On October 3,2001,the Board granted the Special Permit 2001-106 for the construction of a 3,600 sq.ft.,four-bedroom,detached single-family dwelling. In granting that permit,the Board cited that"The re-establishment of the conforming use does not constitute a second use but rather a conforming use that will be the principal use of the Lot." The applicants,however,did not execute that permit within the required time frame of one-year and the permit lapsed. In Appeal 2004-85 the applicants are seeking to re-establish the single-family dwelling and have requested the same relief as in 2001 that was the Expansion of a Pre-existing Non-conforming Use. In this instance,the applicant is seeking to build a four-bedroom dwelling to be located beyond the back parking area. According to plans submitted,the home is to measure 32 fe.et by 45 feet. A two car garage is proposed under:the structure. Plans for the dwelling were approved by the Old King's Highway Regional Historic District Commission on J une 09,'2004. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April. 13,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened June 23,2004,at which time the Board found to re-grant the special permit. Board Members deciding this appeal were Richard L.Boy, Sheila Geiler,Jeremy Gilmore,Gail Nightinbale,and Chairman Daniel M.Creedon III. Attorney Bruce P. Gilmore represented the applicants at the hearing. Mr.Gilmore gave a brief history of the permitting on the property noting that this relief had been issued in 2001 and that it was not executed as the applicant was not aware"that there was a timefrarne on'the permit. The'Board members noted that nothing had changed from the October 2001 granting of the permit.and determined that it was within their authority.to reissue that special permit. Public comment was requested and no one spoke in favor or in opposition to the request. The Board determined to make the same findings as issued in 2001 and to reissue the permits with the.same conditions updated to reflect the new dwelling as approved by the Old Kings Highway Regional Historic District Committee. V Findings of Fact: At the hearing of June 23,2004,the Board unanimously made the following findings of fact: 1. The applicants Lede Bao and Dian Tong,Trustees have applied for a Special Permit under Section 4- 4.5(2)Expansion of a Non-conforming Use to re-establish as the principal permitted use a residential building. The existing structure and use,the art gallery, would be accessory to the dwelling. The property is shown on Assessors Map 216,Parcel 038,addressed 1989 Route 6A/Main St.,West Barnstable,MA in a Residential F Zoning District. 2. In February of 1992,the Board granted a Special Permit for a change of a nonconforming warehouse use to a retail art center. At that time,the property consisted of two uses and two structures-a warehouse'use with a structure of 6,640 sq.ft.,and a single-family residential use in a dwelling of 736 sq.ft. 3. The site is a 1.26-acre lot and the structures located on the property at that time predate zoning. The single-family dwelling was demolished in 1999,and has not been replaced. 4. The applicant'today is seeking to"re-establish"the residential use and to increase the size of that dwelling from 736 sq. ft. to a 3,600 sq.ft.,four-bedroom dwelling. The dwelling is to be located to the far rear of the lot. v 5. This locus is within the AP—Aquifer Protection Overlay District and on-site wastewater disposal is not regulated by the 330 Rule. The art gallery use is.not a high generator of wastewater. 6. This application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. 7. Upon evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 8.- A site plan for the development has been reviewed by the Site Plan Review Committee and found approvabie. Decision: i Based on the findings of fact,a motion was duly made and seconded to grant the appeal with the following conditions: 1. This permit is granted to permit the re-establishment of a single-family dwelling on the site. The re- establishment of the conforming use does not constitute a second non-conforming use but rather a conforming use that will be the principal use on the lot. 2. The second structure shall be a developed in conformance to plans presented and entitled"Title 5 Site Plan of 1989 Route 6A in the Town of West Barnstable prepared for Lede Bad'as drawn by Down Cape Engineering Inc.,dated April 6,2001. 3. Subsequently, the dwelling was rendered inhabitable and ultimately razed. Recently, an application(2001- 106) was filed with the ZBA seeking to create a new residential structure. In my opinion, this filing reflects an erroneous petition for relief, which understandably created great confusion. I believe that the elimination of the original residence required an amendment of the existing special permit (1992-11) as it created a de facto principal use. At this time, the current applicants seek to construct a new dwelling outside and exceeding the footprint of the original building and relocated to the rear of the property. Please indulge my reiteration by allowing me to restate that in retrospect it is apparent that the gallery structure became the principal use and sole structure by default. In considering the relief required by this petition, it is my contention that section 2-3.6 (1) addressing the number of structures on a residential lot is applicable. } 'y A • In conclusion, it is my opinion that relief is not only necessary but also required as the original dwelling was voluntarily demolished and the remaining structure is a commercial use by virtue of a special permit. I find the facts are as follows. A special permit (1992-11)was granted allowing the change of a non-conforming use (warehouse) to a new non-conforming use (art gallery). During this time the property reflected two structures, one being the warehouse%gallery and the other a residential dwelling noted to be the principal use. Subsequently, the dwelling was rendered inhabitable and ultimately razed. Recently, an application(2001- . 106)was filed with the ZBA seeking to create a new residential structure. In my opinion, this filing reflects an erroneous petition for relief, which understandably created great confusion. I believe that the elimination of the original residence required an amendment of the existing special permit(1992-11) as it created a de facto principal use. At this time, the current applicants seek to construct a new dwelling outside and exceeding the footprint of the original.building and relocated to the rear of the property. Please indulge my reiteration by allowing me to restate that in retrospect it is apparent that the gallery structure became the principal use and sole structure by default. In considering the relief required by this petition, it is my contention that section 2-3.6 (1) addressing the number of structures on a residential lot is applicable. In conclusion, it is my opinion that relief is not only necessary but also required as the original dwelling was voluntarily demolished and the remaining structure is a commercial use by virtue of a special permit. Mr.Pinske appears to have filed something with the Superior Court which purports to be a zoning appeal.It does not appear to meet the jurisdictional requirements of Section 17 of Chapter 40A.
