The filing is made on behalf of our clients, Joanne Crowley and Jay Bergeron, owners of the property and its single family dwelling. The Variance ' confirmation has been used because, to the best of our knowledge, no other form exists even though a tight tank request is not classified as a Variance. Based on Town records, the dwelling has existed at the site since 1940. The lot fronts directly on the Centerville River. It has an average grade of 5' MSL where high groundwater based on monitoring data is±2.25' and MHW is±1.8'. ' This property is located in the Craigville DCPC enacted by the Cape Cod Commission and adopted Barnstable Assembly of Delegates 1/19/11 under County Ordinance #11-01. ' Although these DCPC regulations become part of the Town's Zoning and Health Ordinances, because they are Ordinances of the County Government rather than the Town, there appears to be no provision for zoning relief through an application to the Zoning Board of Appeals as ' is the case with locally adopted zoning. Further, there is no provision in the County Ordinance for appeal to either the Cape Cod Commission or the County Assembly of Delegates. ' This set of regulations imposes a minimum 20' front yard setback for all structures. "Structures" are defined as "Anything constructed or erected on the ground or which is attached to something located on the ground. Structures include `t buildings, sheds, swimming pools and towers, but shall exclude fences of six feet or less in height and flagpoles" ' 1 20 Rascally Rabbit Road Unit 3 508 420-9792 Marstons Mills,MA 02648 FAX 508 420-9795 ' Consequently, a mounded septic system which consists of structures including retaining walls, a distribution box and leaching chambers constructed on/over the existing ground surface cannot be ' located in the front yard setback. This has been confirmed with Arthur Traczyk of the Town Planning Department. ' The Bergeron lot is±60' wide. The long existing building is 30' from the front property line. The plans show the current semicircular drive reconfigured to an "L" shape located within 5' of the west property line and 10' wide. This is the narrowest practical width and location which continues access to the attached one car garage. The space remaining for a mounded system to service the dwelling is 8' x 43' (assuming only 2' of separation to the building and 2'to the driveway. Leaving space for the retainage, the available space for the SAS footprint would be only 5'x 40' an insufficient area for the facility to be ' served even assuming a 25% leaching reduction in accordance with 310 CMR 15.405(1)(c). The space between the south side of the driveway garage access and the north side of the dwelling ' presents similar geometric constraints. This space is 16' x 20'. Because the front door is on the north side of the dwelling, we would need to leave 5' between the retainage and the building and 2'to the driveway. Considering the width of the retainage, the available leaching area would be only 6' x 13'. The dwelling proper is only 13.2' off the west lot line and only 12.9' off the seawall at the Centerville River. ' Because of the small lot size geometr y y of the house relative to the lot lines, high groundwater relative to surface grades and house elevation, and location in the flood plain, neither waterless toilets nor II 1 systems are suitable options. A concern of DEP's expressed in the past relative to the use of tight tanks has been that they might be disconnected, with effluent allowed to run into an adjacent waterway because of the expense involved in pumping. However, the DCPC regulations also impose, through the Board of Health, a requirement for ' septic pumpers to inspect systems at every pumping and provide records of both pumping and inspections to the Town Health Department. This will allow the Agency to track the state of the system and to be alerted to a potential deficiency if pumping records are not received for the interval required in ' the contract with the hauler. For all of these reasons, and the fact that the Craigville area is one of the Town's targets for municipal ' sewering,the tight tank is, in our professional opinion,the only option for this site which provides the same degree of environmental protection as would a system which was fully compliant with State and Town Regulations and which would not impose the manifest injustice of rendering the garage ' nonfunctional at the least and, in light of the inability to obtain a Variance for a mounded system within the front yard set back,the condemnation of the house at the worst. The tank solution would continue to be utilized until such time as municipal sewer service is made available. ' We would also point out that since the layout for Short Beach Road has a width of only 15', it is not possible for the Bergerons to park in the roadway. t2 o s ' The site lies within a FEMA mapped A Zone with a projected 100 year flood elevation of I F NGVD. It is not in a mapped Velocity Zone. ' The system will not facilitate increased flows to the system. The Board of Health has required a deed restriction limiting the site to 3 bedrooms be recorded prior to issuance of a construction permit. As ' shown on the attached floor plans, the house currently has 4 bedrooms. Variances — Septic (New): A. Arlene Wilson, A.M. Wilson Associates representing Jay Bergeron and JoAnne Crowley, owners —59 Short Beach Road, Centerville, Map/Parcel 206-034, 6,534 square feet lot, two setback variances. Arlene Wilson presented her plan for a tight tank to replace the current single cesspool. The property abuts the Centerville River at one point. It is a four bedroom built in 1940. The high ground water over a one month period is approx. 