In response,to the request,I have caused the records at the Barnstable County Registry of Deeds to be researched. ,I have also reviewed the Town of Barnstable Zoning Ordinance. Based upon my review of the results of the search of the records at the Barnstable County Registry of Deeds and the Zoning Ordinance,it is my opinion that Lot 28 on Plan Book.224,Page 127(Sheet 2)constitutes a buildable lot for zoning purposes. This opinion is based upon the following: ; 1. The lot located at 282 Skunknet Road, Centerville,Massachusetts was established,on a plan dated October 11, 1967. The plan is recorded in the Barnstable County Registry.of Deeds in Plan Book 224,Page 127(Sheet 2). It is shown as Lot 28 on said plan. A copy of the plan recorded in Plan Book 224.,Page 127(Sheet 2)is„attached hereto as Exhibit 1. 2 Lot 28 is.located in the Residence C Zoning.District..-At the time Lot 28 was created,the Residence C Zoning District had a minimum lot size of 15,000 square feet(see Article 49' adopted at the Annual Town Meeting on March 4, 1958). 3. According to the Assessor's,Records for the Town of Bamstable,Lot 28 contains 0.42 acres of land(18,295t sq.ft.). A copy of the Assessor's Records are attached hereto as Exhibit 2 4. Lot 28 met the Minimum Lot Size requirements for lotslocated in the Residence C Zoning District when it was created in 1.967. At the time they acquired Lot 28 in 1975,Henry Keskula and-Barbara L.Keskula owned abutting Lot 29 located at 292 Skunknet Road,Centerville,Massachusetts: 7. Henry Keskula and Barbara L.Keskula acquired abutting Lot 29 by a deed dated June 12, 1970 recorded in Book 1476,,Page 410 from John E.Barnard,Jr.. 8. According to the Assessor's Records for the Town of Barnstable,Lot 29 contains 0.57- acres of land(24,829+-sq. ft.). A copy of the Assessor's Records are attached hereto as Exhibit 3. 9. Lot 29 met the Minimum,Lot Size requirements for lots located in the Residence C Zoning District at the time it was first created and when it was acquired by the Keskulas in 1970. 10.Henry Keskula and Barbara L.Keskula owned Lot 28 and abutting Lot 29 in common from January.31, 1975-until August 28, 1978. l 1. On August 28, 1978 by a deed recorded in Book 2773,Page 151 Henry Keskula and Barbara L. Keskula conveyed Lot 28 to Douglas R,Xeskula°and Donald H.Keskula. Henry Keskula and"Barbara L.Keskula retained'a life estate inLot28. 12.At the time of the conveyance of Lot 28 in,1978,the Minimum,Lot Size requirement for, dots located in the Residence C Zoning District was:15,000 square feet, p 13, Since the conveyance of Lot 28 by Henry Keskula and Barbara L.Keskula to Douglas R. Keskula and Donald H. Keskula,Lot 28 has been held in separate'ownership from all abutting Lots. j 14.In 1985,the Minimum Lot Size requirement for lots located in the Residence GZoning, - District was increased to one(1) acre. It was this zoning change that made Lot 28 nonconforming. The lot is grandfathered because it has been held in separate ownership from all abutting lots since it was separated from abutting Lot 29 by the conveyance of Lot;28 by Henry Keskula and Barbara L.Keskula to Douglas R. Keskula and,Donald H.Keskula(with a life estate retained in Henry and Barbara Keskula)on August,28, 1978. This conveyance into separate ownership occurred prior to the zoning change:in°1985 that made the lot nonconforming. The lot meets the requirements for the separate Lot Exemption set forth in Section 240-91 of the Zoning Ordinance. Board of Health Regulations Lot 28 is located in the Acquifer Protection Overlay District,the least restrictive drinking water' protection district. It is also located in the Saltwater Estuary Protection Overly.District. Under regulations in effect as of the date of this letter. a three°(3)bedroom single-family residential structure can be built upon Lot 28 provided the lot satisfies percolation test requirements and further provided that a Title V compliant on-site septic system can be installed on the Iot without the need for any variances from Board of Health/Title V'regulations. No other opinion is rendered on the effects of Board of Health regulations and no opinion is rendered on the effects of Conservation Commission regulations on Lot 28.
