Dear Mr. Atsalis:
You are granted a. variance from Regulation 310 CMR 15.02 (17) of the State
Environmental Code, Title V and the Town of Barnstable Board of Health "Marginal
Lot" Regulation, to install an onsite sewage disposal system above natural ground
in filled land at Lot 7 Magnolia Avenue, Centerville, to service a proposed dwelling
to be constructed at Lot 6 Magnolia Avenue, Centerville, with the following
conditions:
(1) The easement, located at the proposed site of the septic system, shall be
recorded on the deed.
(2) According to the EPA/WPC Project No. 625042402 Grant Application 66.418
CONSTRUCTION GRANTS FOR WASTEWATER TREATMENT WORKS
CONSTRUCTION PHASE, dated June 1988 special grant condition #22 signed
by the Town of Barnstable on May 31, 1988, any wastewater effluent pumped
from septic systems connected to a building, facility, or other manner of
construction which is erected or otherwise placed, in whole or in part upon
land which is defined as a wetland or floodplain, cannot be disposed at the
Wastewater Treatment Plant located in Hyannis. Therefore, the applicant
shall furnish the Board a copy of a contract with a licensed septage hauler
indicating where the wastewater effluent_ (which is to be pumped from the
septic tank on an annual basis) will be disposed of.
(3) The septic system shall be installed in strict accordance to the approved
plan dated revised November 26, 1990.
(4) The reserve leaching facility shall be installed at the same time the "main"
system is installed.
(5) The designing engineer shall supervise the construction of the onsite sewage
disposal system and certify in writing that the system was installed in strict
accordance to the submitted plan.
(6) The dwelling must be connected to Town water.

The variance is granted because the designing engineer, Arne Ojala, demonstrated
that the same degree of environmental protection required under Regulation
310 CMR 15.02 (17) of the State Environmental Code, Title V, and the Town
of Barnstable Board of Healths' Installation of On-.Site Sewage Disposal Systems
on Marginal Lots Regulation, will be achieved without strict application of these
particular provisions. Also, the existing fill onsite was analyzed by the Board
members who agreed that the soil is clean medium sand without impervious
materials. Therefore, it would be unreasonable to require a 25 foot removal
of this clean sand to replace it with sand . as required by Title V, the State
Environmental Code.
