When in doubt; check it out! Wow, you look deep on this stuff. This can be good and bad. When I was mapping subdivisions and other miscellaneous changes to the Assessor's Maps, (this ended last year with me but I'm always available to look at some property/road title/plan issues) I used to,review the deeds & plans of record to identify just what the property owner was trying to accomplish. It gets real tricky. You actually end up checking the "time: stamp to see what minute/second the deeds were recorded to keep them in a progressive order. Thank goodness there are "others" that are responsible for this work since title searching can involve licenses and title insurance. When the owner called me looking for her"NEW" address, I had to insure this went before Assessors for evaluation and a commitment to a final parcel number. An assessor checks the title names on multiple deeds. The laws in Massachusetts allow property owners to mix& match properties it valid recorded deeds & plans as long as everything lines up. If it doesn't, the"OWNER" could have serious liabilities. Because we are not licensed title searchers, we, the town, do not have that liability. We review these things to TRY to make sure everything lines up but it is the owner's responsibility to get it right. How do we know if they have provided us with "ALL" the current info on the land and besides; what stops them from going out after and changing the deeds AGAIN and throwing a new construction into a non-compliance situation. As I said, when in doubt, check it out. If you really NEED this info beyond another department's.confirmation, be very careful what is said and done! Now for this mess. You only have "PART" of the story here. The owners had two parcels (Map 248 Parcels 006 &279) that was comprised of three lots (lots 5,5A& 6)! They wanted to combine them into one parcel. When this took place, I had them check with the Assessor's Office. I needed Assessor's to send me the answer whether they would combine them and which Map/Parcel number would be used for the final account. In this case they stated Map248 Parcel 006. Here you need to be careful. Map 248 Parcel 279 was to be deleted and combined with Map 248 Parcel 006. Map 248 Parcel 279"WAS" Dev. Lot 6 and it is easy to confuse the developers' lot number and the Assessors Parcel number. So, below should explain what happened: ORIGINAL: MAP/PARCEL DEV LOT ADDRESS OWNER Deed Book/Page . 248/006 5,5A 34 Trinity Place Shirley A. O'Brien, Trustee of Trinity Place Nominee Trust 15610/221 248/279 6 44 Trinity Place Shirley A. O'Brien, Individually 28871/303 (Note: The above two parcels don't have an EXACT name match) A new deed (Deed Bk.28873 Pg.61)was drawn up from Shirley A. Obrien, Individually "TO" Shirley A. O'Brien, Trustee of Trinity Place Nominee Trust for Map 278 Parcel 279, Dev. Lot 6 to align the deed for that parcel with the deed for Map248 Parcel 006, Dev. Lots 5,5A. This aligns the names on both deeds for both parcels and Assessor's can combine using the old plan and not need a new one! See how this works in this case? As far as the area of the property goes; the plan calls for lot 5 as 11,000 sq.ft. and lot 6 as 11,900 sq.ft. The lot 5A by description was part of lot another parcel and the new plan I sent you calls for 4,101 sq.ft. This should speak for itself unless there is a serious area problem. Let the surveyors deal with property area. As far as the road goes, these deeds are for the description of the PARCELS and not the road. Regardless what they have listed on this deed, especially when they contradict each other, it doesn't mean a thing. Besides, this is a TOWN road so our layout holds as a 40' wide taking. The original subdivision called it 40'wide and the town took a 40'wide "EASEMENT" for the road. If the deed didn't agree in the parcel description, then there would be a -6/8/2015 V" Message Page 2 of 2 problem. Like I said, thank goodness this is someone else's responsibility. Attached please find the first pages of 2 recent quitclaim deeds. I have highlighted my concerns, but I don't know if it means anything or if it is ok. They both list "Shirley A. O'Brien", however one document says"individually" and one says"trustee of Trinity Place Nominee Trust u/d/t dated September 16, 2002." 1 know you said they had to be identical, I wasn't sure if this meets that requirement. One says"by 40 foot way" and the other says"by 30 foot way", again, I don't know if this is an issue or not. Finally, the one says"11,900 11,900 square feet." it looks like another typo with an additional lot size figure.
