The Hunter Hill III Subdivision was approved by the Planning Board in 1987 by grant of a Special Permit pursuant to Section 3=1.7 Open Space Residential Development Provisions of the Zoning Ordinance.- The Open Space Special Permit allows for lots to be created base upon the overall density of development and not on minimum lot area,thus allowing for smaller lots to be clustered within protected open space. At the time that the plan was approved, the Planning Board could grant waivers from side yard setback to no less than 7.5 feet. However no waiver was requested by the developer. In 1999 Section 3-1.7 was amendments and today the Planning Board can only grant waivers from side yard setback to no less than 12 feet. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 08, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 16, 2000, and continued to March 15, 2000, at which time the Board determined to grant a variance with conditions. Hearing Summary: Board Members hearing and deciding this appeal were Gail Nightingale, Gene Burman, Tom DeRiemer, Dan Creedon and Chairman Emmett Glynn. Richard Fenuccio represented himself before the Board. Mr. Fenuccio reviewed the request before the Board. He explained that he thought he could get a waiver from Planning Board under the Open Space Provisions but was told that was no longer applicable and that he would need a Variance from the bulk regulations. There is no other option than to locate the garage as it is proposed on the plan submitted. Most of the other houses in the subdivision have garages. The proposed garage will be a detached two car structure of a carriage house style with an attached 10x12 shed in the rear for storage. There is a paved driveway in place which will be extended to the new garage. There is a letter in the file from the Homeowner's Association stating it is not opposed to the granting of this variance. Mr. Fenuccio indicated the neighbors have been advised and no one has objected. As to variance conditions, Mr. Fenuccio stated there would be a financial hardship if he were not allowed to build a garage as his house would be worth less than.other house in the area because they all have a garage. The topography and shape of the lot is such that no matter where the garage is located some type of variance relief would be needed. The driveway is already in place. The Board was concerned with the size of the garage. They felt this was an over intensification on this small lot. They questioned why the garage had to be so big and why the need for the attached shed. They asked if the garage could be moved so that the amount of encroachment would be less. Mr. Fenuccio responded that although the overall structure would be 24'x 30', from the street you would only see the 24 feet which is a standard size garage for this area. He indicated the second floor of the garage is for personal storage only and he could make a detached shed so as to make the structure's overall size smaller, if the Board desired it. Mr. Fenuccio felt this is the best location on the lot for this garage because of the shape of the lot and the sloping topography. After debate Mr. Fenuccio asked for a continuation so that he could redesign the plan showing the garage no closer than 10 feet to the setback on any comer. This would be less intrusive into the open space and he would only need a Variance for a five foot encroachment. The appeal was continued to March 15, 2000. At the March 15 continuance, Mr. Fenuccio discussed the plan submitted to the file on March 8, 2000.. That new plan shows the proposed garage located 10 feet from the property line. That plan encroach by only five feet in to the required side yard setback. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of March 15, 2000 the Board unanimously found the following findings of fact as related to Appeal No. 2000-15: 1. The applicants are Mary Lou and Richard Fenuccio. The property address is 30 Morgan Way, West Barnstable, MA as shown on Assessor's Map 175 Parcel 030. The total area is 17,652 square feet. 2. The.site is located in an RF Residential F Zoning District and the AP Aquifer Protection Overlay District. 3. Due to the shape of the lot, it would be difficult to stay within the 15 foot sideline setback. The Petitioner has submitted a second plan which shows that only the front portion of the proposed garage would extend 5 feet into the side yard setback. The rear corner of the garage will not encroach into the 15 foot side yard setback. All other setbacks for the zoning district are met. No other findings are made pursuant to MGL Chapter 40A, Section 10, Variance Conditions. 4. The property is located in Hunter Hill III, an open space subdivision. To the immediate east of the locus, there is open space so this side yard setback encroachment does not immediately abut the next neighboring lot to the east. He explained that he thought he could get a waiver from Planning Board under the Open Space Provisions but was told that was no longer applicable and that he would need a Variance from the bulk regulations. The width of the lot in issue is only 77 feet I , ` Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 2000-15-Fenuccio Variance to Section 3-1.4(5)Bulk Regulations across and the house is located in the middle of the lot. There is no other option than to locate the garage as it is proposed on the plan submitted. Most of the other houses in the subdivision have garages. The proposed garage will be a detached two car structure of a carriage house style with an attached 10x12 shed in the rear for storage. There is a paved driveway in place which will be extended to the new garage. There is a letter in the file from the Homeowner's Association stating it is not opposed to the granting of this variance. Mr. Fenuccio indicated the neighbors have been advised and no one has objected. As to variance conditions, Mr. Fenuccio stated there would be a financial hardship if he were not allowed to build a garage as his house would be worth less than other house in the area because they all have a garage. The topography and shape of the lot is such that no matter where the garage is located some type of variance relief would be needed. The driveway is already in place. The Board was concerned with the size of the garage. They felt this was an over intensification on this small lot. They questioned why the garage had to be so big and why the need for the attached shed. They asked if the garage could be moved so that the amount of encroachment would be less. Mr. Fenuccio responded that although the overall structure would be 24' x 30', from the street you would only see the 24 feet which is a standard size garage for this area. He indicated the second floor of the garage is for personal storage only and he could make a detached shed so as to make the structure's overall size smaller, if the Board desired it. Mr. Fenuccio felt this is the best location on the lot for this garage because of the shape of the lot and the sloping topography. After debate Mr. Fenuccio asked for a continuation so that he could redesign the plan showing the garage no closer than 10 feet to the setback on any corner. This would be less intrusive into the open space and he would only need a Variance for a five foot encroachment. The appeal was continued to March 15, 2000. At the March 15 continuance, Mr. Fenuccio discussed the plan submitted to the file on March 8, 2000, That new plan shows the proposed garage located 10 feet from the property line. That plan encroach by only five feet in to the required side yard setback. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of March 15, 2000 the Board unanimously found the following findings of fact as related to Appeal No. 2000-15: 1. The applicants are Mary Lou and Richard Fenuccio. The property address is 30 Morgan Way, West Barnstable, MA as shown on Assessor's Map 175 Parcel 030. The total.area is 17,652 square feet. 2. The site is located in an RF Residential F Zoning District and the AP Aquifer Protection Overlay District. 3. Due to the shape of the lot, it would be difficult to stay within the 15 foot sideline setback. The Petitioner has submitted a second plan which shows that only the front portion of the proposed garage would extend 5 feet into the side yard setback. The rear corner of the garage will not encroach into the 15 foot side yard setback. All other setbacks for the zoning district are met. To the immediate east of the locus, there is open space so this side yard setback encroachment does not immediately abut the next neighboring lot to the east. The increase from 7.5 feet to 12 feet is in response to violations of the open space in a number of open space subdivisions, both by adjacent landowners, and by developers. The open space has been cleared in several subdivisions despite a recorded prohibition on such activity. Open space has been incorporated into yards of abutting land owners, especially where buildings have been located close to lot lines, adjacent to open space. The applicant's plans show a one and half story, two car garage with a one story shed-like addition to the rear, with a total building footprint of 792 sq. ft. The applicant should address whether or not they intend to use the attic space of the proposed garage, and the proposed use of the shed-like addition to the rear of the proposed garage. The building is shown to be located between 7.5 and 10 feet from the east side lot line, adjacent to a narrow, 20 foot strip of open b space.
