Based on its review of the application and accompanying.plans, the Department recognizes that a sewer connection is not feasible and that there is no other feasible alternative for the disposal of sanitary sewage in accordance with 310 CMR 15.000. The Department finds that the application and plans are in compliance with 310 CN4R 15.000, and, accordingly, hereby approves your request pursuant to 310 CMR 15.260, Tight Tanks, subject to the following provisions. Failure to comply with these provisions may result in revocation of this approval. 1. Prior to installation of the tight tank, the owner. shall obtain a disposal system construction permit from the Barnstable Board of Health. 2. This approval is limited to the existing use and any change of use will require a new approval. The facility's flow to the tight tank is limited to 330 gallons per day. 3. The owner shall allow representatives of the Department and the local_Board of Health access to inspect the.. facility during construction in order to assess compliance with the final plans as approved by the Department. It is the applicant's responsibility to ensure that the approved plans are available at the site during construction. 4. No tight tank shall be utilized until the owner has submitted to the Department and the Board of Health written certification by a Massachusetts Registered Professional Engineer or Registered Sanitarian that the tight tank has been constructed and installed in accordance with the approved plans and conditions of this approval. 5. The owner shall provide the Barnstable Board of Health with a copy of an executed two year service contract with a septage hauler licensed to operate in that community, which identifies the disposal location(s) of the tight tank contents. Failure of the owner to properly maintain the tight tank and keep it from overflowing shall constitute grounds for revocation of this approval. 6. Within 30 days of a sewer becoming available to the facility, the owner shall connect the facility served by the tight tank to the sewer and shall abandon the tight tank in accordance with 310 CMR 15.354. 7. Prior to installation of the tight tank, the owner shall record a copy of this approval letter in the chain of title to the property served by the tight tank and shall submit to the Department the book and-page number and the date of such recording. (5) The designing engineer or registered sanitarian shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised plans dated January 7, 2008. These variances are granted to allow the proposed construction of a holding tank. The construction of an onsite sewage disposal system does not appear to be feasible because of the small size of the parcel, proximity to wetlands, and the height of the groundwater in comparison to the elevation of the existing dwelling. The proposed holding tank appears to be the best alternative for this site. Upon a motion duly made by Dr. Canniff, seconded by Mr. Sawayanagi, the Board voted to approve with the following conditions: 1) the plan will be revised to show the three variances, and 2) a three-bedroom deed restriction will be recorded. (Unanimously voted in favor.) VI. Septic Variances (New): A. David Crispin, BSC Group, representing Georgia Giardini — 56 Long Beach Road, Centerville, 20,000 square feet lot, repair of failed septic system with variances requested. Staff comments requested a review of the sizing calculation —they had thought 200% was not met, there's a dashed line going straight through the pump chamber and they would like clarification on it (answer: that is the limit of where sand fill needs to go —they are keeping the septic tank as far away from the wetlands as possible. Also mentioned, the code FFE is finished floor elevation. David Crispin reviewed the sizing: it is a two bedroom, thus 220/dayx200 gal = 1400 and the size of tank is 1500 gallon, therefore, the tank is an adequate size. Mr. McKean said the buoyancy calculations are needed on the plans. David Crispin explained that effluent filters are only seen on the septic tanks, not on a pump chamber. The system presented is a MICRO-FAST system. With this system, an effluent filter is not required. Upon a motion duly made by Dr. Canniff, seconded by Mr. Sawayanagi, the Board voted to approve with the following conditions: 1) revise the plan to eliminate the eight feet to elevation, 2) insert the buoyancy calculations, 3) a two- bedroom deed restriction will be recorded, 4) construction will be done in accordance to the DEP approval letter W04219 dated Jun 4, 2004, 5) monitoring plan will be done quarterly for two years then they will be able to come before the Board to request a reduction in the monitoring plan, and 6) the total will not exceed 19 nitrate. (Unanimously voted in favor.) B. David Coughanowr and William Gordon attended and David presented the plan of the.tight-tank. The DEP would be required to approve the tight-tank and they are very reluctant to do so. DEP requires all options explored first, however, their comment was that DEP approved a similar one in a similar situation. The staff had concerns with the plan: the bouyancy calculations need to be reviewed. Dr. Miller recommended to be very prepared to debate the use of a tight-tank with the DEP. They are very reluctant. Based on its review of the application and accompanying plans, the Department recognizes that a sewer connection is not feasible and that there is no other feasible alternative for the disposal of sanitary sewage in accordance with 310 CMR 15.000. The Department finds that the application and plans are in compliance with 310 CMR 15.000, and, accordingly, hereby approves your request pursuant to 310 CMR 15.260, Tight Tanks, subject to the following provisions. Failure to comply with these provisions may result in revocation of this approval. 1. Prior to installation of the tight tank, the owner shall obtain a disposal system construction permit from the Barnstable Board of Health. 2. This approval is limited to the existing use and any change of use will require a new approval. The facility's flow to the tight tank is limited to 330 gallons per day. 3. The owner shall allow representatives of the Department and the local Board of Health access to inspect the facility during construction in order to assess compliance with the final plans as approved by the Department. It is the applicant's responsibility to ensure that the approved plans are available at the site during construction. 4. No tight tank shall be utilized until the owner has submitted to the Department and the Board of Health written certification by a Massachusetts Registered Professional Engineer or Registered Sanitarian that the tight tank has been constructed and installed in accordance with the approved plans and conditions of this approval. 5. The owner shall provide the Barnstable Board of Health with a copy of an executed two year service contract with a septage hauler licensed to operate in that community, which identifies the disposal location(s) of the tight tank contents. Failure of the owner to properly maintain the tight tank and keep it from overflowing shall constitute grounds for revocation of this approval. 6. Within 30 days of a sewer becoming available to the facility, the owner shall connect the facility served by the tight tank to the sewer and shall abandon the tight tank in accordance with 310 CMR 15.354. 7. Prior to installation of the tight tank, the owner shall record a copy of this approval letter in the chain of title to the property served by the tight tank and shall submit to the Department the book and page number and the date of such recording. 8. An operation and maintenance plan, acceptable to the Barnstable Board of Health, shall be implemented which requires monitoring of the system at a minimum frequency of once every three months to ensure proper operation and maintenance. 3 9. The owner shall submit monthly reports to the Barnstable Board of Health concerning operation and maintenance of the tank. 11.
