Subsection B is proposed to read as follows after such revision: B. RESTRICTIONS No permit for the construction of an individual sewage disposal system shall be granted within the watersheds for the estuaries that have been identified as requiring a reduction in the current TMDL of nitrate-nitrogen as identified by the map titled "Massachusetts Estuary Project, Zones of Contribution to Saltwater Estuaries, Town of Barnstable, March 10, 2008" unless the following standards are met... All other provisions of Subsection B will remain unchanged. You are granted variances, on behalf of your clients, Elevterio and Rosemarie Ricci, to construct a replacement onsite sewage disposal system at 8-10 Sunset Avenue, Centerville. The variances granted are as follows: 310 CMR 15.211: The soil absorption system will be located 7.2 feet away from the westerly property line, in lieu of.the ten (10) feet minimum setback required. 310 CMR 15.211: The soil absorption system will be located 7.6 feet away from the northerly property line, in lieu of.the ten (10) feet minimum.setback required. 310 CMR 15.211: The soil absorption system will be located 7.2 and 7.8 feet away from the foundation wall, in lieu of the twenty (20) feet minimum setback required. 310 CMR 15.211: The septic tank will be located eight (8) feet away from the westerly property line, in lieu of the ten (10) feet minimum setback required. 310 CMR 15.211: The septic tank will be located 7.6 feet away from the foundation wall, in lieu of the ten (10) feet minimum setback required. The staff is of the opinion that this may result in a reduction in the height of the retaining wall design. (3) No more than four (4) bedrooms maximum are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. (4) The septic system shall be installed in strict accordance with the revised plans. (5) The designing engineer or registered sanitarian shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised plans. (6) These variances expire three (3) years from the date of the variance decision letter. It is the applicant's responsibility to obtain a disposal works construction permit within the three_year period. These variances are granted because physical constraints at the site severely restrict the location of the septic system components due to the very small size of the lot. The proposed new septic system appears to be designed to meet the maximum feasible compliance standa ds contained within the State Environmental Code, Title V.
