Notice of this hearing was given by mail, postage prepaid, to all persons deemed affected and
by publishing in Cape Cod News SBarnstable Patriot newspaper published in Town of Barnstable a copy of
which is attached to the record of these proceedings filed with Town Clerk.
A public hearing by the Board of Appeals of the Town of Barnstable was held at the Town

upon said petition under zoning by-laws.

At the conclusion of the hearing, the Board took said petition under advisement. A view of the

Atty. Laurence Sullivan presented his petition before the Board and requested
a special permit under Section P . of the Barnstable zoning by- laws to allow
two professional offices at 438 South St. , Hyannis in a residence B- 1 zoned
district. The property in question is located next to the Hyannis Shell gasoline
station and is now under a purchase and sales agreement with Atty . Russell Lucid
who would have his law office in this dwelling and would rent out the second
office. Mr. Lucid would live in the house in all probability and in total , there
would be an attorney' s office, a second professional office, and a family in.
residence at this property . No one spoke in favor of or in objection to the petition
and the Board took the matter under advisement.
The Board voted unanimously to allow the petitioner a special permit to establish
offices for two professional persons in accordance with the requirements of
paragraph 26 of Section P . , Special Exceptions , at 438 South Street ,, Hyannis in
a residence B- 1 zoned district . The following restrictions are imposed on this
special permit .
1 . The existing driveway off South Street leading to this property shall
serve as the only ingress and egress to the property.
2. The professional office use is limited to the main residential dwelling
only , and the existing garage to the rear of the property shall remain
as an allowed accessory use to a residence, only .
