Centerville, on Wequaquet Lake. At that time I gave you 2 copies of a double pump, pump chamber, septic design. We had decided that a single pump, pump chamber would be less expensive, since there is a sewage system to be installed around the lake within seven years. I believe that you have authorized a permit for Bortolloti Const, to do the work. When I called them to say that a permit was available, they said they required a revised septic design showing a single pump, pump chamber. I had Holmes and McGrath revise their previous plan, and am sending you 2 copies. (collectively, `BNH"). Please find this as a response to your letter requesting Mr. Wilson's presence at a December 17 hearing to discuss the status of the septic system installation at 17 Old Way. BNH is involved in ongoing litigation with the Henrys arising out of the septic system installation that is the subject of your letter. Robert Henry has alleged in that case that BNH improperly performed its design of the septic system. BNH, while denying all liability, has attempted to resolve this matter amicably on multiple occasions. Specifically, BNH's plumbing consultant has inspected the residence and opined that the plumbing could be reconfigured to connect to the septic system, thereby completing the installation. BNH offered to pay the cost related to this reconfiguration. Robert Henry rejected this proposal. BNH has also offered to pay the full cost of installing a pump chamber, which the Board of Health previously approved as a means for resolving this issue. (See top of page 2 of July 10, 2001 Meeting Minutes, attached hereto as Exhibit A). To date, however, the Henrys have failed to accept this offer-and for this reason alone, the system remains unconnected. I believe this responds to your request for information concerning the status of this project and anticipate that no one will be required to be present to discuss this matter further on December 17. In attendance: Susan G. Rask, R.S., Chairman and Sumner Kaufman, M.S.P.H., Wayne Miller, M.D., members of the Board of Health. Also present was Thomas McKean, R.S., Director of Public Health. Susan Rask, R.S. Chairman, called the meeting to order at 7:00 P.M. First, a proposed regulation, to be numbered PART Vlll, SECTION 14.00 entitled Registration c Septic System Inspectors, was reviewed by the Board members. Sumner Kaufman stated the reason for this proposed regulation is due to the fact that we have had some very bad experiences with a duple of inspectors in the past. Susan Rask stated that she had consulted with Mr. Brian Higgins of the Massachusetts Department of Environmental Protection who agreed that a regulation requiring local registration of certified septic system inspectors is a good idea. In the past, complaints regarding particular septic system inspectors were forwardef to the Massachusetts Department of Environmental Protection for action. However, little or no action was taken by the State after a long period of time. Susan Rask asked if any members of the public had comments. None of the members of the public spoke in favor or against the drat regulation. The homf is presently vacant Susan Rask asked_ Mr. Wilson to update the Board members regarding the recent septic system installation at this site. Mr. Wilson explained that the sewer pipe entering the new septic tank does not meet up with the existing plumbing existing the house. The soil absorption system was designed to be located five feet above maximum groundwater elevation of 34.8. The disposal works installer constructed the system in accordance with the engmeerin! plans. Mr. Wilson stated that there are two options available to rectify this problem: (a) Install pump chamber and reset septic tank atlower elevation or(b) raise the dwelling. After some discussion,.the Board members recommended implementation of option"a.' Mr. Wilson agrees to pursue the recommendation made by the Board with his client. The next item on the agenda, Craig Field, BSC Group representing Chandler Bosworth, requested a variance to construct a soil absorption system less than 100 feet away from bordering vegetated wetlands at 37 Broken Dike Way Centerville. It was determined that the applicant failed to notify several abutters by certified mail at least 10 days before the Board meeting. After some discussion, a motion was made by Wayne Miller, duly seconded by Sumner Kaufman, and the Board voted unanimously to postpone the meeting until the next regularly scheduled meeting scheduled to be held on August 21. The applicant was advised to notify the abutters of the next meeting date, location, and purpose by certified mail at least ten days prior to the meeting. Next, Christine Rogoff was present representing Deborah Angelo to request a variance from the Board of Health Horse Stable Regulation, PART X, paragraph 6. The applicant requested a variance to house horses within the utility barn located 37 feet away from an existing onsite building at 32 Reid Lane, Marstons Mills. The Board reviewed the submitted plan. After some discussion, a motion was made by Wayne Miller, duly seconded by Sumner Kaufman, and the Board voted unanimously to grant a variance from the Board of Health Stable Regulation, Part X Paragraph#6, to utilize the existing utility barn as a horse barn located 37 feet away from the onsite home with an attached garage. The variance is granted with the following conditions: 1. No more than two (2) horses are authorized at this barn. (2) All the other provisions of the Board of Health Stable Regulation, Part X shall be strictly adhered to. (3) Horse manure shall not be allowed to accumulate on the property and shall be removed