The variances granted are as follows: 310 CMR 1S.211: The soil absorption system will be located zero (0) feet away from the property line in lieu of the minimum ten (10) feet separation distance required. Section 360-1: The pump chamber will be located 50.2 feet away from the bank, in lieu of the 100 feet setback separation distance required. These variances are granted with the following conditions: (1) The engineering plan shall be revised to show a two inch (2" line). (2) The engineering plan shall be revised to show piping without any perforations. (3) The engineering plan shall be revised to show a tee within the distribution box. (4) No more than four (4) bedrooms maximum are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and Q:WP/ChurchillGodkowski2005 similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. (5) The applicant shall record a properly worded deed restriction, signed by the owner of the property, at the Barnstable County Registry of Deeds restricting the property to four (4) bedrooms maximum. A copy of the recorded deed restriction shall be submitted to the Health Agent prior to obtaining a disposal works construction permit. (6) The septic system shall be installed in substantial compliance with the revised engineered plans. (7) The professional engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised engineered plans. These variances are granted because the physical constraints at the site severely restrict the location of the soil absorption system due to its close proximity to a pond.
