EXTERIOR BUILDING CONSTRUCTION (new or existing buildings): An application is required for any exterior of a building to be erected or altered including windows, doors, siding, roof, light etc., that will be visible from any public street, way or public place. The following scale drawings are'required in duplicate with application: plot plan (if addition — show existing buildings in outline), floor plan and elevations. Also required are snap shots of existing buildings, where additions or alterations are to be made. No plot plan is required for addition or alteration which does not touch the ground. 2. EXTERIOR PAINTING: An application is required for any portion .of a building, structure or sign to be painted that is visible from a public street, way or public place. Color samples must be attached to these applications. An application is not required when repainting existing colors, changing to white, or using colors approved by the Town Historic District Committee. 3. SIGNS OR BILLBOARDS: An application is required for any sign or billboard to be erected within the District, with the following exceptions: a. Existing signs or�billboards on November 27, 1974 shall have until November 27, 1977 to secure an.approved Certificate of Appropriateness. b. Temporary signs for use in connection with any official celebration or parade or any charitable drive as long as they are removed within three days of the event. Certain other temporary signs that the Committee feels does not detract from the Act may be allowed with the prior permission of the Committee. c. Real Estate signs of not more than 3 square feet in area advertising the sale or rental of the premises on which they are erected or displayed. d. A single sign of not more than 1 square foot in area showing the name, occupation or address of the occupant of the premises on which they are erected or displayed in a residential zone. 4. STRUCTURE: An application is required to build or alter any structure within the District which is defined by the Act as a combination of materials other than a building, sign or billboard, but including stone walls, flagpoles,hedges, gates, fences, etc. GENERAL REQUIREMENTS 5. Work on projects requiring approval shall not be started until the Certificate of Appropriateness has been filed with the Town Clerk by the Committee. Approval is subject to the 10 day appeal period provided in the Act. 6. No changes shall be made from the original approved specifications without advance approval of the Commission on an amended application filed with the Committee. 7.'A separate application must be filed with each project requiring a Certificate of Appropriateness. 8, Under heading of "Detailed Description of Proposed Work" give detailed data on such architectural features as: foundation, chimney, siding, roofing, roof pitch, sash and doors, window and door frames, trim, gutters —leaders, roofing and paint color. .9. The property is commonly addressed as 30 Williams Path,West Barnstable and is located in a RF Residential F Zoning District which has a minimum frontage requirement of 150 feet. The locus has approximately 115 feet of frontage on Williams Path. The property is improved with an 11,000 sq. ft. single family dwelling that is under construction, according to the petitioners'application. The assessor's card lists the gross area as 10,428 sq. ft. This residence was built with a valid building permit(Permit#36070). The applicants recently purchased the property and are in the process of finishing the house. They are adding an 835 square foot addition on the first floor and a 280 sq.ft. addition on the second floor. A building permit for the additions was also issued (Permit#26815). The property is located within the Old King's Highway Regional Historic District. The applicants have received a Certificate of Appropriateness from OKH for the improvements to this site(see attached copy). The subject lot was created in 1962 (see attached subdivision plan and Planning Board meeting minutes). At that time, the property was zoned RC-2 which did not have a minimum frontage requirement. In 1969 (ATM 3/6/69, Art. 99), the property was rezoned from an RC-2 District to an RE District with a minimum frontage requirement of 160 feet. In May of 1974(ATM 4/3/74, Art. 134), the property was rezoned to an RF District with a minimum frontage of 150 feet. Most of the lots in this area of Town have already been developed with single-family dwellings, which abut the property on all sides. .. There is a 40' private unnamed way that connects the locus to Route 6A, created at the time the property was subdivided. This way was never constructed. The only access to the locus is from Williams Path, a paved dead end street. Williams Path was created in 1974 (Subdivision#352). Parcel 73 (Lot 12)was created at this time to serve as a right-of-way to the subject site. This parcel is the only frontage for the locus. The applicants recently.purchased the property and are in the process of finishing.the house. They are adding an 835 square foot addition on the first floor and a 280 sq. ft. addition on the second floor. The applicants are also proposing to convert approximately 1,088 sq. ft. of 3rd level attic space into living space. This space would include one bedroom, a bath and a