A view f the locus was had by the Board. On .......J.ulr....2........97..5............._......................................_..................... 19 ......._.... the Board.of Appeals found The Petit.._-ners, Reginald L. Iickerson et al, hare appealed to the Board of tppeals and petition for a special permit under Seot..on PA 5 - change of a non-conforming use - Barnstable Zoning By La 1 as re%-ieed December 18, 1974,- to allow operation of antique shop at Route 6A, Wesit Barnstable in an RF Zoning District. Attorney Thc,mas George repres nted Petitioners. Petitioners propose to change existing real estate office te retail antique shop to be operated by William Nickerson, s-n of Reginald Nickerson. Presently locus contains a miin house _ with upstairs apartment and d instairs real estate office and land surveyor's office and a barn and pump se. The type of operation w'_11 be tlse sale of fine Pzit_Ves, not brig-a bra , primattily English furniture and oriental rugs and items to fit in i-rith the furniture. The greater percentage of sales are. to' othe'r dealers. There will be no exterior display, as there are.two large ` display windows in the building. They will maintain a dignified sign in keeping with the historic district. Mis will be .a low key, high quality operation i-dth perhaps three customers at on time at most. There will be no regular employees. No new structures will be add d, nor will any structures be torn down. Exterior will remain 'weathered shingle 50 but trim and doors will be painted an antique light green in compliance wit tie historic district. Parking can be directed to the rear via signs and parking a can be c6vered with crushed stone. Parking w_.11 be between the house and the am in the rear. This is an existing non-conforming use with two uses. Opposition was based on traff o hasard and parking problem. The Board found that this was a routine applicati,%n for change of a non-conforming use under Section PA5 of the Barnstable Zoning By-Law. In order to grant tons change, if is necessary that this use be no more detrimental to the area involved that the present use. The Board-found that-the ret,all sale -of-antigdes would probably be a lesser use of the property, t n a real estate office, which is the present use. The Hoard 1bund that there was adequate parking and, therefore, could see no detriment to the area in-solved, nor Aexoggiti6n of the Barnstable Zoning By-Law. Therefore, the Board voted unanimously to change .the use of these premises from real estate office to the ret it .sale of antioues. Distribution. A view f the locus was lead by the Board. On .......July. ....2....... .97..5............................................................................ 19 ............. the Board.of Appeals found The Peti -ners, Reginald E. Iickerson et al, have asppea.led to the Board of t'ppeals and petition f^r a spec:al p rnit under sect.>on PA 5 - change of a non-conforming use - Barnstable 7onin; By-Law as revised December 18, 1974, to allow operation of antique shop at Route 6A, Iest Barnstable in an RF Zoning District. Attorney Thc,mas George represented Petitioners. Petitioners propose to change existing real estate office t retail antique shop to be operated by William Nickerson, s•-n of Reginald Ni kerson. Pr^sently locus contains a wAin house with upstairs apartment and downstairs real estate office and land surveyor' s office and a barn and pump hoixse. The type of operation will be t,.e sale of fine antiques, not brie-a--bra , primattily English furniture and oriental rugs and items to fit in erith the furniture. The greater percentage of sales ares to other stealers. There will be no exterior display, as there are.two large display windows in the building. They will maintain a dignified sign in keeping with the historic district. This will be.a low key, high quality operation with perhaps thre(- cust)mers at one time at most. There w ll be no regular employees. No new structures will be ad•d,d, nor gill any structures be torn doeni. Exterior will remain weathered shingles, but trim and doors wall be painted an antique . light green in compliance with to historic district. Parking can be, directed to the rear via signs and parking a a can be covered with crushed stone. Parking w;..11 be, between the house and the barn in the rear. This is an existing -non-conforming use with two uses. Opposition was based on traffic hasard and parking problem. The Board Found that this was a routine application for chango of a non-conforming use under section PA5 of the Marnstable 7onj-ng By-Law. In order to grant tr-,is change, it is necessary that this use be no more detrimental to the area involved thah the present use. ^he Board-found that-the ra,ail sale -of-aatiques would probably be a lesser use of the property t n a real estate offices which is the present use. The Boardtbund that there was adequate parking and, therefore, could see no detriment to the area involved, norderoga-tion of the Barnstable Toning By-Law. A view of the R;eits was had by the Loard. on ....... ...2.t.....1.9.7.5............................................