2.25 feet and the ground surface elevation is five feet. This means it is not possible to meet the Town's requirement of four feet of dry, permeable.material above ground water. Arlene explained there is an added problem as the property is located in the DCPC area which requires that all structures built on grade must comply with a 20 feet front yard setback and a 15 feet side yard setback. A structure under this ruling would include any retaining walls so a mounted system is not an alternative. No variances are permitted. A tight tank is proposed because it is underground and does not have to conform to the front and side yard setbacks. The tight tank would be 78 feet from mean high water which exists on a small sea wall. Mr. McKean said he and the staff reviewed old plans on file to see if a Title V system could be installed. It appears the ground water level has risen since the previous plans and is now only about 2 feet above grade so a comparison with the old plans is not possible. The staff also had a question on the bedroom count. A previous plan approved in 2002 was for 3 bedrooms, not 4, and the floor plans submitted appear that the second room identified as a bedroom on the first floor is too small. Dr. Miller stated that this property is restricted to a 3 bedroom as it is in the Estuary and the DCPC area and can not approve an increase in flow. In the past, Brian Dudley, DEP, had turned down a tight tank on Short Beach; however, that was prior to the DCPC and now a mounted system is not allowed in the DCPC area. The Board supports the tight tank plan and acknowledged that it must go to DEP for approval. Mr. Pinho, the father of James Pinho at 65 Short Beach spoke to the committee. r r .. They are in support of the system as it will be an improvement over the cesspool which is probably sitting in ground water. The issue he brought up was that he does not believe the plan is accurate in depicting the cesspool as being on the 59 Short Beach lot. He believes it is six feet over onto his son's lot at 65 Short Beach and they request that when the cesspool is removed that it is completely removed and filled in with clean fill and the lawn repaired similar to the plush lawn which exists now. He also asks that no heavy equipment will be parked or use his son's paved driveway to the left of his house so as not to damage it. Otherwise, they are in support of the plans. Arlene Wilson said she did not survey the property. Mr. McKean stated that the three plans in the file from three different engineers all show the cesspool on 59 Short Beach. Ms. Wilson said she'll be happy to investigate and if, indeed, it is on the Pinho's property, the cesspool will be removed to the proper satisfaction. Upon a motion duly made by Dr. Canniff, seconded by Mr. Sawayanagi, the Board voted to have the plan for a tight tank approved by the DEP with the following conditions: 1) a three-bedroom deed restriction is recorded at the Barnstable i Registry of Deeds, 2) a proper copy of the deed restriction is submitted to the Public Health Division and 3) the engineer must share the DEP restrictions placed on the system with the homeowner as the restrictions are mailed to the engineers and not the owners. Prior to obtaining a permit, a signed Operating and Maintenance Contract must be submitted to the Public Health Division. (Unanimously, voted in favor.) An additional note: Arlene Wilson said the owners have been trying to obtain a pier permit for five years. The window to obtain a pier permit is very small and normally, the Health Division can not sign off unless the septic is fine. Arlene asked the Board if it would be possible to have the inspectors sign off on the pier permit now that the Board has reviewed the plans. She said the standard time frame for the State DEP approve for the tight tank would be a minimum of 60 days which would be too long. The Board declined the request. I 1 ' Project Description Bergeron Tight Tank ' The Bergeron/Crowley property is a lot of±0.15 acre developed with a 4 bedroom single family home with attached garage in approximately 1940. It is serviced by COMM public water supply and a single cesspool The entire site has an average elevation of 5.0' MLS where the 100 year flood elevation is I F MSL. Thus in a 100 year event the property would be expected to be 6' under water. More importantly,the town's Flood Study shows flood waters to match or slightly exceed the site elevation in as little as a 10 year flood. ' The site is mapped as within an area where groundwater contributes to a saltwater estuary. It is also within the Craigville DCPC District. Preservation and improvement of surface water ' quality is of prime concern for both of these districts. The owner/applicants wanted to be sensitive to the area's water quality issues in the ' replacement of their septic system. Composting toilets are not an option here because there is currently no basement and basements are not allowable because of the site's location in a Flood Zone. The lot is so small, that a mounded system would not only take up the entire t front yard, but could also be deemed an impediment to floodwater likely to cause or increase damage to abutting properties in the event of severe flooding. As such, it would likely be prohibited under the Craigville DCPC regulations. Consequently, a tight tank, utilized until ' such time as the area is provided with municipal sewer service, seemed a reasonable option. 310 CMR 15.260 allows tight tanks to replace a failed on-site septic system when there is no ' other feasible alternative. The Town defines a single cesspool as failed. In this instance it is our professional opinion that due to the small lot size, number of bedrooms to be serviced, location in the flood plane, closeness of abutting development, high groundwater and other tregulatory issues, a tight tank in anticipation of municipal sewering is the only feasible alternative which provides the necessary degree of environmental protection. ' The tight tank and its connection to the long existing dwelling require Variances from Section 360-1 of the local regulations which require 100' setback from wetlands and water bodies. There is nowhere on the lot where these facilities could be sited which would meet the setback requirement. ' The existing cesspool which is to be decommissioned is only 3 F from the salt marsh and the building sewer predates the regulation and cannot be relocated so as to conform. Consequently, to deny the setback Variance would, we believe, be manifestly unjust. A concern of DEP's which has come up on other tight tank requests is the potential for illegal discontinuance. However, in this case the Craigville DCPC regulations have established a requirement that septic pumpers provide both pumping and inspection reports to the Town every time service is provided to a facility within the District. (5) The designing engineer shall supervise the construction of the onsite sewage disposal.system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised plans. (6) The pressure distribution system shall be inspected quarterly (four times per year). The applicant shall provide a copy of a quarterly inspection contract to the Board of Health. These variances are granted because physical constraints at the site severely restrict the location of a soil absorption system due to the fact that the Centerville River adjoins the property.