closet. The maximum allowable height of buildings in residential districts is 30' or 2 1/2 stories, whichever is lesser. Although a half story is permitted under the Zoning Ordinance, no definition exists within the ordinance for a half story above grade. The height of the applicant's home is 30 feet from ground level to the plate (see the attached floor plans and elevations). The overall height of the structure from grade to the top of the ridge is 35 1/2 feet. The attic level could be considered either a half story or a full story, depending upon how the Board selects to define a half story. The Building Commissioner has denied a building permit for the proposal to convert 1,088 sq. ft. of existing attic space into living space, based upon his opinion that the attic level is a third story which is clearly not permitted under the Zoning Ordinance. The property is located within the Old King's Highway Regional Historic District. On October 22, 1997, the applicants were issued a Certificate of Appropriateness from the OKH Historic District Committee for the proposed additions to this residence. Staff Review/Comments: In order to receive a building permit to build a residence or to complete a partially constructed residence, it must comply with the height requirements. The residence in question was built with a valid building permit (Permit#36070). The original building permit categorizes the building as a two-story single-family dwelling. A Building Permit for the proposed additions was also issued (Permit#26815). c Town of Barnstable-Planning Department-Staff Report Appeal No. 1998-56-Lovely Variance to Section 3-1.4(5) Bulk Regulations-Building height The attic space proposed to be used by the applicants already exists. They are not intending to create any additional attic space. There is nothing in the Zoning Ordinance that limits that portion (above-two stories)to be used only as an attic if the height requirements are met. The Ordinance does not limit how that space can be utilized other than to limit it to a single family dwelling use. The applicants are not questioning if the third level constitutes a half or a full story, they are requesting a Variance to utilize a third IeveUfloor. As in a number of past cases involving the half story, staff has proposed the following definition of a half story: • Half Story- Rooms or space for use or habitation located beneath the rafters of a pitched roof and having side walls of no higher than 4 feet. This definition was selected because, in staffs opinion, most existing half stories would be covered by the definition and fewer non-conforming situations would result from its use. It is also staffs opinion that this was the traditional way the half story was looked at in Barnstable. The issue of the half story has been brought to the attention.of the Town Council Subcommittee on Implementation of the Local Comprehensive Plan -the"zoning subcommittee". It is staffs understanding that the committee is considering dropping the half story from the residential bulk requirements and changing all residential height limitations to a 2 stories or 30 feet which ever is lessor. Variance: In consideration for the Variance, the Petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial'detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Condition: If the Board should find to grant the Variance requested, staff would suggest that the Board may wish to consider the following condition: The third floor is limited to no more than 1,088 sq. ft. of habitable space for single-family residential use only. Staff, in this particular instance, would not recommend that the Board condition the third floor in any manner that regulates or restricts the detailed uses or interior finishing of the space. This residence was built with a valid building permit(Permit#36070). The applicants remtly purchased the property and are in the process of finishing the house. They are adding an 836 square foot addition on the first floor and a 280 sq.ft.addition on the second floor: A building permit for the additions was also issued (Permit#26815). The property is located within the Old IQng's Highway Regional Historic District The applicants have received a Certificate of Appropriateness from OKH for the improvements to this site(see attached copy). The subject lot was created in 1962(see attached subdivision plan and Planning Board meeting minutes). At that time,the property was zoned RC-2 which did not have a minimum frontage requirement In 1969 (ATM 3/6169,Art 99),the property was rezoned from an RC-2 District to an RE District with a minimum frontage requirement of 160 feet In May of 1974(ATM 413174,Art 134),the property was rezoned to an RF District with a minimum frontage of 150 feet Most of the lots in this area of Town have already been developed with single-family dwellings,which abut the property on all sides. There is a 40' private unnamed way that connects the locus to Route 6A,created at the time the property was subdivided. This way was never constructed. The only access to the locus is from Williams Path, a paved dead end street Williams Path was created in 1974(Subdivision 9352). Parcel 73(Lot.12)was created at this time to serve as a right-of-way to the subject site. This parcel is the only frontage for the locus. During the Board's deliberation,a_question was raised as to whether zoning relief is needed on this property with regard to frontage. The relief being sought is a variance to Section 3-1.4(5) Bulk Regulations.