from the site on a regular basis. This variance is granted because the proposed horse barn is actually located more than fifty (50)feet away from the living areas of the home. The attached two-car garage is approximatell twenty (20)feet wide and is located between the home the utility barn. After some discussion, a motion was made by Wayne Miller, duly seconded by Sumner Kaufman, and the Board unanimously voted to continue this matter until August 21, 2001 after the Board receives revised engineering plans maximizing the separation distance to wetlands. Next on the agenda, John Kelley submitted a letter requesting a extension of disposal works construction permit issued on September 4, 1998 in regards to a new septic system proposed E 116 Bay Road, Cotuit, Massachusetts. The Board reviewed the submitted plans. Susan Rask stated the engineered plans appear to meet all of the State Environmental Code, Title V provisions and local health regulations. After some discussion, a motion was made by Wayne Miller, duly seconded by Sumner Kaufman, and the Board voted unanimously to grant the applicant a one-year extension of his disposal works construction permit number98-577 issued on September 4, 1998, regarding 116 Bay Road Cotuit, Massachusetts. This variance will allow the applicant to continue to operate a food service establishment at 500 Ocean Street, Hyannis, with the following conditions: No cooking of food will be allowed, only the tasting of bagels and reheating of pre-made egg and cheese sandwiches and micro waving of canned foods are allowed. Only disposable single service paper, plastic, and other disposable dishes and utensils are authorized. This under the sink grease interceptor shall be cleaned monthly. After some discussion, a motion was made by Wayne Miller, duly seconded by Sumner Kaufman, and the Board voted unanimously to grant a conditional variance from the Board of Health Regulation#1 which requires minimum 1,000 gallon capacity inground grease traps at all food service establishments in the Town of Barnstable. The applicant is granted permission to install and operate an automatic grease recovery device with the following conditions: 1. A grease recovery device (G.R.D.)shall be utilized at this site. 1. P.E. was present representing his client.lames Ellis, to requested permission to install a composting toilet at parcel 4 2, Sandy Neck He also requested permission to use the existing cesspool for the disposal of greywater from the washing of dishe: etc. Mr. Wilson stated it would be very difficult to get a field crew out to this particular site to construct a new septic system for this purpose. Mr. McKean reminded the Board members tha- a permanent cement system is not recommended at this location. Susan Rask agreed and stated that the proposed composting toilet is a good solution. However, she added, the Board needs some sort of verification as to where the cesspool is in relation to the well and in relation to the groundwater, and wetlands before a determination can be made whether or not it is alright to continue to use the cesspool for greywater disposal. Next item on the agenda, Stephen Wilson, P.E. was present representing his client Cape Cod Aggregates, to request a variance from Board of Health Regulation Part Vlll, Section 6.00, towr sewer is approximately 2,100 feet away at 20 Industrial Blvd., Hyannis. The Board reviewed th, submitted plans. Mr. Wilson stated that the closest public sewer line is approximately 2,100 feE away from this parcel; therefore it should cost considerably more to connect the building to public sewer. After some discussion, a motion was made by Sumner Kaufman, duly seconded by Wayne Miller, and the Board voted unanimously to grant a variance to the applicant from Part Vlll, Section 6.00, Groundwater Protection Regulation. The applicant is therefore granted permission to install an onsite sewage disposal system at 20 Industrial Blvd., Hyannis, Massachusetts. The variance is granted with the following conditions: 1. The building is restricted to office use only. No laboratories, cafeterias, or other use: are authorized in the building. 2. The sewage flow is restricted to 330 gallons per acre per day maximum. Horse manure shall not be stockpiled on the property above-ground. 2.---- The compost bin shall be constructed with three sides as designed, along with a slat'front. The front area of the bin shall not be left open; horse manure shall not be exposed. 3. The compost bin shall be kept covered at all times. 4. Any excess manure, which will not fit inside the compost bin, shall be removed from the property on a weekly basis. 5. Nye & Holmgren, concerning the Board of Health meeting of 10 July. The problem at 17 Old Way, Centerville, (204 Anabele Point Road), is that the design of the septic system is wrong. The system was installed according to an improperly designed plan. The result is a septic system that is above the level of the sewer pipe exiting the house. The engineering firms present solution is to re-plumb the bathroom fixtures and run the sewer pipe, exiting the house, attached and along the side of the house, above grade, into the newly installed tank. That is a possible fig (not acceptable), and does not address the original problem. The correct solution would be to re-install the septic system at the proper elevations. Ana ro riatel designed PP p y g system was paid for, not a system that is "close", then corrected (jury rigged) with a series of "fixes". The approved system is for a year round application, regardless of whether or not the house is seasonal. With sewer pipes at the surface, freezing would render this proposed "fix" useless.