__.......................... 19 :.._.._, the Board of Appeals found The Petitioners, Reginald E. Nickerson et al, have appealed to the Board of Appeals and petition for a special permit under Section PA 5 - change of a non-conforming use - Barnstable Zoning By-Law as revised December 18, 1974, to allow operation of antique shop at Route bA, West Barnstable.in an RF Zoning District. Attorney Thomas George 'represented Petitioners: Petitioners propose to change existing real estate office to retail antique shop to be operated by William Nickerson, 'son of Reginald Nickerson. Presently locus contains a main house. with upstairs apartment and downstairs real estate office and land surveyor's office and'a barn ,and pump house. The type of operation will be the sale of fine antiques, not bric-a-brac, primarily English furniture and oriental rugs and items to fit in with the furniture. The greater percentage of sales are: to other dealers. There will be no exterior display, as there are two large display windows in the building. They will maintain a dignified sign in keening . with the historic district. This will be a low key, high quality operation with perhaps three customers at one time at most. There will be no regular employees. No new structures will be added, nor will any structures be torn down. Exterior will remain weathered shingles,. but trim and doors will be painted an antique . light green in compliance with $de historic district. Parking can be directed to the . :rear via signs and parking area can be covered with crushed stone. Parking will. be between the house and the barn in the rear. This is an existing non-conforming use with two uses. Opposition was based on traffic hazard and parking problem. The.Board found that this was a routine application for change of a non-conforming' use .under Section PA5 of the Barnstable Zoning By-Law: In order to grant this change, it' is necessary that this use be no more detrimental to the area involved than the present use. The Board found that the retail sale of antiques would probably be a lesser use of the property than a real estate office, which is the. present use. The Boardfnund that there was adequate parY.ing and, therefore, could see no detriment to the area involved, nor derogation of the Barnstable Zoning By-Law.. Therefore, the Board voted unanimously to change the use of these premises from :real estate office -to the retail sale of antiques. " Many Home Owners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix 0, Rules and Regulations for . licensing Construction. Supervisors, Section 2. 15) . This lack of awarene often results in serious problems, particularly when the Home Owner hires unlicensed persons. " In this case °our Board cannot proceed against the .inlicensed person as it would with licensed. Supervisor. The Home '*Owner.* act_ as supervisor is ultimately responsible. To ensure that the Home Owner is fully aware of his/her responsibilities, ma: communities require, as part of the permit application, that te Home Owner h certify that he/she understands the responsibilities of a supervisor. I want the town to understand that this wall is a safety hazard. This wall was built without regard to town regulations. It is a beautiful wall; however, it is too high. It blocks the view of traffic from 6A for anyone exiting Plum Street who \\ is driving a car. It is fine for people in pickups and SUVs, but extremely dangerous for people in cars, particularly people under 5'5". I have had numerous friends comment to me concerning their difficulties exiting our street. (The Pastiche sign can also be a problem when trying to see traffic coming off of 6A.) And when people ignore the NO PARKING signs, in front of Pastiche and further down Parker Road, it is like taking your life in your hands. Plum Street,Parker Road, and Our Lady of Hope make this intersection a particularly beautiful area;we love it. You are aware of the safety issues with this corner. We are very concerned that the Town's failure to enforce this clear violation of the sightline regulations will result in' liability exposure when, not if, an accident occurs as a result of obstructed motorist views. Therefore, we hope the Town will move quickly to address this situation to protect the safety of its residents while being sensitive to the historic tradition of this area. Sincerely, 211z Kathy M. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section 1.09.1.1) E• The uniiersigned "homeowner"assumes responsibility for compliance with the State Building Code and other- applicable codes, bylaws, rules and regulations. The undersigned "homeowner"certifies that he/she understands the Town of Barnstable,Building Department minimum ins cti n cedures and requirements and that he/she will comply with said procedures and requir Signatur of omeown r Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a persons)for hire to do such work, that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(sec Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Suction 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities, many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. BUILDING INSPECTOR APPROVAL: YES: NO: q-forms-f9E0303a 790 CMR Appendix J Footnotes to Table 35.2.1b: Glazing area is the ratio of the area of the glazing assemblies (including sliding-glass doors, skylights, and basement windows if located in walls that enclose conditioned space, but excluding opaque doors)to the gross wall area, expressed as a percentage. Up to 1%of the total glazing area may be excluded from the U-value requirement. For example,3 If of decorative glass may be excluded from a building design with 300 fl of glazing area. 2 After January 1, 1999, glazing U-values must be tested and documented by the manufacturer in accordance with the National Fenestration Rating Council (NFRC) test procedure, or taken from Table.J1.5.3a. U-values are for whole units:center-of-glass U-values cannot be used. ' The ceiling R-values do not assume a raised or oversized truss construction. If the insulation achieves the full insulation thickness over the exterior walls without compression, R-30 insulation may be substituted for R-38 insulation and R-38 insulation may be substituted for R-49 insulation. Ceiling R-values represent the'sum of cavity insulation plus insulating sheathing (if used). For ventilated ceilings, insulating sheathing must be placed between the conditioned space and the ventilated portion of the roof. 'Wall R-values represent the sum of the wall cavity insulation plus insulating sheathing (if used). Do not include exterior siding, structural sheathing, and interior drywall. For example, an R-19 requirement could be met EITHER by R-19 cavity insulation OR R-13 cavity insulation plus R-6 insulating sheathing. Wall requirements apply to wood-frame or mass(concrete, masonry, log)wall constructions, but do not apply to metal-frame construction. 'The floor requirements apply to floors over unconditioned spaces (such as unconditioned crawlspaces, basements, or garages). Floors over outside air must meet the ceiling requirements. 'The entire opaque portion of any individual basement wall with an average depth less than 50%below grade must meet the same R-value requirement as above-grade walls. Windows and sliding glass doors of conditioned basements must be included with the other glazing. Basement doors must meet the door U-value requirement described in Note b. 'The R-value requirements are for unheated slabs.Add an additional R-2 for heated slabs. ' If the building utilizes electric resistance heating use compliance approach 3, 4, or 5. If you plan to install more than one piece of heating equipment or more than one piece of cooling equipment, the equipment with the lowest efficiency must meet or exceed the efficiency required by the selected package. 'For Heating Degree Day requirements of the closest city or town see Table J5.2.1 a NOTES: a)Glazing areas and U-values are maximum acceptable levels. Insulation R-values are minimum acceptable levels. R-value requirements are for insulation only and do not include structural components. b)Opaque doors in the building envelope must have a U-value no greater than 0.35. Door U-values must be tested and documented by the manufacturer in accordance with the NFRC test procedure or taken from the door U-value in Table J1.5.3b. If a door contains glass and an aggregate U-value rating for that door is not available, include the glass area of the door with your windows`and use the opaque door U-value to determine compliance of the door. One door may be excluded from this requirement(i.e.,may have a U-value greater than 0.35). e) 1f a ceiling, wall, floor, basement wall,slab-edge, or crawl space wall component includes two or more areas with different insulation levels, the component complies if the area-weighted average R-value is greater than or equal to the R-value requirement for that component. Glazing or door components comply if the area-weighted average U- value of all.windows or doors is less than or equal to the U-value requirement(0.35 for doors).
