On behalf of our client, we are requesting variances under Town of Barnstable Health Regulations Article (1) Chapter 360-1: Leaching facility and reserve less than 100'to the Coastal Bank(100'to 58') permits and septic tank less than 100'to wetland (100' to 56'). Under Title 5 310 CMR 15.211: reduction in setback, septic tank to full foundation (20'to 17'). The site is an undeveloped 41,214+/-s.f. lot. It is the last remaining undeveloped lot within the Wild Goose Way portion of the subdivision. The site is bordered to the east by (tidal)Scudder Bay and to the north and south by residences. Most of the site is intact and natural. Various Resource Areas affect the site, to include Land Subject to Coastal Storm Flowage (AE el. 13),Salt Marsh, Bordering Vegetated Wetland (BVW) and a (State & local) Coastal Banks. Transects were performed by Down Cape Engineering based on DWW Policy 92-1 and are indicated on the site plan. The State-defined Coastal Bank.is shown. Proposed work includes the construction of a 3 bedroom single family dwelling with paved driveway and Title 5 septic system. The project closely resembles what was previously approved. The plan received approval through the Conservation Commission on November 28th with the exception that they required the house to be moved 3'toward the street, which now requires a setback variance for the leaching facility and reserve to the dwelling from 20'to 17' in order to hold the required setback to the front property line. The 3 bedroom septic system is proposed as far from the resource areas as possible. Given the topography and resource areas,this is the most reasonable and practical area for the system. The most landward resource area affecting the site is the Coastal Bank. This Bank contains unconsolidated sediment and is not subject to significant wave action and does not act as a sediment source to any coastal beach. The proposed house is shown between the Coastal Bank and the septic system; no adverse effects are expected to the Bank by the septic system. The base of the system will be approximately 40'above groundwater. Based on the DeFeo,Wait &Associates, Inc. "Technical Evaluation of Title 5...." dated October of 1990, most of the contaminant removal occurs in the biomat layer and the unsaturated zone of the SAS. The vertical separation distance for this site is more than adequate for contaminant attenuation. In that the site does not lie within a Zone II,,the-area-is served.b.y town water_,the septic system is well above groundwater and that variances were previously approved), we feel that the proposed Title 5 septic system will not adversely contribute to the decline of existing water quality or food sources. Previously,the lot had been issued a Disposal Works Permit under old Title 5; the permit has since expired and the Board has requested that a Title permits 5 `95 design be incorporated. The enclosed represents this. In accordance with Transition Rules Regulation 15.005 3(c), the system has been designed to the maximum extent feasible under 310 CMR 15.000 pursuant to 15.404 and 15.405. Under 15.405 1(g),a variance is being sought from the required setback to a Town-defined and State DEP-defined Coastal Bank . Due to site constraints, including topographic limitations and wetland location,this is the only area of the lot that a Title 5 `95 design can be reasonably incorporated. The Coastal Bank is heavily vegetated and stable; a work limit line of staked haybales and silt fence will be used to confine the work space and protect against any possible erosion. The vegetated wetland is greater than 100' from the system. We feel that by granting this variance under 15.005 and the system having been designed as required to the maximum extent feasible, the intent of 310 CMR 15.000 is upheld and that a level of environmental protection is at least equivalent to that provided under 310 CMR 15.000 is achieved without strict application of the required setback distance to the Coastal Bank.
