Box 704 Marstons Mills, MA 02648 Dear Mr. Bortolotti: The original order letter dated August 7, 2001, directing you to construct a swale or drainage system at 50 Old Stage Road, is hereby rescinded. The Board of Health members viewed the site. It was determined that the septic system installation area was properly sloped to divert rain water from the front yard onto the rear yard on the same property. Box, 534, Hyannis, MA 02601 Tom: It is my understanding that there is a meeting scheduled for Tuesday, 4 � 16 October 2001, regarding my complaint concerning the Septic installation at 50 Old S bege Rd. .and is to include all concerned parties. I recommend that meeting 4put in abeyance. In our last brief conversation you mentioned that the property owner at 50 Old Stage Rd. had mentioned to you that there is a question of the exact location of the property line. I believe that this requires investigation. When we purchased the property, 30 some years ago, I walked the property with one of1the-sellers, Mrs Gail Cook. She pointed out the front°)1ot:-corner pipe stake on the side in question and we were joined at this point by the adjacent owner of the property at the time, Mr. Peterson. He sunstantiated that the pipe was the property corner. In addition, Mrs. Cook went to great extremes to point out the two azaleasthat had been broucjhhut of China by her:1,husband's parents and planted by her several years ago. Both were within what was thought to be the property line. Why would she have planted them there if she wasn't sure of the line? A good question. Subsequent owners of the property at 50 Old Stage Rd. ; Mrs. Ivar Johnson and Colleen Cahill, appeared to except the property line established, especially Ms� Cahill who erected a fence along the line. II I-never.�had my lot surveyed, which now appears to be a major mistake on my part, for preliminary investigation by me revealed that the pipe stake might very. well be in the wrong location. I intend to have the line surveyed which, hopefully, will be in the near future. As I stated to you im my letter of 21 August 2001, it appeared to me that the construction at 50 Old Stage Rd. violated ','Title V. First, that the toe of the slope shall be a minimum of 5(five) feet from any adjacent. property. Secondly, that the finished side slopes of a mounded system shall not be steeper that 3;1(horizontal:vertical. Both of these especailly the latter, appeared to me to be a threat to the Azalea trees from water damage. Until the propert line iestablished,,my complaint appears to be a moot issue. If the toe of the slope is a minimum of five feet from the established property line then my complaint is invalid. The slope angle I leave to you. On August 7, 2001, an order letter was mailed to Robert Bortolotti, President of Bortolotti Construction Company, directing him to contruct a swale or drainage system to divert the water away from Mr. Crowley's property within 45 days. On August 13th, Mr. Bortolotti requested a hearing before the Board of Health. Therefore, a hearing is scheduled to be held on September 11 th at 7:00 p.m. in the basement Conference Room of the SAB Building. Any members of the public may attend the hearing. It is my hope that the Board of Health members will uphold the order. Based upon my experience with previous actions taken by the Board of Health, I believe the Board would be very stringent in ensuring a violation of Title V is corrected. F.Y.I. - In the meantime, the Engineering Division staff is investigating the run-off from the public sidewalk and roadway, which would appear to significantly contribute to this particular problem at this site. A few days after this letter was sent, a crew from Bortolotti Construction Company went out to the site and placed hay bales at the top of the slope. They also planted wildflowers along the slope of the bank. These actions appeared to correct the problem at the time. <<File Attachment: crowleyw.doc>> Then, one year passed by until May 7, 2001 when another letter was received from Mr. Crowley. Immediately after receiving his letter, Health Inspector Glen Harrington was dispatched to view the site. Mr. Harrington took two photographs and made the following observations: 1) The new homeowners at 50 Old Stage Road do not appear to maintain their property very well (ie. many leaves have accumulated along the property line, etc.). 2) It appears there is some road run-off entering the complainants property. The Engineering Division was informed about the problem. 3) A swale or drainage system could be constructed to direct run-off away from the adjacent property. On two separate occasions, Mr. Harrington and I have spoken to the Foreman John Norman, of Bortolotti Construction Company. To date, Mr. Norman has refused to construct a drainage solution. My next step is to prepare an order letter to Robert Bortolotti to correct this problem. The letter will be prepared and will be mailed-out via certified mail (in approx. 2 days).