-Frontage. The property is located in an RF Residential Zoning District which today has a minimum 150'frontage requirement The site has approximately 115'of frontage on Williams Path, an improved private.subdivision road created in.1974. Access.to the property is from Williams Path. - There,is a private 40'unnamed way that borders the western side of the subject site(approximately 341')and extends to Route 6A. In 1962 when the lot was created, there was no frontage requirement The way is shown on the approved Subdivision Plan of Land for George W &Lydia Kalweit,dated April 28, 1962. It was never constructed. It should be noted that in a neighboring subdivision,(Subdivision#656, Plan of Land for Everett W. Paananen, dated January 8, 19871,the same 40'unnamed way is used for frontage and access. At the March 24, 1987 meeting,the Planning Board voted to waive the paving of the way at the request of the 4 (then)petitioner. According to the Town Engineer, Bob Burgmann�s way cannot realistically be constructed due to the steep grade that exists in this area. The Building Commissioner has determined that the 40' unnamed way cannot be considered frontage because it is a paper street The Board would like to know whether or not a paper street, such as this, can be considered frontage when there is adequate access elsewhere on the property(from Williams Path)? I Re ctfuIly, Emmett Gly , Chairm file-zbaUettersU-030599.doc d •' t TOWN OF BARNSTABLE - ZONING BOARD OF APPEALS Excerpts from the minutes of March 03, 1999 Appeal Number 1999-02 Lovely Board Members hearing this appeal were Ron Jansson,Gene Burman,Elizabeth Nilsson,Thomas DeRiemer,and Chairman Emmett Glynn. Christopher Lovely represented himself before the Board. This appeal was continued from January 06, 1999 because no one was present to represent the applicant. Mr.Lovely reported he bought this property in 1997. At that time,Lot 12 was used as a right-of-way to this property. He has since bought that property,so they now own both lots. (Deed submitted). Lot 12 is the only means of access from Williams Path to his house lot. There was a paper road to be constructed to the left of this property,but there is a severe drop down to it of approximately 55 feet,so this property could not be accessed from that road even if it were built. Due to this topographical feature,the applicant is requesting a variance from the frontage requirement. Williams Path is the only way to access this property. As background,the subject lot was cad in 1962. At that time,there was no frontage requirement. In 1974,the property was rezoneZ with a minimum frontage requirement of 150.feet. The Board asked Gloria Urenas if this lot was,in fact,grandfathered. She indicated the 1993 building permit was issued in error. The Building Commissioner reported to her that the lot is not grandfathered and needs 150 feet of frontage. She did not know if the lot had any merger problems. Mr.Lovely reported the lot was built upon when he purchased the property. He was unaware of the potential frontage problem until later. There is no access from Route 6A. It can only be accessed from Williams Path. He has 370 feet of frontage on the 40'unnamed way-paper road,but it was never built. The Board estioned if this lot was in f a questioned act,grandfathered.� If it is a grandfathered lot,then zoning relief is not needed. Mr.Lovely thought there might have been merger sometime prior to his purchasing the lot because Mr.Ezerins owned Parcels#3;#73'and#32-the abutting parcels. Mr.Lovely had a title examine done and he was told he had to buy Lot 12(Panel#73)when he bought his Home or the bank would not give him a mortgage because the title examine revealed he did not have'a right-of-way over Lot 12 to get to his house lot. He was not concerned with frontage(at that time)because he was told this is a no frontage zone area and the bank gave him a mortgage. Public Comments:No one spoke in favor or in opposition to this appeal. Partial findings were started by Ron Janson but withdrawn because he questioned the approved 40 foot way as shown on the Subdivision Plan of Land for George W. &Lydia Kalweit, dated April 28, 1962, which may give this lot legal frontage. It shows the subject parcel as having 341.40 feet of frontage on the approved way. Even though the way has not been constructed,it has been approved by the Town. It would appear the lot does have frontage on an approved way and therefore does not need zoning relief. The Board felt that since the road was approved by the Town in 1962,it does-in fact-exist(even though it has not been brought up to code)and therefore,it can be used for the establishment of frontage even though access is gained by another road. The Board felt that this lot may has legal frontage and may not need zoning relief. They asked for an opinion from the Town Attorney regarding the validity of this way as shown(and laid out)on the 1962 subdivision plan to see if that constitutes sufficient frontage for purposes of zoning. If the way is established as legal frontage for the locus,then the application can be