This letter is to certify our proposal to install Solar(PV) at the above-
referenced property has been moved into a cancellation status.
SolarCity Corporation and Candace G. Kelly will not be moving forward
with the proposed installation at this time. We would greatly appreciate
reimbursement for the permitting fees paid, but understand that the town
will not refund any fees.

Good Morning Cheryl,.
I received a change in the permit for the subject address late.-last month. The change will require a new building
permit for the additional modules. It appears that the system has expanded from 16 modules to 28 modules.
Therefore, the new permit would only be for the 12 additional modules with an application fee and a permit fee.
In the future, and for your information, changes to a building permit normally require a new permit. In considering
the nature of your business we have determined that the new permit will only be required for the addition of more
than two modules. The reduction or addition of one or perhaps two modules will not trigger a new permit. Also,
changes in the electrical (i.e.: inverter, wiring)will not normally trigger a new building permit.

Attached are the revised plans and calcs. for our solar installation located at 40 +�
Morgan Way in West Barnstable.
Since receiving the Building/Electrical permits, we have added seven (7) modules to
MP3 and five (5) modules on MP4, increasing the system production from 4.16 to
,7.28 kW. We would greatly appreciate the revised plans be added as a modification
to our existing permits. New Size: 28 modules @ 7.28 kw-DC.

Please be advised that we have examined the chain of ownership and title to the above-
referenced parcel through the records at the Barnstable County Registry of Deeds. Our
examination indicates the following:
1. The above-described vacant lot was created by subdivision plan approval of the Town
of Barnstable Planning Department on August 10, 1987, by a decision recorded in the
Barnstable County Registry of Deeds in Book 6600 Page 284.
2. The subject property has been owned independently, and not in common ownership
with any abutting parcel since its initial conveyance out as a lot on October 31, 1996
by deed recorded in the Barnstable Registry of Deeds in Book 10471 Page 299.
3. At no time since October 31, 1996 was the subject property owned in common with
any abutting parcel such that a merger was created.
4. Title to the subject property, as a matter of record,presently stands in the joint
ownership of Naureen Anne Hobbs, Trustee of the West Barnstable Courthouse
Trust, established by Declaration of Trust recorded in the Barnstable Registry of

land of the Grantor in said Town of Barnstable, the right (1) to

to time entitled to use the same, for all purposes for which
streets may now or hereafter customarily be used in said Town of '
Barnstable, and the right to grant like right to others, including
the Town of Barnstable; and (2) without limiting such other rights
as the Grantor and his successors and assigns may have with respect
to the said ways, (i) the right form time to time to grade, change
the grade of, surface, landscape and otherwise improve said ways,

that if in connection with the installation of utilities or
otherwise, they shall make any excavations in said ways, they will i

remove any soil from said ways without the prior written consent of II
the Grantor, and (3) that they and their heirs, representatives and I
assigns will, upon request by the Grantor at any time or from time
to time, (1) join in dedicating said ways or any parts thereof or

proper to establish such public ways.
The Grantees, their heirs and assigns, shall become regular members
of HUNTER HILL ASSOCIATION III, INC. , a non-profit organization, i
organized for the purpose of maintaining and improving the roads
and the common areas as shown on the hereinbef ore mentioned i
subdivision plans.
Said premises are conveyed subject to and with the benefit of Open ;
Space Permit at Book 6600 Page 284; Deed of Open Space to the Town
of Barnstable at Book 6873 Page 013; Open Space Restriction and
Easement to the Town of Barnstable at Book 6873 Page 019; Open
Space Deed to Hunter Hill III Resident Association III, Inc. at II
Book 6873 Page 026 and Book 8315 Page 147.
The owner or owners of the premises hereby conveyed shall pay to
said Association each year such amount, not to exceed Three Hundred
($300.00) Dollars per lot, as shall be determined to be the annual
regular member assessment pursuant to the by-laws of said
Association, and such special assessments, not to exceed in any one
year One Hundred ($100.00) Dollars per lot, as shall be determined
pursuant to the by-laws of said Association.
The maximum amounts the owner of owners may be required to pay
during any one year on account of special assessments as herein
provided shall, each year, commencing with 1990, be increased or
decreased to reflect fluctuations in the United States- Department i of Labor Statistics Consumer Price Index, United State average,
using January 1988 as the base month and January of the year ;
preceding which a payment in respect to one or more special
assessments is payable as the comparative month.

If any assessment or any installment of any special assessment
payable in installments shall not be paid on the date when due,
then such assessment shall become delinquent and shall, together
with interest thereon and all costs of collection thereof as
hereinafter provided, thereupon become a charge on the granted
premises and a continuing lien on the property against which i
assessed, which shall bind such property in the hands of the then i
owner or owners. It shall also be the personal obligation of the
owner or owners of such property at the time the assessment became
due, and shall remain his or their personal obligation and shall
not pass to his or their successors in title unless expressly
assumed by them.
If any assessment or installment is not paid within thirty (30)
days after the delinquent date, the same shall bear interest per
annum until paid at a rate equal to one hundred twenty (120%)
percent of the prime rate of the New England Merchants National
Bank, and the Association may bring any appropriate action or I
proceeding for the collection thereof against the owner personally
obligated to pay the same or to foreclose the lien against the
property; and in either event the Association shall be entitled to
recover all its costs of collection, including a reasonable
attorneys fee.
The lien hereby created shall become effective only upon the
recording of an appropriate notice of lien in the Barnstable County
Registry of Deeds.
The granted premises are conveyed subject to the provisions of the
"Declaration of Protective Covenants of Hunter Hill IIIII, and
recorded in the Barnstable County Registry of Deeds in Book 5946,
Page 34 as the same may have been amended and to the extent they
may be in force and effect and applicable. i
