Good Afternoon Anna,
To update you regarding this evenings meeting.
1) Patti Baker and I met with the Janet Holian and her professionals on Monday. They answered
questions regarding the size and location of the house, and that the new subdivision plan will not provide
access to Sunset Point but rather maintain all access of Windswept.
2) I have been contacted by Sonja Kelly who is next to me on Windswept on the other side. She and her
lawyer will be attending the meeting on zoom. They are very concerned by the proposal as it will add to
the traffic on Windswept which cannot handle the traffic now, and by the news that the new development
will increase pollution in the swamp by them and increase the likehood of flood damage.
3) I am pulling together slide materials for the hearing tonight. I will basically be making three
arguments tonight.
a) a motion to approve the variance for the proposed "Parcel B" would be in violation of the Zoning
Code Bylaws and Massachusetts law, not simply a variance regarding a Code regulation. I attach the
relevant sections of the Zoning Code and reference to the g.l. 40a.
b) The Division of Land Plan submitted to the Planning Board is not in compliance with Barnstable and
Massachusetts law not only because Parcel B as proposed is in volation of the lot shape factor bylaw but
also because Parcel A is not engineered in compliance with Barnstable Development Regulations and
Massachusetts law because it does not properly show that 250 Windswept fronts with access on
Windswept Way and that Parcel A is divided by a Land Court Registered Way. To Support my argument
I attach a subdivision Plan that is drawn according to the Town and State requirements, and the relevant
Massachusetts Land Court laws.
c) I will explain that granting the variance and enabling the Applicant to proceed with the development of
Parcel A, especially after approving all her development of Parcel B which involved the removal of a
large number of trees, is clearly contrary to the purposes of the Barnstable Code regulating development.
In partial support of my argument, I attach herewith the current FEMA Maps regarding floodplain on
Oyster Harbors which shows that the section of 250 Windswept Way to be developed in directly in a
specific 500year floodplain which is oriented to the south. I was present on August 16, 1991, when this
section of Windswept Way as well as my driveway was washed out and most all of the trees on the land
where my property adjoins the Holian property were completely devastated.
Please provide these maps and materials to the ZBA members.
