Variances may only be granted when, in the opinion of the Board of Health, the applicant has demonstrated that (a) enforcement of the particular provision would be manifestly unjust and (b) the same degree of protection could be achieved without strictly adherence to a particular provision or regulation. No protective alternatives were presented in regards to protecting drinking water wells from contamination. There are multiple contaminants contained within sewage wastewater which are considered to be detrimental to health, given the proposal to construct the soil absorption system in close proximity to the onsite private drinking water well (only 74 feet) and to neighbor's wells.
