As yo4 know I applied for and received a permit in early November to rebuild the:io�he at 601 jayes Road. After working on the house for one week we received a stol:a v,.vork ordei,"'from Jeff the Building Inspector_ After consulting with Jell", I guess the protlein was actilaally with Conservation. Apparently the permit should not have been signed,and they;asked me to go to a hearing in December. Trying to follow proper procedurk natural ijy I agreed to the hearing, despite the house being opened to the weather ai rid gausing damage. I received an OX from COfiservation at their meeting 12/14/04. I came back in following the hearing to get the perniit signed off. Your Department told me I needed the playa for the Septic De;ig;Qa before you would sign off. I had asked my Engineer to do this for me prior to you&*k rig for it, v I asked him to expedite the Design. I finally received it on 01/17/05 and-:)r�iught it oriI the I e only to find out I need a variance requiring a hearing in March. I have attache I i new(ten:."rary) design that I think is better for everyone since it is more than 100' �om the water. It would mean the Septic tanks would be placed at the edge of the praogrty line cif#66 Hayes Road. My wife own: #60 Hayes Road and I own the abutting property#66 Hayes Road which would grant as Oasement, `Cs this acceptable? Whatever way you think iri'best, we would do. I only ask that if we need to go for a hearing, could y6u please;sign off on the permit to allow me to get the house weather tight to preveaat Further damage. You could stipulate on the permit before sheetrock sign off that the Septic design ii approved. It appears that a complete second story addition is being added along with other work. I understand that a building permit has been issued for some work, but a complete second story addition is not mentioned in the permit. I do believe that this work needs permits (and hearings) from both of your boards. None of the neighbors have received notification from either of your boards for a hearing on securing the necessary permits. Although the past owners always had trouble with overflowing cesspools, I do not believe a new Title 5 septic system has ever been installed, even though the present owners bought the property over 2 years ago. Would you please look into this and inform me of your findings ? Also, the former Thomas property at 143 Hayes Rd, Centerville was sold about one month ago and is presently undergoing complete interior rebuilding. Tom, could you check on whether a septic inspection was performed on this property ? I am sorry to bother you, but I do feel strongly (and know from my many years on regulatory boards) that necessary permitting is a vital protective measure for the whole community. This property was sold by the Tarlows to a new owner(s) about 2+ yrs ago and I do not believe any upgrading of the septic system has been done. The previous owner, Mr Tarlow, complained to me several times over the years that the cesspool on this lot ( and the adjacent lot that he owned ) overflowed every summer when more than 2 people used the house (and the adjacent cottage) . The close neighbors, Weinberg and Golding, can attest to that. Can a building permit be issued with a cesspool in place ? Within 50 ft (+or -) of the lake ? Anyways, thank you for looking into this. I also think that these two lots were established in 1984 by an "approval not required" Planning Board plan that created two undersized lots. The zoning at the time required 1 acre and these 2 lots are each only 1/2 acre. I believe this makes both lots illegal and no building permit at all should be issued, unless variances or special permits are received from the Board of Appeals. Personally, I do not object to the remodelling of these houses, as long as all town rules and regulations are followed and permits are obtained from the town boards involved. In my opinion, before a decision can be made on 'Determination of Applicability' on this parcel, plans for the entire project (both parcels) must be viewed as a whole. There are (2) houses on this one acre, that according to the Planning Board, are undersized lots. Both of these houses together had a total of (3) bedrooms. (There was a main house and a small guest house. ) I believe Mr. McNamara is planning to add at least 4 or 5 additional bedrooms to this total property and effect major renovations to both housing units. As of last summer, I remember the septic system was still a cesspool. When the Tarlow's owned this land, the cesspool would overflow each summer when there were more than two people in residence. Does the current system meet Title 5 or 6 specifications to allow a building permit at this lakefront site? In addition, the main house seems to be within 50 feet (+ or -) of Lake Wequaquet. Are there rules or guidelines for building so close to the water's edge? As you know, we have a fragile ecosystem in Lake Wequaquet that is worth protecting. I do not object to a quality renovation of the property and I would look forward to having ONE family as a permanent neighbor. The last (2) summers have been a bit unsettling with many transient residents next door and on the dock. I do believe that Mr. McNamara appreciates this rare, peaceful, natural setting with swans, herons, ducks, birds, fish, fox, mature trees, and indigenous plants. A professional engineer or registered sanitarian should be hired to evaluate the capacity of the system. That same person could complete the multiple page inspection report.
