Please be advised that the site upgrade (Warren Buick) recommendations to ' provide some type of monetary bond or guarantee to the Town in the amount of $4, 100, is an option that the applicant'` may elect. The reason for the above recommendation, which was made at the SPRC meeting of January 27 , 1994 , was to show good faith at the ZBA' hearing, which I presume would enhance the applicants request; for the upgrades that they are looking for. A curb ,cut ;permit would also be required by the DPW office Could youpass this information on to Mr. Richards and his Engineer? His engineer was made aware of these I recommendations. Thank you. Prior to issuance of a building permit, a cashiers check for the sum of $4,100, made payable to the Town of Barnstable, will be submitted to the Town. This money, requested by the Department of Public Works, will be held in escrow and returned to the applicant upon completion of all work shown on the attached, conditionally approved site plan. such work must meet all requirements of the Town of Barnstable Department of Public works construction standards for curbing and sidewalks. Enclosed please find a certificate of Review and a copy of the conditionally approved plan. Please be informed that you must comply with any requirements the Zoning Board of Appeals may impose in addition to the above, and that a building permit is necessary prior to any construction. Address: 100 Barnstable Road, Hyannis, MA 02601 Owner: Lewis Warren Trust (CCB&T Trustee) 307 Main Street, Hyannis, MA 02601 Assessors Map/Parcel: 327-056 (0.64 Acres) Zoning: B - Business District Ground Water overlay: AP- Aquifer Protection District (not applicable) Applicants Request: Variance to Section 3-3.1 (5) Bulk Regulations, Minimum Front Yard setback of 20 feet. Activity Request: To permit construction of a building addition on Willow Avenue side that extends into the setback area. Procedural Provisions: Section 5-3.2 (3) : variances Background information: This decision concerns the application submitted by Warren Buick, Inc. for a variance to bulk regulations, minimum front yard setback within the B - Business District as referenced above in the Town of Barnstable Zoning ordinance. The property, identified as Lot 056, Map 327 is located south of the intersection of Barnstable Road and center Street in Hyannis. According to the Assessor s Field Card, the lot contains 0.64 acres and was developed in 1930 as a commercial building. It is serviced by all public utilities. The applicant has indicated that existing gross floor area is 11,455 sq. ft. The petitioner is requesting relief from the front yard setback regulations of a minimum 10 feet along the Willow Avenue side to allow the construction of a new first floor entrance of 292 sq.ft. and a second floor addition of 658 sq ft. for storage (total addition - 950 sq. ft.) . The second floor addition extends over the first floor which is mostly open air and is to be utilized to display vehicles. The applicant is seeking to reduce the front yard setbacks to 2.8 feet and 3.2 feet as per plan submitted and titled "Site Plan of Land in Hyannis, Mass prepared for Warren Buick" and last revised dated 2-18-94. The plan was approved at site plan review with the understanding that new parking requirement of 49 spaces is satisfied as-of-right with 21 on-site spaces and more than 28 off-site spaces being provided at Warren Buick inventory lots #59 and #60, and by agreement with others on lots #65 and #57. All of the lots are within 300 feet and all are within the B District. 1 Staff Report - Appeal No. 1994-28 variance Minimum Front Yard Setback - Warren Buick 1 procedural Summary: The petition was filed in the office of the Town Clerk and at the Zoning Board of Appeals office on February 25, 1994. A public hearing , duly noticed under M.G.L. Chapter 40-A, was opened, closed and a decision rendered by the' Board on April 6, 1994. The petition was heard by Emmett Glynn, Ron Jansson, Gail Nightingale, Betty Nilsson, and Chairman Richard Boy. Attorney Mark Boudreau, Esq. is representing the petitioner and is accompanied by Mr. Rick Richard, manager of Warren Buick. Attorney Boudreau stated that Warren Buick wants to add a second floor to allow safer access to the dealership and not as presently, accessed through the garage portion. General Motors desires to have this problem remedied as well. Additionally, more storage is planned for files and there is a desire to spruce up the structure. Attorney Boudreau showed pictures for four parking spaces with three extra for handicapped spaces. The lot is unique with bordering streets on three sides. The topography is a hardship in that there is no sideline. The rear lot line is three feet from the property line and on the East it sharply slopes toward center Street. Site Plan Review has approved with conditions including a $4,1000 Bond to the town for sidewalks and improvements. The addition will not be in detriment to the neighborhood and will in fact be an improvement. Lots for additional parking include Lot 60 and 59 which are owned by Warren Buick, and there is available parking through a handshake agreement with the owners of lot 65. All are within the 300 feet rule and in the same zoning district. The owners are under a 10 year lease for the parking with+a five year renewal option and eight years remain on the 10 year lease now. Public Comment: Peter Demers, owner of the near by sunoco station, spoke to say that Warren Buick had always been a good neighbor and a face-lift would be good for the entire neighborhood. No comments were offered in opposition. FINDING OF FACTS: Based upon the evidence submitted and testimony given at this public hearing, a motion to unanimously approve the following finding of facts was made, seconded and approved: 1. That the lot is unique by fronting on three streets, and contains steep sloping edges on more than one side. The topography and shape makes it difficult to place any additional building on the land, therefore the site factors have great impact upon variance conditions being requested. 2. That it would be a hardship not to allow the desired additional building area be added because the original building was built as an auto dealership and if not allowed to expand, its use for other purposes would be difficult. Staff Report - Appeal No. 1994-28 Variance Minimum Front Yard Setback - Warren Buick 3. That the project does have conditional site Plan Review approval that includes the improvement of sidewalks along the Barnstable - Hyannis Road as agreed to by the petitioner. 4. That it would not be detrimental to the neighborhood as long as off site parking requirements are met and continued through leasing and/or use of owned parcels within 300 feet. CdNCLUSION: Accordingly, based upon the Findings of this Board, a motion was uly made and seconded that Appeal No. 1994-28 be granted the relief being sought variance of the minimum frontyard setback with the following conditions: 1. That it shall comply with all conditions of site Plan Review approval letter dated January 18, 1994. 2. That the addition ,be built as shown per plans submitted with the Site Plan of Land in Hyannis, Mass prepared for Warren application and titled Buick" and last revised dated 2-18-94.
