NOTICE TO ABATE VIOLATIONS OF 310 CMR 15 . 00 . STATE
ENVIRONMENTAL CODE, TITLE 5 , MINIMUM REQUIREMENTS FOR
SUBSURFACE DISPOSAL OF SANITARY SEWAGE
The property owned by you at 55 Short Beach Road.
Centerville was inspected on September 8 , 1987 , by Dale L .
Saad, Coastal Health Resources Coordinator for the Town of
Barnstable,because of a complaint. The following violations
of 310 CMR 15 . 00 the State Environmental Code, Title 5,
were observed:
REGULATION 15 . 02
( 14) Type of System : Sewage effluent does not discharge to
a suitable subsurface sewage disposal facility. Your
existing system is inadequate and considered to be a source
of contamination . The system is within 100 feet of a
waterway and is sitting in water at high tide. Evidence of
the system overflowing was observed .
( 19) Maintenance : Owner has not kept disposal system in
proper operational condition.
You are hereby notified to pump your system as many times
as necessary to prevent contamination until permanent
repairs are made.
You are directed to have a professional engineer submit
plans within fifteen ( 15) days of receipt of this order
upgrading your on-site sewage disposal system to conform to
Title 5', of the State Environmental Code and the Town of
Barnstable Health Regulations .
If no action is taken in this matter, the Board of Health
will consider condemnation of the dwelling.
You may request a hearing before the Board of Health if
written petition requesting same is received within seven
(7) days after the date order is served.
Non-compliance could result in a fine up to $500 . 00 . Each
day's failure to comply with an order shall constitute a
separate violation.

Dear Mr. Traywick:
My family and I rented the cottage at,=55 SThort_Beach ;
,,�P7,5ad�from August 15th through August 29 , 1987 I-am`com
pletely disgusted with the conditions that we were made to
endure. The cesspool was overflowing into the yard the first '.
week we were there. We had to wait one whole day before
someone came to pump it out. On Tuesday of the second week
it overflowed again, leaving the same terrible odor in the
air both outside and inside the cottage. They came to pump
it out Tuesday afternoon and told me there was a serious
problem and they would be back on Wednesday morning.
Needless to say, I never saw them again. By Thursday
we had no toilet facilities at all. Three times we went to
your office between Thursday and Friday, and we also left
a message with your answering service Friday night, and still
no response from you.
All I can say is that your company is a non-caring
company. We paid you $1700 for rental of what we thought
was a functional cottage. The fact that we had a problem
is understandable. However, the fact that you never acknowledged
our calls is just inexcusable. We had to leave early on
Saturday (August 29th) morning due to the lack of facilities
and it upset my wife very much to leave the toilet in the
condition it was \in, however, we had no choice.
I would appreciate a prompt reply to this letter. We
were unable to reach the Board of Health to report this,
but I am sending a copy of this letter to them in the hopes
that this condition will not happen to another client of
yours in the future.
