DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures.A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the buildinppermit. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are.assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section.2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community. Flagg and I am the owner of property at 2464 and 2472 Meetinghouse Way in West Barnstable, Massachusetts (the "Property"). The Property is shown on Barnstable Assessor's Map 155 as Parcel 028. 2. I purchased the Property at 2472 Meetinghouse Way on September 4, 2003 from John C. Hall II by deed recorded with the Barnstable County Registry of Deeds in Book 17582, Page 225. A copy of the deed is attached hereto as Exhibit A. 3. I inherited the Property at 2464 Meetinghouse Way in 1995 from my aunt and uncle. 4. Both properties are shown on a subdivision plan dated April 29, 1946, and recorded with the Barnstable County Registry of Deeds in Plan Book 78, Page 51. A copy of the subdivision plan is attached hereto as Exhibit B. 5. I have requested though my counsel that Bernard Kilroy, a Land Court Title Examiner, conduct an examination of title. As a result of that examination, a title chronology dating from June 9, 1947 was prepared, and a copy is attached as Exhibit C. 6. The subject Property was purchased in 1975 by my aunt and uncle, George and Annette Alger. My great aunt and great uncle, Gertrude and Ralph Barkley, lived in the apartment from 1975 to 1987. They paid rent in the amount of $250.00 to $350.00 per month during that period. 7. The predecessor title holders, William and Elizabeth Bettinen, had a renter living upstairs, and I have personal knowledge of that fact. The Bettinens owned the Property from 1965 to 1975. 8. In addition, I am informed by Forrest Lambert of West Barnstable that he resided in the apartment as a child. Mr. Lambert is currently in his late 50s. 9. In investigating the status of the apartment, I spoke with Joanne MacConnell, who resides at Ryder Lane in Cummaquid, Massachusetts. Ms. MacConnell lived in the apartment over a 22 year period at various times. In particular, she lived in the apartment during the 1980s and has stated to me that she was aware of the apartment being occupied and utilized during the 1970s and 1980s. 1O.She confirmed that she resided in the apartment, in particular, from 1987 to 1992 and paid rent in the amount of $375.00 to $450.00. She also resided in the apartment from 1994 to 2002 and paid $650.00 in rent. 11.From 1992 to 1994 a Jerry Sulham resided in the apartment and paid $475.00. 12.From 2002 to 2003, Kathleen Gavin resided in the apartment and paid rent in the amount of $700.00. 13.From 2003 to 2006, Cheryl Austrowski resided in the apartment and paid rent in the amount of $875.00 per month. 14.I am informed that Frank and John Bresnahan, owners of the Property from 1963 to 1965, rented the apartment to third parties and it was utilized for such purpose. 15.At no time during my ownership or the ownership of my aunt and uncle or great aunt and great uncle, am I aware of any construction or modifications to the Property to allow for the apartment use. All apartment use occurred within structure already in existence. The use and occupancy of the Property and the structures thereon for a residential accessory apartment pre-existed all of the ownership and use and occupancy of which I have opined above. No notice or copy of that citation was forwarded to our office, despite our having advised you that we serve a counsel of record to the property owner. I further advised that once those steps were completed we would be able to advise the client as to a recommended course of action. In the intervening months we have attempted to locate and obtain affidavits from prior owners of the property and/or prior renters. On November 28, 2006, you delivered correspondence to our client, with no copy or notice to this office. We advised your office at that time that we had spoken with several of the prior tenants and were in the process of trying to locate tenants for the period 1955 through 1975, as well as examination of other relevant documents relating to tenancy (i.e., utility bills etc.). As I am sure you can appreciate, the work required to conduct such an investigation is time consuming and is ongoing at this time. On April 12, 2007, you delivered to our client a citation referencing a non-criminal offense having occurred on January 5, 2007. We would note that the correspondence forwarding the citation is addressed to a Mr. David "Flaff". No notice or copy of that citation was forwarded to our office, despite our having advised you that we serve a counsel of record to the property owner. On March 9, 2007, a "second notice" was forwarded to Mr. Flagg, a copy of which is attached hereto. Again, no copy of notice was sent to this office. It is my intention to meet with you tomorrow to review the requirements to "prove" the grandfathered status of the apartment and to discuss disposition of the non-criminal citation. Flagg, a resident of Barnstable, Massachusetts, on oath say and depose as follows: 1. My name is David M. Flagg and I am the owner of property at 2464 and 2472 Meetinghouse Way in West Barnstable, Massachusetts (the "Property"). The I Property is shown,on Barnstable Assessor's Map 155 as Parcel 028. 2. I purchased the Property at 2472 Meetinghouse Way on September 4, 2003 from John C. Hall II by deed recorded with the Barnstable County Registry of Deeds in Book 17582, Page 225. A copy of the deed is attached hereto as Exhibit A. 3. I inherited the Property at 2464 Meetinghouse Way in 1995 from my aunt and uncle. 4. Both properties are shown on a subdivision plan dated April 29, 1946, and recorded with the Barnstable County Registry of Deeds in Plan Book 78, Page 51. A copy of the subdivision plan is attached hereto as Exhibit B. 5. I have requested though my counsel that Bernard Kilroy, a Land Court Title Examiner, conduct an examination of title. As a result of that examination, a title chronology dating from June 9, 1947 was prepared, and a copy is attached as Exhibit C. 6. The subject Property was purchased in 1975 by my aunt and uncle, George and Annette Alger. My great aunt and great uncle, Gertrude and Ralph Barkley, lived in the apartment from 1975 to 1987. They paid rent in the amount of $250.00 to $350.00 per month during that period. I 7. The predecessor title holders, William and Elizabeth Bettinen, had a renter living upstairs, and I have personal knowledge of that fact. The Bettinens owned the Property from 1965 to 1975. 8. In addition, I am informed by Forrest Lambert of West Barnstable that he i resided in the apartment as a child. Mr. Lambert is currently in his late 50s. 9. In investigating the status of the apartment, I spoke with Joanne MacConnell, who resides at Ryder Lane in Cummaquid, Massachusetts. Ms. MacConnell lived in the apartment over a 22 year period at various times. In particular, she lived in the apartment during the 1980s and has stated to me that she was aware of the apartment being occupied and utilized during the 1970s and 1980s. 10.She confirmed that she resided in the apartment, in particular, from 1987 to 1992 and paid rent in the amount of $375.00 to $450.00. She also resided in the apartment from 1994 to 2002 and paid $650.00 in rent. 11.From 1992 to 1994 a Jerry Sulham resided in the apartment and paid $475.00. 12.From 2002 to 2003, Kathleen Gavin resided in the apartment and paid rent in the amount of $700.00. 13.From 2003 to 2006, Cheryl Austrowski resided in the apartment and paid rent in the amount of $875.00 per month. 14.I am informed that Frank and John Bresnahan, owners of the Property from 1963 to 1965, rented the apartment to third parties and it was utilized for such purpose. 15.At no time during my ownership or the ownership of my aunt and uncle or great aunt and great uncle, am I aware of any construction or modifications to the Property to allow for the apartment use. All apartment use occurred within structure already in existence.
