Upon a motion duly made by Dr. Canniff, and seconded by Dr. Miller, the Board--voted-to CONTINUE UNTIL FEBRUARY 13 BOH, and all parties will converse with Brian Dudley, DEP, for clarification. (Unanimous in favor). B. Down Cape Engineering representing Cheryl Nolan, 97 Willow Run,_ Centerville, 1.3 acre lot, repair of failed septic system, four variances. Dan Ojala, Down Cape Engineering spoke and owner was present. Five foot separation is used. It is a combined septic and pump chamber. A mound is necessary. The Health staff comments were to move the retaining wall. Referring to the 11/17/06 plan, the engineer will move the SAS back towards the garage two feet to avoid creating their own hardship to Title V. (the plan currently has SAS at 8 feet, and setbacks are 10 feet) Upon a motion duly.made by Dr. Canniff, and seconded by Dr. Miller, the Board voted to approve the septic system with the following conditions: 1) move the SAS an additional 2 feet from the wall (having a total of 4 feet from wall), 2) plantings are required to be done on two sides - the neighbor's side and the water view sides (west and north sides), and 3) no increase in footprint and no change in number of habitable bedrooms with a maximum of three bedrooms (otherwise, they must come before the board). Unanimously voted in favor. D. Down Cape Engineering representing Fred Tonsberg, 2 Short Beach Road, Centerville, 12,630 square feet lot, repair of septic system, existing 2- bedroom to be razed and rebuilt as 2-bedroom, numerous variances. Arnie Ojala presented case. In the past, they did approve a plan in 2001 (with 12 variances) but they never installed it because the approved plan by Conservation is not what they decided they were happy with. (The 2001 approval has expired at this point.) They are interested in redoing the house now with the same number of bedrooms and relocating the system from the proposed side of house to now proposing it be in the front of the house. Staff comments: Because of close proximity, they recommend a tight tank. TM said Brian Dudley, DEP, said if we approve a tight tank, DEP will very carefully review. If a septic system is feasible, the DEP would prefer a septic system. If the only environmental issue is the distance to the wet area (here it is 39 feet). Previously approved was 29 feet, now they are extending it to 35? feet.. Dr. Canniff supports the staff in recommending a tight tank. Arnie said the tight tank is difficult to keep pumping. Chances are if tight tank is required, the owner won't make the changes to the house and it will end up continuing i b DESCRIPTION OF WORK 97 Willow Run Drive, Centerville, Massachusetts During June 1995, Horsley & Witten, Inc. (H&W) was contracted to perform a site assessment and removal of contaminated soil; the result of a failed above- ground storage tank. The site is a single-family residential property at 97 Willow Run Drive in the village of Centerville, Barnstable, Massachusetts (see Locus Map). The site abuts Lake Wequaquet on its western shore. The leaking tank was a 275-gallon home heating oil tank for use on the premises, T and was located on the west side of the detached garage in the rear (see attached Site Plan). Prior to H&W's involvement, the owner, after realizing the tank was leaking, had a contractor drain and remove the leaking tank. The previous contractor conducted no assessment and removed no soil. The material that was drained from the tank was stored in metal 55-gallon drums on site until manifested to CYN Environmental Services, Stoughton, Massachusetts, on July 21, 1995. A private potable water well is located on the property, approximately 150 feet north of the spill location. Prior to conducting work at the site, H&W obtained emergency certification from the Barnstable Conservation Commission to excavate, stockpile, and, eventually, dispose of contaminated soils. : The emergency certificate was ' 7 required as the site of the excavation was within the buffer zon e Bordering Vegetated wetland and a small embayment south of the property that connects to Wequaquet Lake, ease and north of the site. H&W subcontracted with EnviroSafe, Inc. for the actual excavation and transportation of contaminated soil. On June 30, 1995, the assessment and removal was undertaken. Utilizing a Thermo Environmental photo ionization detector, outfitted with a 10.6 eV lamp with readings expressed as benzene, soils were scanned as the excavation proceeded. Readings were taken utilizing the jar headspace method in accordance with Massachusetts 1 au; r � DEP protocol. The excavation was discontinued when headspace readings 4 . showed a reading of less than one ppm on the detector. Approximately 5 cubic yards of contaminated soil was removed from the excavation and r stockpiled on site until completion of the analytical work. The soil was placed on polyethylene and covered by same. The excavation was backfilled to grade with clean sand. Confirmatory samples were taken for laboratory analysis from the sidewalls and bottom of the excavation and from the stockpiled soils. The analysis was conducted by Groundwater Analytical of Buzzards Bay, Massachusetts. The samples were analyzed for Total Petroleum Hydrocarbons by USEPA Method 418.1 (modified). All results were non-detect for TPH. Since ground water is approximately three feet at the site, and the excavation encountered ground water, H&W installed a monitoring well in the location of the spill and excavation in order to determine if ground water had been impacted. The ground water sample was analyzed by Groundwater Analytical for TPH by EPA Method 418.1. H&W took a water sample from the potable water well and an additional sample from the monitoring well and had them analyzed for the presence of VOCs by the Barnstable County Health and Environmental Laboratory by EPA Method 502.2. for the drinking water well and Method 8010/8020 for the monitoring well. None of the analysis detected any contaminants. On October 3, 1995, all contaminated soil was transported to the recycling facility by EnviroSafe, Inc. The recycling facility is Bardon Trimount, Inc., Stoughton, Massachusetts. The leaching facility is placed in the most feasible area on the lot, keeping the leaching facility the furthest distance possible from the wetland areas. The.leaching facility is 5' above the high water lake elevation (Wequaquet Lake datum system), which according the the DeFeo& Waite study on Title 5 is a more important factor for treating effluent than maintaining required horizontal setbacks to resource areas. Due to the site's vertical proximity to groundwater, an w additional variance is necessary from the septic tank inverts to groundwater elevation, in order to maintain gravity flow from the dwelling to the septic tank. The tank is proposed to be waterproofed and pipe joints shall be sealed with hydraulic cement to maintain watertightness. Based on the fact that there will be no increase in habitable space, the new system is 5' above the high groundwater elevation and that Town sewer is planned for this area, it would be a financial hardship to require an innovative/alternative system for this site and then be required to connect to Town sewer when it becomes available. We feel that by granting these variances, the same degree of environmental protection can be attained without the need for strict adherence to the Title 5 and Town of Barnstable Regulations.
