The variances granted are as follows: PART VIII, SECTION 1.00: The septic tank will be located 60.9 feet away from a wetland, in lieu of the one-hundred feet minimum separation distance required. 310 CMR 15.211: To install a septic tank at the property line, in lieu of the ten feet minimum setback required. 310 CMR 15.211: To install a septic tank 3.1 feet away from the cellar wall foundation, in lieu of the ten feet minimum setback required. 310 CMR 15.211: To install a septic tank 5.1 feet away from the neighbor's cellar wall foundation (located at 248 Lake Elizabeth Drive), in lieu of the ten feet minimum setback required. These variances are granted with the following conditions: (1) No more than three (3) bedrooms maximum are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. (5) .The professional engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the engineered plans dated October 20, 2004. These variances are granted because the physical constraints at the site severely restrict the location of the soil absorption system due to its close proximity to the wetlands and very small size of the parcel. The following is some information on the technology of composting toilets, and a description of how and when they may be used in Massachusetts. I Composting toilets Composting toilets use a biological process in which various types of organisms under controlled conditions biologically degrade human waste to a humus-like end product. ,This biological process is influenced by a number of environmental factors such as temperature, moisture, pH, aeration and the ratio of carbon to nitrogen. Compost temperature must be maintained above 55°C for three days for composting to proceed effectively and kill pathogenic organisms. At lower temperatures, bacterial activity is inhibited and the composting process slows. Moisture must be maintained between 40-60% for best results. All organisms require water, but too high moisture content in the compost pile may give rise to anaerobic conditions. A very low content of water, on the other hand, retards the activity of the microbes. 'Normally, there is no need to influence the pH of a composting toilet. The best pH range for most bacteria is from 6 to 7.5. Fresh human excreta are slightly acid (below 6) but after a few days in a compost pile the pH usually begins to rise to the optimum range. Proper mixing, porosity and maintenance of aerobic conditions are necessary for rapid, decomposition and for the destruction of pathogenic organisms. Under anaerobic conditions the decomposition is slower, heat given off is only a fraction of that from aerobic conditions and foul smelling gases are released. The carbon/nitrogen balance needs to remain within an optimum range of 20:1 to 30:1 to achieve rapid decomposition. Human excreta and especially urine are rich in nitrogen. It may, therefore, be necessary to add high carbon materials like sawdust, grass and kitchen wastes to keep the carbon/nitrogen ratio between the optimum range. Manufacturers of composting toilet systems often recommend such materials and give frequencies for their use; they may every sell pre-packaged bulking agents. The first type are relatively large, watertight containers equipped with a chute that connects the toilet fixture to the composting unit located below, often in a basement. Waterless toilet fixtures are typically above the composting unit and are connected to it via a large-diameter chute. Foam flush toilet fixtures can be offset from the composting unit and connect to it via a standard pipe. The composting unit consists of a receptacle and a storage chamber. A properly operating composting process will decompose the pile to less than 10% of the original volume by the time the compost is ready to be removed. Excess liquid is drained to the lowest part of the tank where it is either evaporated or collected. This is a slow process, and it may take a few years before the first time there is a need to remove humus from the storage chamber. After that, annual removal is generally sufficient. The second type of composting toilet comprise smaller units in which the toilet seat, receptacle and composting tank are formed in a single self-contained unit. Some designs incorporate heaters and mechanical aeration in an effort to maintain a balance of moisture and aerobic conditions that are necessary for proper biological degradation. These units are intended to evaporate all excess liquid so that there is no discharge other than the finished compost. Compost will have to be removed from these units several times per year; disposal options for the finished compost are described below. Liquid by-product If the composting toilet produces a liquid by-product that is not recycled through the toilet, the liquid by-product must either: a) be discharged through a greywater system on the facility that includes a septic tank and leaching system in compliance with the Title 5 regulations, b) be removed by a licensed septage hauler and properly disposed, or c) be disposed of using an alternative method specifically approved by the Department. Composted solids In accordance with Title 5, composting toilet systems must be designed to store compostable and composted solids for at least two years either inside the composting chamber (large container type composters), or in a separate compost container (smaller composting toilets), unless a system has been approved by the Department as an alternative system with different standards. Currently, one composting toilet manufacturer has applied for and received a Provisional Use Approval from the Department for one model to be used without this storage requirement; details on this can be found in the listing at the back of this document. Compost from the system has the potential to contain pathogenic organisms and, therefore, according to Title 5, must be disposed of either: a) by burial on-site or in another manner and location approved by the local approving authority, covered with a minimum of six inches of clean compacted earth; or b) by a licensed septage hauler. The compost can be removed by the owner, by a maintenance person, or by a septage hauler; caution and good hygiene when dealing with this material is necessary. The Use of Composting Toilets in Massachusetts March 15, 1999 4y Greywater If the facility generates greywater(i.e. wastewater from sinks, showers, washing machines, etc.) a disposal system still is needed for the greywater. Title 5 