We are writing regarding the variance petitioned for by Kyle and Julie Condinho (Appeal No. 2022011),
scheduled to be heard at the Zoning Board of Appeals Public Hearing at 7 pm on April 27th. The
Condinhos seek a variance from the front yard setback in order to allow for their newly
constructed garage, located at 34 Hi River Rd., Marstons Mills, to extend into the front yard setback by
approximately 1.1 feet.
Hi River Rd. is a small neighborhood with just 5 or 6 houses along the street. We own the property at 11
Hi River which is located across from the Condinho's newlyconstructed garage. Before the garage was
constructed, the land was an empty dirt/gravel lot owned by the Condinhos, which they used for parking
for their vehicles. The fact that they used this lot for parking was of no bother to us, just not much to look
at.
The newly constructed garage has made a significant difference in helping to beautify the neighborhood.
It is a quintessential New England style barn in appearance, complete with a cupola and weathervane
and window box planters on every window. The barn is surrounded by beautifully landscaped grounds
with a granite retaining wall on one side. The whole project was done very tastefully and is a remarkable
improvement over the empty lot it used to be. The garage is a beautiful and welcome addition to our
small neighborhood. Additionally, it is located near the entrance onto Hi River and thus can be seen
from the main road (Lovell's Lane), adding to the a scenic view along the main road.
It is of no consequence to the neighborhood that the garage extends by approximately 1 foot into the
front yard setback. It does not cause any issues with street access or cause any other kind of
interference. We never would have known there was an issue had we not received the Notice of Public
Hearing.
We fully support the variance the Condinhos are seeking and request that their petition be granted. If you
