Book 2907, Page 1). John A. Irwin deeded to Mary K. and John A. Irwin, Trustees of the Garde Realty Trust,the current owner, on June 30, 1993 (Book 8735, Page 223). Lot 3 (178/27)was also purchased by William Lieberman on September 14, 1973 (Book 1939, Page 262). He then deeded to Packet Landing Realty Trust on October 17, 1973 (Book 1953, Page 49). Packet Landing deeded to Herbert 1. Cohen, Trustee of Meeting House Lane Realty Trust on October 2, 1974 (Book 2104, Page 50). Herbert 1. Cohen, Trustee deeded to Ralph Gordon on November 4, 1974 (Book 2116, Page 52). Gordon deeded to Alfred H. Lord on May 26, 1976 (Book 2344, Page 236). Alfred Lord deeded to John N. Reilly on December 11, 1978 (Book 2837, Page 136) at which point John Reilly was the titled owner of Lots 2 and 3. Reilly also mortgaged Lot 3 that same date to Meeting House Hill Co-Operative Bank. Reilly deeded to White Cap Corporation on January 22, 1979 (Book 2861, Page 137). White Cap Corporation deeded to John A. Irwin on April 25, 1979 (Book 2907, Page 1). Lot 3 was foreclosed upon by Meeting House Hill Co-Operative Bank and deeded to Charles E. McDermott on June 16, 1982 (Book 3505, Page 44). McDermott deeded to Codway, Inc., on June 24, 1982 (Book 3505, Page 49). Codway, Inc., deeded to Paul J. Lynch on April 12, 1983 (Book 3713, Page 24) and Paul J. Lynch deeded to the.current owners Joel Pl. and Darlene A. Dwyer on June 17, 1985 (Book 4583, Page 334). The adjacent parcel (Lot 33, Map 1.55) has been in ownership separate from the aforementioned properties since March 1972 when the adjacent property which became the subdivision was deeded to the Unger Lands (Book 1612, Page 333). John and Bernice Bresnehan deeded to Jeffery J. Mone in September 1988. The property was foreclosed upon by Bank of New England and deeded to NEW, Inc., on November 7, 1990. NEW, Inc., deeded to the FDIC on February 24, 1993; the FDIC deeded to Peter A. Sundelin and Nancy R. Trafton on February 24, 1993 and the properties have been.held by Peter A. Sundelin and Nancy R. Trafton in various forms of ownership since. John N. Reilly owned both Lots 2 and 3 on December 11, 1978 and deeded both Lots 2 and 3 to White Cap Corporation, on January 22, 1979, which in turn deeded the Lots to John A. Irwin on April 26, 1979. However,the conveyance to White Cap Corporation and subsequently to John A. Irwin were to subject to encumbrances of record. One of those encumbrances was their Mortgage given by Reilly to Meeting House Hill Co-Operative Bank encumbering only Lot 3 and a Parcel A (center of cul-de-sac) dated December 11, 1978 and recorded at Book 2837, Page 138 (copy attached). Massachusetts, being a title theory State, holds that the grant of a mortgage conveys legal title to the mortgaged premises to the mortgagee and the equitable title (Right of Redemption) is held by the Mortgagor. It can be argued therefore that even though both Lots 2 and 3 were conveyed by Reilly,the legal title to Lot 3 was held by the Meeting House Hill Co-Operative Bank because of the Mortgage. See Maglione, et al vs. BancBoston Mortgage Corporation, 29 Mass. App. Ct. 88 (1990). In addition, it is clear from the record that the Co-Operative Bank controlled Lot 3. On July 19, 1979, Meeting House Hill Co-Operative Bank made entry on the property pursuant to the foreclosure process. On February 25, 1980, the Co-Operative Bank entered into a Lease Agreement with the United States Postal Service for a term of five (5) years (copy attached). On June 16, 1982, it completed the foreclosure process by deeding Lot 3 to Charles E. McDermott (copy attached). In light of the information set out herein, it is suggested that if not on December 11, 1978, when John N. Reilly mortgaged Lot 3 to the Meeting House Hill Co-Operative Bank, clearly on July 19, 1979 when it made Entry and took possession of Lot 3, the ownership/control would be considered separate from that of Lot 2. Both of these dates fall within the eight (8) year protection period set forth in Section 240-91 (E) of the Zoning By-Law and it is therefore suggested that this non-conforming lot would qualify for grandfathering protection. The owner of this vacant parcel would like to place this lot on the market for sale and be able to represent that the Town would treat it as buildable, so it would appreciated if you could evaluate this information and confirm that your Department would treat this lot as a legally protected lot eligible for a building permit.