withdrawn,and the Building Commissioner will be able to re-issue the building permit. LOVELY- 1998-56 APPEAL FOR VARIANCE The subject premises is located at 30 Williams Path in West Barnstable. It is shown as Lot 3 on Assessors Map 111. The property is zoned RF. The property is zoned for single family residential use which is the proposed use. The relief which is being sought is to allow the applicant to use the existing space above the second story. The proposed use would be one bedroom, bathroom and closet: Section 5 of the bulk regulations of the Town of Barnstable Zoning By-laws limits the height of buildings in an RF district to 30 ft. or two and one-half stories,whichever.is the lesser. The Lovely house is in fact 30 ft. to the plate in height. The problem is the fact that the Town of Barnstable does not define a half-story. In the case of the Lovely residence,the attic space would meet almost any definition of half-story. The entire space is underneath the eaves. There are no vertical walls as the roof rafters run straight to the floor. The total floor area of the space we are looking to utilize is approximately one-third the size of the first two stories. I am attaching to this memorandum the.pertinent portions of the By-'laws for the Towns of Falmouth,Yarmouth,Provincetown,Mashpee and Chatham. Our project would come within the definition of a half-story in each of those towns. Falmouth: Half Story -That portion of a building under any type of sloping roof,which is potentially habitable as defined under Massachusetts Building Code and within which the number of square feet in area is never more than one-half(1/2)of that of the story below. If the square foot area of the subject portion is greater,that portion shall be deemed a story." Yarmouth: "Habitable attic- the habitable.story located between the upper surface of the ceiling beams of a story and the upper surface of a gabled roof- the roof above a habitable attic must maintain the same slope from the floor line to the ridge line except that it may be interrupted by any dormer with an interior width of no greater than 4 ft." Provincetown: "Half-story shall mean a partial story under a gabled or hip roof, the wall plates of which on at least two directly opposite sides are not more than 3 ft. above the floor of such story." Mashpee: "Half-story -That portion of a building next beneath a sloping roof and in which there are less than 4 ft. vertically between the top of the floor and the intersection of the bottoms of the rafters with the interior faces of the wall." Chatham: "Half-story means the uppermost story with its level ceiling height requirement higher than the eaves of the roof above." The space we are intending to utilize meets the definition of half-story in each of these towns. As stated earlier,the Town of Barnstable does not define half-story in their By-laws "However, the courts have ruled that where words in a zoning ordinance are not defined, the meaning of such words must be deternuined according to the common and approved usage's of the language. Jackson v. Building Inspector of Brockton, 351 Mass. 472, 475 (1966); Kurz v. Board of Appeals of North Reading, 341 Mass. 110, 112 (1960). It is submitted that the common understanding of a half story is that of a room or rooms beneath a sloping roof such as within a dormer, attic,or dormer windows. Webster's International Dictionary defines "half story' as'an uppermost story usually lighted by dormer windows in which a sloping roof replaces the upper part of the front wall.' Webster's International Dictionary, Second Edition. In short, a half story is the type of room normally found in a typical Cape Cod house wherein the attic has been expanded by a dormer or dormer windows." I believe that statutory requirements for a variance are met in this situation. The . first requirement is that this Board must find that owing to circumstances relating to soil conditions, etc. or structures and affecting such land or structures, but not affecting generally the zoning district in which it is located. In this case we have an existing permitted residence which meets the 30 ft. maximum height requirement. We are not looking to create any new space or any new structure..We are bound by the confines of the existing structure. The space is already in existence, and this is not generally the case within.the zoning district. The failure to grant the applicants relief would result in a substantial hardship to them. The applicants purchased the.property last year when it was partially constructed. It is a large and expensive residence. The applicants intended from the outset to use this space, which by.any definition should be considered a half-story, as a bedroom. If the applicant is not granted relief,then this rather large space with beautiful views of the great marsh, Sandy Neck and beyond,will be virtually useless. