" Significantly, this was the only instance in which the word "merged' or"merger" was mentioned in the BOA's decision. The owner, Richard P. In a letter dated June 7, 1999, Mr. Koch°s attorney, Richard J. Gallogly, responded to the Building Commissioner's letter of May 28, 1999, requesting that the.Stop Work Order he revoked. The applicant contends that the Town's Zoning Ordinance contains no provision that limits or otherwise prohibits construction of recreational trails on residentially-zoned land. The applicant also contends that the"multl- purpose" trail is an accessory use to the principal, single-family residential use, and Is therefore, allowed as-of-right. In a follow-up letter dated June 9, 1999, the Building Commissioner states: "!t is my position that this use Is an expansion of a pre-existing nonconforming use and must be either removed or allowed by Special Permit." The applicant is appealing this decision of the Building Commissioner and is requesting that the Stop Work Order be revoked. 1. 23. 2014 2:50PM No. 3341 P. 3 Town of®arnstable-Zoning Board of Appeals-Decision and Nolire - Appeal Number 1999-103-Callahan Appeal of the Building Commissioner Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 17, 1999. A 60 day extension of time for holding the hearing and for Ming of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 18, 1999, at which time the Board overruled the decision of the Building Commissioner. Hearing Summary: Board Members hearing this appeal were Gene Burman, Richard Boy;Tom DeRiemer, Dan Creedon,and Chairman Emmett Glynn. Attorney Jennifer Roberts represented the applicant, Richard P.Callahan,who was present. Also present was Attorney Richard J. Gallogly. For the record,Gene Burman reported that he had a recent transaction with an associate of Mr. Callahan, not directly with Mr. Callahan himself. Mr. Burman felt he could act impartially on this matter but would step down If anyone felt there might be a conflict or an appearance of a conflict. Both the Board Members and Attorney Callahan agreed that this disclosure would not constitute a conflict. At the start of this hearing,Attorney Roberts reported that Mr. Callahan now holds title to all six parcels in question. They are all under the name of"Richard Callahan, Trustee of Island Realty Trust'. The quitclaim deeds were submitted to the file. By combining the six parcels,Attorney Roberts Is of the opinion, there is only one lot for zoning purposes.. As background,Attorney Roberts explained that this is an appeal of the Stop Work Order issued by the Building Commissioner. A.recreatlonal trail was constructed-a number of years ago-on three of the parcel In issue. This past year, they extended It onto the other three parcels so the trail now passes through all six parcels. The Building Commissioner has informed them that this use is an expansion and needs a Special Permit. On the combined parcels(besides the recreational trial), there is a single family residential dwelling, a gymnasium, a play area, and a basketball court. Attorney Roberts indicated that if the combining of the parcels renders this one.lot then a Special Permit is not required for this use, If it is determined to be six separate lots, then the Bullding Commissioner feels a Special Permit would be needed for the trail's expansion. Attorney Roberts referenced the SJC case of Heald vs.Zoning Board of Appeals Greenfield which states the combining of lots may be considered one lot for zoning purpose. The parcels in Issue are now under common ownership and should be treated as one lot. If treated as one lot,under Section 4-1.1 of the Zoning Ordinance, accessory uses or accessory buildings are permitted as-of-rlght, In Attorney Robert's opinion, that is the case here. However, if the Zoning Board of Appeals should disagree, the applicant is willing to file a new plan with the Registry of Deeds dissolving the lot lines and then get a new deed on the one lot. The Board asked the Building Commissioner for his comments. Mr. Crossen believes the issue of the number of lots was not the subject of the Cease and Desist. The Cease and Desist relates to construction of an accessory use(a go-cart track)on a lot that was for the use and purpose of the principal dwelling on another lot located across the street. In his opinion, the accessory use(the go-cart track)was for the people who live on the lot across the street not for the people who live on the lot next to the track. The accessory uses on the lots(s)are pre-existing nonconforming accessory uses, and to expand those uses would require a Special Permit. Mr. Crossen explained that the principal dwelling on the lot(s)is occupied by the caretaker. Mr. Koch lives across the street. The accessory use is used by the residents of the Koch house. In the Building Commissioner's opinion, this accessory use is for the house across the street not the house on the site and therefore needs a Special Permit. Attorney Roberts responded stating the Zoning Ordinance does not require residency