Dear Ms. Hamlyn,
You are granted conditional variances on behalf of your client, Christopher
Bullock., to install an onsite sewage disposal system at Lot 2 Pheasant Way,
Centerville, Massachusetts. The variances granted are as follows:
PART VIII, SECTION 1.00: The soil absorption system will be located 60 feet
away from a coastal bank, in lieu of the one-hundred (100) feet
minimum separation distance required per the Board of Health
Regulation.
PART VIII, SECTION 1.00: The reserve area for the soil absorption system will
be located 50 feet away from a coastal bank, in lieu of the one-
hundred (100) feet minimum separation distance required per the
Board of Health Regulation.
These variances are granted with the following conditions:
(1) No more than three (3) bedrooms maximum are authorized at this
property. Dens, study rooms, offices, finished attics, sleeping lofts, and
similar-type rooms are considered "bedrooms" according to the MA
Department of Environmental Protection.
(2) The applicant shall record a properly worded deed restriction, signed by
the owner of the property, at the Barnstable County Registry of Deeds
restricting the property to three (3) bedrooms maximum. A copy of the
recorded deed restriction shall be submitted to the Health Agent prior to
obtaining a disposal works construction permit.

(3) The septic system shall be installed in strict accordance with the
engineered plans dated revised May 11, 2004.
(4) The designing engineer shall supervise the construction of the onsite
sewage disposal system and shall certify in writing to the Board of Health
that the system was installed in substantial compliance with the submitted
plans dated revised May 11, 2004.
These variances are g.ranted because the physical constraints at the site
severely restrict the location of the greywater disposal system due to the close
proximity f a coastal bank and a bordering vegetated wetland.

Variance request
Dear Board Members:
The Conservation Commission issued an Order of Conditions dated November 6, 2003 to
Christopher Bullock approving the construction of a single-family house with
appurtenances on Lot 2 Pheasant Way, Centerville, MA. The Commission will review a
revised plan on April 6 showing the house, in its approved size and configuration, to be
seven feet closer to resource areas; the septic system design has not been revised from
that approved.
There are several resource areas on and adjacent to the locus property: river and
riverfront area,bordering vegetated wetland and coastal bank. The septic system occurs
outside of the riverfront and beyond the 100-foot buffer zone to the BVW. However,
septic components are located within 100 feet of the coastal bank.
Board of Health Regulations state:
Unless specified by the Board of Health, all soil absorption systems, leaching
facilities, septic tanks, disposal fields, or other sewage disposal system
components hereafter constructed shall be so located that a distance of not less
than one hundred (100) feet shall intervene between and bordering vegetated
wetland (as defined within 310 CMR 15.002 of the State Environmental Code,
Title 5, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage)
and/or watercourse including brooks,ponds, salt and fresh water marshes, bogs,
streams, coastal banks, lakes or spring high water mark of tidal waters and any
portion of any soil absorption system, leaching facility, septic tank, disposal field,
or other sewage disposal system component.
During the public meeting held on February 17, 2004, the Board members voted to utilize
the State's definition of coastal bank listed under 310 CMR 15.002 of the State
Environmental Code, Title 5.
Accordingly, the applicant seeks variances from the above as follows:
The leaching facility is proposed to be located 60 feet from the top of the coastal bank,
requiring a 40-foot variance.
The reserve is proposed to be located 53 feet from the top of the coastal bank,requiring a
47-foot variance.
The septic tank is proposed to be located 70 feet from the coastal bank, requiring a 30-
foot variance.
The distribution box is proposed to be located 67 feet from the top of the coastal bank,
requiring a 33-foot variance.
This coastal bank exemplifies the type of noneroding bank that occurs inland of a
freshwater, woody swamp; it is designated as a coastal bank under state regulations
because it is adjacent to a 100-year flood elevation. The edge of the river was located at
the mean high water elevation of the tidal creek; all components of the septic system are
located over 200 feet away from the tidal waterbody. The plant community type changes
from salt water to freshwater between the tidal creek and the base of the slope—salt
marsh to brackish marsh to woody swamp. The slope, upon which the 100-year flood
elevation falls, is upgradient of the BVW and stabilized by a mature multi-tiered plant
community.
The leaching facility design meets breakout requirements and will not destabilize the
bank. The minimal design is to service a proposed two-bedroom dwelling. The system
has been located as far from the coastal bank as possible while maintaining the property
line setbacks required under Title 5; no other state or local variances are required.
A work limit line is to be established a minimum of fifty feet from the top of the bank
and shall be maintained to project completion, which includes the stabilization of
sediments. All disturbed areas shall be vegetated upon completion of construction.

your letter during the public meeting held on November 18th
Public Health Division staff will ensure that the application will be thoroughly reviewed
before any permits are issued to construct a septic system at Lot 2, located off Pheasant
Way Centerville. This parcel is listed as parcel 2 on assessor's map 227 (61 Pheasant
Way)
If there are any wetlands within 100 feet of a proposed soil absorption system,the
applicant will be responsible for bringing the application before the Board of Health and a
public hearing will be scheduled. The applicant will also be responsible for properly
notifying all of the direct abutters regarding the date,time and reason for the hearing.