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purposes of the By-law. There would be absolutely no change to the exterior of the building. The look of the building will be identical whether the space is used or empty. The use of the house as a . single-family residence is in keeping with the zoning district and the neighborhood. The existing septic system is sufficient for a nine-bedroom home and can easily handle this additional bedroom. In short,the relief we are seeking is the ability to use existing space in a one-family residence for residential purposes. I would ask this Board to make a determination that the space above the second floor qualifies as a half-story under any definition, and therefore can be utilized as of right. In the alternative,I would ask this Board to grant the applicants a variance from regulations, because the only reason they need relief is the fact that the f Town of Barnstable does not have a definition of a half-story in their By-laws. Both lots are owned by the applicants. The property is commonly addressed as 30 Williams Path, West Barnstable and is located in a RF.Residential F Zoning District which has a minimum frontage requirement of 150 feet. The locus has approximately 115 feet of frontage on Williams Path. The property is improved with an 11,000 sq. ft. single family dwelling that is under construction, according to the petitioners' application. The assessor's card lists the gross area as 10,428 sq. ft. This residence was built with a valid building permit(Permit#36070). The applicants recently purchased the property and are in the process of finishing the house. They are adding an 835.square foot addition on the first floor and a 280 sq. ft. addition on the second floor. A building permit for the additions was also issued (Permit#26815). The property is located within the Old King's Highway Regional Historic District. The applicants have received a Certificate of Appropriateness from OKH for the improvements to this site. i The subject lot was created in 1962. At that time, the property was zoned RC-2 which did not have a minimum frontage requirement. In 1969 (ATM 3/6/69, Art. 99), the property was rezoned from an RC-2 District to an RE District with a minimum frontage requirement of 160 feet. In May of 1974 (ATM 4/3/74, Art. 134), the property was rezoned to an RF District with a minimum frontage of 150 feet. Most of the lots in this area of Town have already been developed with single-family dwellings, which abut the property on all sides. There is a 40' private unnamed way that connects the locus to Route 6A, created at the time the property was subdivided. This way was never constructed. The only access to the locus is from Williams Path, a paved dead end street. Williams Path was created in 1974 (Subdivision#352). Parcel 73 (Lot 12)was created at this time to serve as a right-of-way to the subject site. This parcel is the only frontage for the locus. The unnamed 40' private way along the west side-of the site cannot be considered frontage because it has never been constructed. According to the Town Engineer, Bob Burgmann, this way cannot realistically be constructed because of the steep grade that exists in this area. The applicants are seeking a Variance to Section 3-1.4(5) in order to legitimize the subject property with regard to the minimum 150 feet of frontage required on this site. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-02-Lovely r Variance to Section 3-1.4(5)Bulk Regulations-Frontage , Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 02, 1998. A 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. An additional 30 day extension of time for filing of the decision was executed between the applicant-and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 06, 1999 and continued to March 03, 1999 and March 24, 1999, at which time the Board granted the requested Variance with conditions. Hearing Summary: Board Members hearing this appeal were Ron Jansson, Gene Burman, Elizabeth Nilsson, Thomas DeRiemer, and Chairman Emmett Glynn. Christopher Lovely represented himself before the Board. This appeal was continued from January 06, 1999 because no one was present to represent the applicant: Mr. Lovely reported he bought this property in 1997. At that time, Lot 12 was used as a right-of-way to this property. He has since bought that property, so they now own both lots. Lot 12 is the only means of access from Williams Path to his house lot. There was a paper road to be constructed to the left of this property, but there is a severe drop down to it of approximately 55 feet, so this property could not be accessed from that road even if it were built. Due to this topographical feature, the applicant is requesting a variance from the frontage requirement. Williams Path is the only way to access this property. As background, the subject lot was created in 1962. At that time, there was no frontage requirement. In 1974, the property was rezoned with a minimum frontage requirement of 150 feet. The Board asked Gloria Urenas if this lot was, in fact, grandfathered. She indicated the 1993 building permit was issued in error. The Building Commissioner reported to her that the lot is not grandfathered and needs 150 feet of frontage. She did not know if the lot had any merger problems. Mr. Lovely reported the lot was built upon when he purchased the property. He was unaware of the potential frontage problem until later. There is no access from Route 6A. It can only be accessed from Williams Path. He has 370 feet of frontage on the 40' unnamed way - paper road, but it was never built. The Board questioned if this lot was, in fact, grandfathered. If it is a grandfathered lot, then zoning