in the principal dwelling on a lot in order to use the accessory use on that same lot. There are many uses on this trail such as, biking, rollerblading,walking,jogging, etc. This is not your typical go-cart track. It is a.recreation trail that is occasionally used for go-carts. Attorney Roberts knows of only one neighbor expressing concerns and Mr. Koch has agreed to provide fencing and extra landscaping along their common boundary line to the neighbor's satisfaction. She does not know of any opposition to this trail. Many letters of support were submitted to the file. As to the go-cart use on this trail,only one of Mr. Koch's children uses a go-cart. The other children are under age. The go-carts are not used very often. Attorney Roberts reported there is another house on Oyster Harbors that has this kind of recreational trail. This Is not the only trail in the area. A recreational trail Is a use that is customarily incidental to, subordinate to the principal use to a parcel in this area. The Building Commissioner was asked what brought about this complaint and he Indicated that the Building Department received three complalnts. Attorney Roberts knows of only one complaint and that has been resolved. Public Comment: No one spoke In favor or in opposition to this appeal. There are letters of support in the file from Zenas Crocker,,loan Corby&Hugh Tompkins,James Mills, Michael J, Egan, Mrs. George P. A paved "multi-purpose" recreational trail has recently been constructed around the perimeter of the subject property. A portion of the trail was previously built on Parcels 002-1 and 002-2, approximately 12 years ago according to the applicant. The abutting lots to the north and east of these two parcels were recently acquired and the recreational tail has been extended onto these lots. The trail has been used for a variety of purposes, to include walking, biking and as a go-cart track. The Building Commissioner has determined that this recreational trail is an accessory use which requires a Special Permit from the Zoning Board of Appeals. Prior to the completion of the trail, the Building Commissioner issued a verbal Stop Work Order as described in a letter dated May 28, 1999, in which the Building Commissioner states: "I issued a verbal Stop Work Order on the subject property of Mr. Koch because our zoning ordinances, section 4-1.2, require a Special Permit for an accessory use that is somewhat removed from the site of the primary use." In a letter dated June 7, 1999, Mr. Koch's attorney, Richard J. Gallogly, responded to the Building Commissioner's letter of May 28, 1999, requesting that the Stop Work Order be revoked. The applicant contends that the Town's Zoning Ordinance contains no provision that limits or otherwise prohibits construction of recreational trails on residentially-zoned land. The applicant also contends that the"multi- purpose" trail is an accessory use to the principal, single-family residential use, and is therefore, allowed as-of-right. In a follow-up letter dated June 9, 1999, the Building Commissioner states: "It is my position that this use is an expansion of a pre-existing nonconforming use and must be either removed or allowed by Special Permit." The applicant is appealing this decision of the Building Commissioner and is requesting that the Stop Work Order be revoked. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-103-Callahan Appeal of the Building Commissioner Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 17, 1999. A 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 18, 1999,at which time the Board overruled the decision of the Building Commissioner. Hearing Summary: Board Members hearing this appeal were Gene Burman, Richard Boy;Tom DeRiemer, Dan Creedon, and Chairman Emmett Glynn. Attorney Jennifer Roberts represented the applicant, Richard P. Callahan, who was present. Also present was Attorney Richard J. Gallogly. For the record, Gene Burman reported that he had a recent transaction with an associate of Mr. Callahan, not directly with Mr. Callahan himself. Mr. Burman felt he could act impartially on this matter but would step down if anyone felt there might be a conflict or an appearance of a conflict. Both the Board Members and Attorney Callahan agreed that this disclosure would not constitute a conflict. At.the start of this hearing, Attorney Roberts reported that Mr. Callahan now holds title to all six parcels in question. They are all under the name of"Richard Callahan, Trustee of Island Realty Trust". The quitclaim deeds were submitted to the file. By combining the six parcels, Attorney,Roberts is of the opinion, there is only one lot for zoning purposes. As background, Attorney Roberts explained that this is an appeal of the Stop Work Order issued by the Building Commissioner. A recreational trail was constructed -a number of years ago-on three of the parcel in issue. This past year, they extended it onto the other three parcels so the trail now passes through all six parcels. The Building Commissioner has informed