I was inundated with inspections Board of Health filings due to the December 31, 1999 deadline. I wish to reiterate our phone conversation of this date. permits I understand that you have obtained permits from the health department for lots 1/2, 3, 8 and 9 -which effectively grandfathers you from any changes for the next 3 years should your area be determined a"nitrogen sensitive area"by the Town or State. I have filed Lot 4 with the Health Department for a minor variance necessary to the lot line(10' to 5% as I wanted to keep the septic system at the highest portion of the lot- which was in the access panhandle. As of this date, your lots are within an"Aquifer Protection District",which at this time carries no restrictions as to the number of bedrooms. Your disposal works permits are extendable - no guarantees, but they would likely be extended. It would be important to keep track of the dates on the disposal works permits. i believe there are plans at the Town showing a proposal to sewer the area surrounding Wequaquet Lake in the next 10 to 15 years. We had hired a wetlands specialist to flag the areas of Lots 3 and 4 for any wetlands under the definition of the Wetlands Protection Act and the Town of Barnstable regulations. She observed the vegetation and topography as required,to determine the demarcation between upland and wetland. She flagged an area and noted it as"isolated land subject to flooding"which we subsequently mapped. Our review of the mapping raised some questions in our mind as to the possible combinations of vegetative and topographic and soils conditions which would define a wetland. As a check, Arne(a licensed"site evaluator")dug some holes in various areas on Lot 3 and determined that the soils were not"hydric"and therefore, even though there are some wetland indicator species present, under the present definition of wetlands,this area would not be called a "resource area". Since the determination of wetland resource areas can be somewhat subjective, depending on the perspective of the delineator,the way to be absolutely sure that the area would not be included under the jurisdiction of the Barnstable Conservation Commission and/or the Wetlands Protection Act would be to file a "Resource Area Determination"with the Commission. This would entail a formal filing and attendance at one public Conservation meeting. It is our opinion at this time that it is not a wetland resource area. If and when you decide to pursue the work on Lots 6 and 7,we would need to hire a wetlands specialist again for those lots in order to determine upland versus wetland area. We would also perform some light topographic work to get an idea of possible house/septic layouts-again,to determine feasibility of building. We would have to be certain of the upland area in accordance with zoning regulations. In summary, you are grandfathered for Lots 1/2, 3,4, 8, and 9 under the pre-2000 regulations with the Health Department. Revisions can be made to these plans as necessary when and if the time comes to build on them. Regards, Sarah E. Our client wishes to permit the construction of a 3 bedroom dwelling at the above-referenced location. The lot resides within an AP District according to the "Town of Barnstable Revised Groundwater Protection Districts", dated September 1998. The area is served by town water and town sewer is not available at this time. The variance requested under Maximum Feasible Compliance is minor in nature: a reduction in setback distance (10' to 5')between the leaching facility and the property lines. This septic system could have been constructed in complete compliance with the 1978 Code without the need for variances. Under the Transition Rules regulation 15.005 (3) (isolated lot), the system is designed to the maximum extent feasible and is slated to be completed within 3 years of obtaining the Disposal Works Permit. The system is placed in the panhandle access to the lot due to the fact that it is the highest portion of the lot -we are able to maintain the 5' separation to the high water lake elevation without the need for a costly and unsightly concrete retaining wall structure. The system is designed as H-20 loading and will be vented. The driveway is proposed to be pervious. On behalf of our client,we are requesting a variance from the Title 5 regulation 15.405, Maximum Feasible Compliance. By granting the variance, the same degree of environmental protection can be attained without the need for strict adherence to Title 5 regulations. Very truly yours, , Arne H.