relief is not needed. Mr. Lovely thought there might have been merger sometime prior to his purchasing the lot because Mr. Ezerins owned Parcels#3, #73 and#32 -the abutting parcels. Mr. Lovely had a title examine done and he was told he had to buy Lot 12 (Parcel#73)when he bought his home or the bank would not give him a mortgage because the title examine revealed he did not have a right-of-way over Lot 12 to get to his house lot. He was not concerned with frontage (at that time) because he was told this is a no frontage zone area and the bank gave him a mortgage. Public Comments: No one spoke in favor or in opposition to this appeal. Partial findings were started by Ron Jansson but withdrawn because he questioned the approved 40 foot way as shown on the Subdivision Plan of Land for George W. &Lydia Kalweit, dated April 28, 1962, which may give this lot legal frontage. It shows the subject parcel as having 341.40 feet of frontage on the approved way. Even though the way has not been constructed, it has been approved by the Town. It would appear the lot does have frontage on an approved way and therefore does not need zoning relief. The Board felt that since the road was approved by the Town in 1962, it does- in fact-exist(even though it has not been brought up to code) and therefore, it can be used for the establishment of frontage even though access is gained by another road. The Board felt that this lot may have legal frontage and may not need zoning relief. They asked for an opinion from the Town Attorney regarding the validity of this way as shown (and laid out) on the 1962 subdivision plan to see if that constitutes sufficient frontage for purposes of zoning. If the way is established as legal frontage for the locus, then the application can be withdrawn, and the Building Commissioner will be able to re-issue the building permit. 2 Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-02-Lovely Variance to Section 3-1.4(5)Bulk Regulations-Frontage The Board voted to continue Appeal Number 1999-02 to March 24, 1999 at 8:45 PM. Upon opening this appeal on March 24, 1999, Chairman Emmett Glynn explained that there are only four Board Members present tonight who had previously heard this appeal. Under MGL Chapter 40A, a positive vote of at least four out of a five member board is needed to grant.the relief being sought. The applicant was given the opportunity to have his appeal heard this evening by the four member board, or the option of asking for a continuance to a date when the original five members hearing this appeal would be present. Mr. Lovely elected to proceed with a four member board. The applicant gave a brief history of the project before the Board. A building permit was issued by the previous Building Inspector to a previous owner. The property has since changed hands. The Building Commissioner reviewed the site and is of the opinion the site lacks sufficient frontage because he does not consider the paper way legal frontage. The Board Members and the Building Commissioner discussed the letter from the Town Attorney dated March 22, 1999. The Building Commissioner stated he does not necessarily agree with the letter and is in favor of the Board granting a Variance. The Board discussed the plan for the site and the subdivision plan listing the private way. This particular lot does have unique conditions that affect the locus but not the zoning district in which it is located. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of March 24, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-02: 1. The Petitioners are Christopher and Joanne Lovely. The property in issue is addressed as 30 Williams Path, West Barnstable, MA as shown on Assessor's Map 111, Parcels 003 & 073 and contains 3.06 acres. 2. The property is located in the RF Residential F Zoning District which requires, among other things, 150 feet of frontage. 3. The property is improved with an 11,000 square feet single family dwelling. This house was built pursuant to a valid building permit not more than six years ago and, therefore, is still within the provisions of MGL Chapter 40A. 4. The Petitioners are seeking to add an 835 square foot addition on the first floor and a 280 square feet addition on the second floor. 5. The property currently has 115 feet of frontage on Williams Path. This zoning district requires 150 feet of frontage. 6. There is a 40 foot private unnamed way that connects the locus to Route 6A that has been identified in a subdivision plan approved by the Town of Barnstable Planning Board in 1995. 7. That unnamed way has more than sufficient frontage- if it could be utilized - however that road has not been built. 8. Owning to unique topographical conditions that exist in this areas with reference to issue of frontage, in particular the configuration of each lot that consists of locus, are unique conditions not found throughout this zoning district, and in effect create the hardship for which relief is being sought. 9. To deny the Petitioners the relief being sought would be a significant hardship in view of the fact that the building already exists. 10. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance especially in view of the . fact that a good portion of the structure already exists pursuant to a valid building permit. 11.