them that this use is an expansion and needs a Special Permit. On the combined parcels (besides the recreational trial), there is a single family residential dwelling, a gymnasium, a play area, and a basketball court. Attorney Roberts indicated that if the combining of the parcels renders this one lot then a Special Permit is not required for this use. If it is determined to be six separate lots, then the Building Commissioner feels a Special Permit would be needed for the trail's expansion. Attorney Roberts referenced the SJC case of Heald vs. Zoning Board of Appeals Greenfield which states the combining of lots may be considered one lot for zoning purpose. The'parcels in issue are now under common ownership and should be treated as one lot. If treated as one lot, under Section 4-1.1 of the Zoning Ordinance, accessory uses or accessory buildings are permitted as-of-right. In Attorney Robert's opinion, that is the case here. However, if the Zoning Board of Appeals should disagree, the applicant is willing to file a new plan with the Registry of Deeds dissolving the lot lines and then get a new deed on the one lot. The Board asked the Building Commissioner for his comments. Mr. Crossen believes the issue of the number of lots was not the subject of the Cease and Desist. The.Cease and Desist relates to construction of an accessory use (a go-cart track) on,a lot that was for the use and purpose of the principal dwelling on another lot located across the street. In his opinion, the accessory use(the go-cart track)was for the people who live on the lot across the street not for the people who live on the lot next to the track. The accessory uses on the lots(s)are pre-existing nonconforming accessory uses, and to expand those uses would require a Special Permit. Mr. Crossen explained that the principal dwelling on the lot(s) is occupied by the caretaker. Mr. Koch lives across the street. The accessory use is used by the residents of the Koch house. In the Building Commissioner's opinion, this accessory use is for the house across the street not the house on the site and therefore needs a Special Permit. Attorney Roberts responded stating the Zoning Ordinance does not require residency in the principal dwelling on a lot in order to use the accessory use on that same lot. The use should be allowed as-of-right. Plus,.the beneficial owner of all the properties has always been the same-William Koch. Attorney Roberts described the recreation trail. The original trail has been there for a number of years and has been used for a variety of purposes including, occasionally, go-carts. This is not something new. There are many uses on this trail such as, biking, rollerblading, walking,jogging, etc. This is not your typical go-cart track. It is a recreation trail that is occasionally used for go-carts. Attorney Roberts knows of only one neighbor expressing concerns and Mr. Koch has agreed to provide fencing and extra landscaping along their common boundary line to the neighbor's satisfaction. She does not know of any opposition to this trail. Many letters of support were submitted to the file. As to the go-cart use on this trail, only one of Mr. Koch's children uses a go-cart. The other children are under age. The go-carts are not used very often. Attorney Roberts reported there is another house on Oyster Harbors that has this kind of recreational trail. This is not the only trail in the area. A recreational trail is a use that is customarily incidental to, subordinate to the principal use to a parcel in this area. The Building Commissioner was asked what brought about this complaint and he indicated that the Building Department received three complaints. Attorney Roberts knows of only one complaint and that has been resolved. Public Comment: No one spoke in favor or in opposition to this appeal. There are letters of support in the file from Zenas Crocker, Joan Corby & Hugh Tompkins, James Mills, Michael J. Egan, Mrs. George P. Edmonds, Jr., Chris & Holley DuPont, Frederick W. Wrightson, III, Anne Herrick, and James F. Clearly. When asked if the Building Commissioner would lift the Cease and Desist now that the land is in one ownership he indicated that was not the issue. He feels"The accessory use is off site from the principal use and therefore is in violation of the Zoning Ordinance. The accessory use is to the house across the street not to the house on the lot." Attorney Richard J. Gallogly addressed the Board and stressed that there is a single family home on the lot and it does not matter who lives in it. Attorney Roberts again stressed that the Zoning Ordinance does not require residency in the structure to use the accessory use. There is a residential use that supports the accessory use-that is all that is required in the Zoning Ordinance. Findings of Fact: At the hearing of August 18, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-103: 1. The applicant, Richard P. Callahan, Trustee of Island Realty Trust, is appealing the Decision of the Building Commissioner. 2.
