pertains to lot size, as aforementioned, any subsequent purchaser
from the Grantee, its heirs, executors, administrators and
successors, may rely on the subdivision plans of the locus of
record and noted on the margin of the original deed to the Grants ,
and if the lots so subdivided and of record at that time average
not less than two (2) acres in size, then this restriction shall
have been fully complied with and of no further affect, provided,
however, that said subsequent purchaser shall not thereafter
further'subdivide his property.
4. The Grantee, its heirs, executors, administrators, successors
and assigns, shall limit and confine construction of new roads
so that there shall not be more than one new road intersecting
Prince Avenue and not more than one new road intersecting Cedar
Tree Neck Road.
5. No "For Sale", "For Rent", "Sold", "Lot Number" signs, or
signs of a similar nature or purpose, or contractor's signs, or
home occupation or advertising; signs of any kind, shall be placed
or maintained within view of Prince Avenue, or Cedar Tree Neck
Road, or Baxter's Neck Road;. this restriction. however, shall not
prevent the Grantee from placing and maintaining one sign at any
point within view of Cedar Tree Neck Road and one sign within
i view of Prince Avenue, for the purpose of identifying the area
i and instructing the public.

1984, by JOHN J. RUSSO and YVONNE M. RUSSO of Whitman, Plymouth

We, JOHN J. RUSSO and YVONNE M. RUSSO, do hereby I ��
acknowledge and declare that all property, both real and
personal, which shall be acquired by us as Trustees of the RUFAM � .
TRUST shall be held by us in trust for the purposes and with the i
powers, duties and limitations hereinafter set forth, namelys (I
Section I. The title of the Trust shall be the RUPAM 1
TRUST. All property, real and personal, acquired or held by the
Trustees hereunder, hereinafter referred to as the Trust
Property, shall be held in trust for the benefit of JOHN J.
RUSSO and YVONNE M. RUSSO, or the survivor of them. Upon the
death of the survivor of them, then distribution shall be made
in equal shares to their children, LINDA A. RUSSO, now of
Brockton, Plymouth County, Massachusetts, JOHN J. RUSSO, JR. and
STEVEN A. RUSSO, both now of Whitman, Plymouth County,
Massachusetts. The person or persons. for whose benefit the
Trust Property shall be held as provided in this section, as
herein set forth or as hereafter altered or amended, are
hereinafter referred to as beneficiaries, and, in the event of
there being but one beneficiary, the word 'beneficiaries" shall i
i be deemed to include the sole beneficiary. The beneficiaries
shall have no legal title to the Trust Property and shall not be

liable for any debts whatsoever incurred by the Trustees.
Section II. The Trustees shall have full power to hold, I i
improve, manage, let, hire, lease, mortgage and sell real and

after the termination of the Trust, the Trustees shall have the
power from time to time to sell and convert into money the Trust
Property for the purpose of distribution, and the Trustees
shall, as soon as practicable, pay, distribute and convey to the
beneficiaries, in equal shares, the Trust Property and the
proceeds thereof, free and in discharge of all trusts. In the

event of the death of any beneficiary hereunder during the
operation of this Trust, then his or her share shall pass '
equally to the remaining beneficiaries surviving.

Section XII. In the event of the death, resignation or
Incapacity of one of the Trustees hereunder, then the surviving
Trustee shall be able to sign as the sole Trustee. In the event
of the death,' resignation or incapacity of both Trusteed
hereunder, then JOHN J. RUSSO, JR. now of Whitman, Plymouth
County, Massachusetts, Massachusetts, shall be the succeeding
Trustee and, without any formal conveyance of assignments, shall
acquire legal title to all Trust Property, both real and
personal, and become subject to all the terms of the Trust under
the within agreement as Trustee hereunder.

I, Jeremy M. Carter, hereby under oath do depose and state that I have personal
knowledge of the within facts
1. I am an attorney licensed to practice in the Commonwealth of Massachusetts since
December of.1983. My offices are located at 509 Falmouth Road, Mashpee, MA.
2. I have conducted a title examination of the subject property, which is also shown
as Assessor's Map 57, Lot 47, and the two (2)adjoining parcels(Assessor's Lots
48 and 56) from the original developer, Old Post Landing, L.P. beginning
November 22, 1972.
3. The Barnstable Planning Board approved the subdivision on June 20, 1973. All
three(3) lots were part of a bulk sale to New England Investors, Inc. on'April 10,
1979. New England Investors sold the three(3)lots to separate, individual
owners in October, 1979. Subsequent to these sates, there has been no common
ownership of any of the three(3)'lots at any time, and none of the lots have been
subdivided.
4. The locus is currently owned by Thomas J. &Jacqueline A. Higgins by deed from
William K. &Elaine IC. Tinsley, dated April 26, 1984, and recorded at Barnstable
County Registry of Deeds in Book 4114, Page 108. The property is a corner lot,
totaling 30,193 square feet. The property is located iti the RF-1 Zoning District
which requires a minimum lot area of 43;560 square feet (one acre).
