Sandwich, MA 02531 Ilk 1017 West:Main Street Hy A = 229`;060„ Dear Mr. Meyer, You are granted a conditional variance on behalf of your client, Henry Irvin Tousignant, to construct an onsite sewage disposal system at 1017 West Main Street, Hyannis. The variances granted are as follows: Section 360-1 of the Town of Barnstable Code: To install the septic tank 58.8 feet away from a wetland, in lieu of the minimum 100 feet separation distance required. Section 360-1 of the Town of Barnstable Code: To install the pump chamber 58.8 feet away from a wetland, in lieu of the minimum 100 feet separation distance required. 310 CMR 15.405(1) (b): To install leaching chambers up to 5.11 feet below grade, in lieu of the maximum depth of three feet allowed. These variances are granted with the following conditions: (1) No more than three (3) bedrooms are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. Q:\WPFILES\MeyerTousignantVariances2Ol5.doc (2) The applicant shall record a properly worded deed restriction, signed by the owner of the property, at the Barnstable County Registry of Deeds restricting the property to three bedrooms maximum. A copy of the recorded deed restriction shall be submitted to the Health Agent prior to obtaining a disposal works construction permit. (3) The septic system shall be installed in strict accordance with the revised engineered plans, showing the required pump curves, dated December 4, 2014. (4) The designing registered sanitarian shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised engineered plans dated December 4, 2014. These variances are granted because the proposed plan appears to meet the maximum feasible design standards contained within the State Environmental Code, Title 5 and local Health Regulations. The registered sanitarian designed the septic system to be located in an area to attempt to maximize setbacks to wetlands. We are currently on the agenda for the December 91h hearing for variances for an upgrade to the existing system at the subject property. As you can see,the revisions requested do not directly affect any of the requested variances. The owner and installer just felt it would be best to install a 313R 500-gallon chamber system rather than the stone leach field originally proposed. Dave Stanton spoke to you regarding this change yesterday and said you felt it would be acceptable to just bring the plans to the hearing, however, I wanted to provide a courtesy copy for your review prior to the hearing. Due to the emergency nature of the installation, we can't afford any delay, so if this change creates a delay,we will move forward with the initially proposed leaching. Thank you. Darren Meyer,R.S.
