On Friday morning January 3, 2003, Mr. Jason Ellis, R.S. of J.C. Ellis Design reported to the Public Health Division and to the Brewster Police Department that his plans were"stolen" by Mr. Joseph Zysk, of McIntosh Builders and Remodelers. Mr. Ellis claimed that the septic system design plans were taken 'but of his hands"while at his Office that morning. Mr. Zysk then quickly drove away. Later that same day, Mr. Zysk filed a disposal works construction permit application, along with the required $100 fee (check#110), and two copies of the allegedly stolen plans to the Public Health Division Office. I verified that there was a report of stolen septic plans received that morning at the Brewster Police Department. After contacting Assistant Town Attorney David Houghton, I was advised to: (1) Contact Mr. Ellis and request him to submit an affidavit detailing what happened last Friday morning. Mr. Houghton offered to provide guidance to Mr. Ellis in this regard. (2) Contact Mr. Zysk and inform him of the following statement: - The plans apparently left the Office of Jason Ellis improperly or unlawfully, and - if this turns out to be the case,the application is deemed to be"incomplete." Both persons were immediately contacted yesterday and were informed of the above. At this time this incomplete application, two copies of the septic system plans, and check are on the desk of Health Inspector David Stanton and are considered to be public records.
