Discussion: A. Ed Pesce, 1'8 Bay Lane, `Centervillel, status update. Ed Pesce was present. Originally the plan had the septic located in the back. As they started to install the system, a potential purchaser said he was interested in purchasing both properties and was interested in building the house in the back. Upon discussion of the steps that were then taken, the Board explained this is viewed as new construction and is within 100 feet buffer of wetlands. With two or more components changed in the plan, this represents a significant change from the original plan. Therefore, the applicant is required to come back before the Board for approval. The Board also stipulated that the bedrooms will have to be taken out of the carriage house. y Date: December 11, 2006 To: The Barnstable Conservation Commission From: Susan Nelligan 700 South Main Street Centerville, MA 02632 My name is Susan Nelligan. I live with my husband William Goldenberg and our two children at 700 South Main Street in Centerville. Our property abuts the southeastern boundaries of 716 South Main Street and 18 Bay Lane. We wish to comment on the proposal before the commission regarding 18 Bay Lane. BACKGROUND We purchased our property in January of 2005. Various inspections were carried out in December of 2004. Before making an offer on 700 South Main,we looked at 716 South Main, which was also on the market at that time. We observed standing water in the basement of 716, as well as wet squashy ground in the driveway and to the left of the driveway(18 Bay Lane). In general the property looked very wet in December; We moved into the cottage on our property at the end of March 2005. At that time we ; began the permitting process for a restoration project on the main house on our-property We had the property surveyed and wetlands marked. U� During the spring and summer we frequently observed the details of our propertyViand its-- boundary with 18 Bay Lane as we walked our bounds with various builders archi ects T= landscape architects, surveyors, landscapers, arborists etc. to assess both the existing state0' of our property and the need for maintenance projects as well as possible future improvements We also drive by 716 S Main and 18 Bay Lane almost daily. During this time we observed that standing water would accumulate at 18 Bay if there was more than a brief shower. We also observed that the wetlands line marked at 18 Lane for its relevance to our property was at the phragmites that bordered the lawn behind the Chauffeur's garage (i.e. very large garage.). We did not observe any standing water behind the Chauffeur's garage. j At some point(in the fall?) 716 and 18 Bay were purchased. It appeared as if some type of septic tests were performed. Driving by the property at this time a backhoe at the front of 18 Bay was pulling up buckets of black soup. Septic work commenced for 716,the existing house, and at the front of 18 Bay. The work at the front of 18 Bay Lane was carried out over a long period of time. More than T r once it appeared that the work was carried out at low tide. A large capacity hose (fire hose size)was used to pump out the excavation site as work was performed in it. At sometime after work was begun at the front of 18 Bay, it became apparent that much larger quantities of water were accumulating on this property. Rather than dissipating in a day or two, as had been the case previously,the surface water persisted. From this time on there was always standing water on the property. Much to our consternation,water was piling up behind the chauffeur's garage at 18 Bay as well. When the heavy spring rains came, a"lake"formed at 18 Bay, and an even deeper lake behind the chauffeur's garage. The water here extended to our property line. At the end of June this water was still at our property line. It appeared to be a big stagnant pool. In contrast to the previous summer when we ate most of our meals outside,we were so inundated with mosquitoes; we could not sit outside at all. The builder at our house brought in machines to control the mosquitoes for his carpenters. Everyone outside had to wear mosquito repellant. Towards the end of June the mosquitoes were so thick we called Cape Cod Mosquito Control and left a message before we left for vacation. We called again when we returned in July. There was still a stagnant lake to our property line,and Mosquito Control had been unable to understand our message, but was eager to locate'the problem we described. When we finally connected in the middle of July,Mosquito Control was astonished by what they found. They told us they had not seen larval counts that high in years, and told us we had saved the entire neighborhood from a very serious infestation of mosquitoes. In a few days they told us we would have been covered with mosquitoes just going to our cars. For the remainder of the season they came every time it rained. Another interesting ecological change that seemed to be related to the water and,perhaps, the mosquitoes was the bullfrog(?)population. These frogs are VERY loud. They were also VERY numerous. You could not miss them. You could hear them all day, but at night they put on quite a show. They were also definitely not there the prior summer. Again,not a presence that would go unnoticed. Around the middle of August,while we were away, 716 and 18 Bay dried enough to be mowed. However, as soon as it rained again the property began to accumulate water and the lakes returned. The following pictures were taken on November 29, 2006. The area covered with leaves at the front of the boundary between 716 and 18 Bay is actually covered with standing water perhaps 6"deep on which the leaves seem to be floating. These leaves were actually brought in by a giant dump truck and spread over the area. 1 QUESTIONS 1. Where is this water coming from and why can it no longer drain? Has either a new source of water been introduced or an old form of drainage been eliminated by the recent work. The Centerville River is across the street. The property is almost floating on the water table. We know from work on our own property that you don't have to dig far before you reach the water table, and you can watch the water in the hole rise and fall with the tide. Could it be that some type of farmers drain designed to draw water to the Centerville River has been blocked, in effect creating a dam that is causing the water to pile up on 716 and 18 Bay. Could the installation of the(leaching field?)at the front of 18 Bay be interfering with the ability of the water table and tide to draw water from these properties 2. Were the wetlands lines incorrect? If the ground adjacent to our property behind the chauffeur's garage had been as wet in the past, in fact under standing water most of the year,there should be wetlands plants present that reflect these conditions. In fact there are none and were no such plants when we had our wetlands line marked, indicating that this is a new condition. 3. Can the FEMA lines be correct? Can a flooded plain be considered a flood plain or function as a flood plain? We are concerned that the water accumulating on this property will drastically alter the drainage of this area in the event of a flood. In particular, we are worried about a storm surge that would send rising waters through the Bump's River and Skudder's Bay and adjacent tidal marshes as well as the tidal creek area to the east of our property. This network of wetlands seems to circle back to the Centerville River,pressing at the back of our property and 716 and 18 Bay. If you examine the elevations, it would appear that if the"lake" behind the chauffeur's cottage received additional water in the event of a storm surge it could easily breach our property line and flow to the lowest part of our yard, flooding our garages and gardening shed on the way. 4. Can the raised(leaching field?)area work? Can it work given how wet that site appeared to be during the work? This week they were opening that area up after there was a substantial flood in the basement of 716. A lot of water(hopefully not backed up from the septic)was pumped out. We know because it all emptied into our lower yard, filling it like a pool. (Perhaps a good thing for 18 Bay since there really is no more room for water on that property.) 5. Have changes to the elevations at 716 and 18 Bay altered where water accumulates on these properties. During the septic work, substantial site work was done between the proposed location of the new house and the raised area at the front along the street. Are changes here forcing water to accumulate at the back of the property? 6. Will additional work exacerbate the drainage problems? Will removing the footprint of a new home from the flood plain further hamper the property's ability dissipate surface water? I � IN CONCLUSION Based on historic maps of Centerville and photographic evidence, it does not appear that anything has ever been built on this piece of land. It has existed as meadow or undeveloped land since the late 1600's, disturbed only when Bay Lane was introduced. Despite the Lewis family's progeny building homes all along South Main extending both east and west of 700 S. Main(their original"South Sea"homestead),in over 300 years no home was ever built at 18 Bay Lane. We would like to gently suggest that there might have been a good reason for that. We earnestly request that the conservation commission delay rendering a decision on whether a new home should be built at 18 Bay Lane until the cause or causes of the property's present condition are conclusively identified and permanently rectified. That is why I told him to cap the pipe. I have asked Brian Celia to check out that system and see if he can figure out where it goes. If we create a lake by capping that pipe, we will have to figure out what to do with the water.