Dear Board Members:
In response to a letter written to you by Attorney John Alger, dated November 4, 2003
regarding a septic design for new construction on Lot 2 Pheasant Lane, Centerville,
Ha.mlyp Consulting offers the following:
The reserve of the septic system to which Mr. Alger refers, is located 114 feet from the
wetland edge. The active leaching facility is located approximately 121 feet from the
wetland. The reserve is located 53 feet from the top of a non-eroding coastal bank.
This bank exemplifies the type of coastal bank that occurs inland of a freshwater,woody
swamp and is designated as such because it is adjacent to a 100-year flood elevation, as
was discussed at-the October 14, 2003 Board of Health hearing. The Board is
considering altering the definition of coastal bank, which would omit this type of bank
from the required 10046ot setback regulation. The discussion was to be continued at the
November 18, 2003 hearing.
If the Board redefines coastal bank to preclude those non-eroding coastal banks not
effected by tidal action, then the septic design will require no variances. If the definition
does not change, the applicant will apply for a variance to the 100-foot required setback.

I am writing as the attorney for Peter Howard-Johnson and George Panaiotopolous. The
above-named;_Christopher Bullock, has a petition pending before the Barnstable Conservation
Commission to-construct a-single family residence on a vacant lot off Pheasant Way, Wetlands
File SE3-3220. The plan, which was originally drawn in 1997, shows a septic system which is
approximately 50 feet from the edge of wetlands. Your current regulations, Part VIII Section
1.00 effective June 13, 2003, required that all septic systems be located not less than 100 feet
from a bordering vegetated wetlands.
This application clearly does not comply and I am writing to request that you review this
application before any permits are issued to construct a septic system at this time.

Regarding the above referenced regulation could you please provide clarification
on the definition for coastal bank. The Board traditionally defined coastal bank as a bank
subject to tidal action-Tro—wie-M in the latest form of the 100-foot regulation(revised May
27,2003)there is now a reference to Title 5. The latest revision to Title 5 uses the
310CMR10 definition of coastal bank, which is rather broad based. Additionally the local
Conservation Commission has their own definition of coastal bank,which is also
different from 310CMR10. So if you could provide some direction it will be appreciated.

Definition
Coastal bank is defined in Article 27 as a seaward face or
elevated landform, other than a coastal dune, which resides
at the landward side of a coastal beach, land subject to
tidal action, or other coastal wetland. A coastal bank must
have a slope greater than 18% (compare figures 1. &. 3. ) . A
coastal bank may serve as a vertical buffer to floodwater,
or as a sediment source.
Analysis
The Article 27 coastal bank policy loosely parallels DEP's
bank policy (92-1) , but important differences exist. 00

* To be regulated, a coastal bank must have a slope
greater than 18%. The toes- bank is that point where
the slope first exceeds` ;18$�The top of bank is that
point where the slope di3k shes to 18% or less
(figures 3. & 4 . ) . Observe that the top of bank may
occur below (figure 4. ) or above (figure 3. ) the FEMA
100 year coastal floodplain.
* A slope less than or equal to 18% is not a coastal bank
under Article 27, although it may be under DEP policy
(figure 1. ) .
* Under DEP policy, a coastal bank may arise anywhere the
FEMA 100 year coastal floodplain occurs, as long as the
slope criteria are met. Thus, a DEP coastal bank may
occur at a seemingly "interior" location, removed from
the shoreline itself, but where the topography is low
and the landscape prone to coastal flooding. Under
Article 27, a regulatable coastal bank must necessarily
reside adjacent to a tidal waterbody.

* Multiple or tiered coastal banks may reside at' the same
site (figure 5. ) .
* A coastal bank may extend above the FEMA ,100 year
coastal floodplain only when the toe of bank is located
below the floodplain (figure 3. ) . That is, a bank
originating beyond the FEMA 100 year coastal floodplain
is presumed insignificant to storm damage prevention
and flood control interests, and is not regulated
(figure 2. ) .
Methods
Slopes of potential coastal banks shall be determined by
employing one or more linear transects, depending on the
bank's profile view:
* Where the slope is relatively uniform (Figure 3. ) ,
the transect shall extend from the toe of bank to the
FEMA 100 year coastal floodplain (or velocity zone,
should no "A" zone be indicated) . The derived "run-up
slope" must exceed 18% to qualify as regulatable.
* Where the slope is variable (Figure 5. ) , the
transects shall be fitted so that the steepest portions
of the bank are analyzed. Employing a single transect
that includes both steep and gently sloping portions of
the bank would serve to "average" the run-up slope, and
shall not be considered appropriate.
The top of coastal bank may be determined by either sighting
the first observable break in the >18% slope, or by using
the transect method to quantify the point at which the slope
diminishes to 18% or less.
Observe that as this policy and methodology are independent
of their DEP counterparts, different "local" and "state"
banks may exist at the same site.
Slopes which are clearly <18% shall require no demonstration
that they are not regulatable. Where slopes are clearly
>18%, a regulated coastal bank may simply be conceded by the
applicant without detailed analysis. Otherwise, slopes for
Notice of Intent filings shall typically be determined from
field survey spot elevations. Transect location(s) shall be
shown in plan view, with spot elevations and run-up slope
indicated. As a rule, deriving slopes through interpolated
contours shall not be an acceptable method. Neither shall