has different requirements for remedial use (i.e., system upgrades) and for new construction. Because of the increased interest in the development of new greywater treatment technologies, DEP also has initiated a greywater piloting project, which allows for additional flexibility in the design and placement of greywater treatment and disposal technologies. The approvals for such systems are designed to, in turn, provide DEP with needed information on greywater and the capability of systems to treat it. The options are detailed below: Remedial Use GPD Remedial use applies to existing facilities that: a) have a design flow of less than 10,000 gallons per day, b) are served by an existing system which is failed, failing or non-conforming, and, c) where there is no proposed increase in the design flow. Under remedial use, an existing cesspool may be used as a leaching pit, provided that the cesspool is pumped and cleaned at the time of inspection, is not located in groundwater, and meets the design criteria of 310 CMR 15.253 (pits, c rs, and galleries) with respect to /effective depth, nsp separation b ween units, and iection.access. The cesspool may be replaced with a precast concrete le Ching pit meeting those requirements, and the effluent loading requirements of Title 5. If a cesspool is not used, the construction of a soil absorption system is required. The soil absorption system shall be sized to accommodate at least 60% of the facility's design flow. Installation of a septic tank also is required. Approval Process: A Disposal System Construction Permit must be obtained from the local approving authority, generally the Board of Health; no application_to DEP is required unless variances from Title 5 are being requested. If DEP variances are needed, the applicant must apply forte variances first to the Board of Health and then to the appropriate Regional Office of DEP using application form BRP WP 59b. New Construction Under Title 5, "new construction" comprises situations which include building on an undeveloped lot as well as any situation in which a facility is subject to an increase in Title 5 design flow, such as adding a bedroom to a residence, or adding seats to a restaurant. Composting toilets are certified for General Use for new construction on sites where a system in full compliance with 310 CMR 15.000 could otherwise be installed. If there is a greywater discharge or a discharge from a drain equipped with a garbage grinder, a septic tank and a leaching facility are required. A filter system specifically approved by the Department for this type of application can be used instead of the septic tank. Although there are not yet any such filters with General Use Certification, the Department has approved several on a site-specific basis under individual Piloting Approvals. For new construction or expansions, the size of the leaching facility may be reduced by 40%, even though the site must be capable of providing 100% leaching capacity. Approval Process: A Disposal System Construction Permit must be obtained from the local approving authority. No application to DEP is required, unless DEP variances to Title 5 are needed, in which case the application also must be submitted to the appropriate Regional Office of DEP using application form BRP WP 59b. There is no nitrogen removal credit established for the use of composting toilets, therefore the loading on the lot cannot exceed 440 gallons per day per acre in a nitrogen sensitive area, as designated by the Department in Title 5. Greywater Piloting Project The purpose of the Piloting Program is manifold. Although greywater recycling has been practiced in other states, and in other countries, the information available on the characteristics of greywater is limited, often of unknown quality, and sometimes even contradictory. Public health practitioners agree that greywater, while containing less of many contaminants than combined domestic wastewater, is not "clean". Greywater, like combined wastewater, may contain toxic chemicals, nutrients like phosphorus and nitrogen, and pathogens, including bacteria and viruses. The Greywater Piloting Program, therefore, will generate needed information. To date, DEP not only has approved alternative greywater systems to serve residences, but also alternative greywater systems to serve public facilities such as state parks and rest areas, and hopes to receive applications for approval of greywater systems at other types of facilities as well. The Greywater Piloting Program will be used to gain experience with the technologies used to reuse, treat and dispose of greywater. Through the piloting of a system, the applicant and DEP will learn how well a proposed technology performs in the climate and geology of Massachusetts. Potential problems with these innovative systems can be identified and corrected before widespread use is allowed in the State. Approval Process: Innovative/alternative greywater systems applications must be submitted to DEP for approval. Applicants should use the same DEP process as for other innovative/alternative technologies —permit application number BRPWP64b for piloting use of a greywater technology, BRPWP64c for remedial use of a greywater technology, or BRPWP63 for use of a greywater technology at a State or Federal Facility. Because the "piloting" category also may apply to situations where an existing system has failed, is failing or is non-conforming, in such situations, the selection between permit categories BRPWP64b and BRPWP64c is at the discretion of the applicant. Applicants for remedial use of a technology must show, through evidence of effective past performance of the system over a period of at least one year of general usage in other states, that the system will provide a level of protection at least equivalent to a conventional Title 5 system. Applicants for piloting approval of a technology must show, through available laboratory data, field testing, previous use and other information, that the system is likely to be capable of providing a level of protection at least equivalent to a conventional Title 5 system. The two permit categories have the same permit application fee and timeline. Due to the lack of performance and operational data for these technologies, as noted above, Title 5 requires that when a system is designed for "new construction" (a new facility or a facility with an increase in design flow), some sort of contingency plan must be in place.
