Your latest correspondence to Barnstable Public Health Division was a voicemail to Timothy Lavelle stating that the property would be cleaned up on the weekend of May 9—10,2015. Mr. Lavelle re- inspected the property on May 12, 2015 and still observed violations (specifically rusted out and discarded 55 gallon drum, file cabinet, gas grill,exercise equipment and ironing board, as well as other scrap metal; rotten and discarded scrap wood;broken and discarded plastic buckets,toys, and hazardous material containers; and large pieces of discarded styrofoam). Because the issues at the above property have not been corrected after given a reasonable amount of time,your client is required to appear at the next scheduled public meeting of the Town of Barnstable Board of Health. Unless you can provide proof that the above issues have been resolved prior to the hearing,you are scheduled to appear at the June 9,2015 public meeting. Mr. Timothy Lavelle of Town of Barnstable Health Division,re-inspected the property several times and again on July 7,when he still observed items on the ground which are defined as rubbish per Section 353 of the Town of Barnstable Ordinance(rotten and discarded scrap wood; broken and discarded plastic buckets, broken toys). You are ordered to remove all of the rubbish items on or before August 18, 2015, Failure to comply with an order of the Board of Health will result in the issuance of a$100.00 non-criminal ticket citation. If the rubbish is not removed before the established deadline,you and/or your client will be automatically scheduled to appear at the next scheduled public meeting of the Town of Barnstable Board of Health.
