During the August 18, 2015 meeting of the Board of Health, the Board held multiple hearings regarding underground fuel or chemical storage tanks which have remained underground for more than thirty (30) years. Your hearing was held in regards to your underground fuel tank located at 97 Outpost Lane, Centerville. You testified that sometime during 1989, the oil was removed from your 1,000 gallon underground fuel storage tank; the oil was transferred into a new basement storage tank. You stated that your insurance company informed you that the tank does not need to be removed. During 1991, a soil vapor analysis was conducted. Then again on July 31, 2012, a second soil vapor point analysis was conducted. You testified that they felt the tank didn't need to be removed because there was no oil in it. In addition, you testified that the `EPA" in Lakeville informed you that the tank did not need to be removed. However, maintaining an underground tank at your property for greater than thirty years was/is a violation of Section 326-3 (b) of the Town of Barnstable Code. The underground fuel or chemical storage tank located at 97 Outpost Lane was kept underground at your property for more than thirty (30) years. The underground fuel storage tank was not properly abandoned nor Q:\WPFILES\UndergroundTankHearingRemmersOutpostLane2Ol5.doc removed as of the date of this hearing. After some discussion and at the end of your hearing, the Board voted unanimously to order you to remove your underground fuel storage tank within six (6) months. On September 24, 2015, Joanne Cardoza of Comm Tank Company, informed us that your tank was removed on September 21, 2015. Thank you for your response and cooperation in this regard. In 2012, you and Martin agreed that the Remmers could remove OR abandon the UST, but they must do one or the other. If they want to argue, I think they should appear before the BOH. t Hi'Tim, Here is a cut and paste from a site consultation that Martin performed on 8/13/2012. Met with homeowners regarding ongoing issue with ust on their property. They have received several letters from the TOB Health Dept on the status of the tank. After discussion apparently the homeowners stopped using the tank in 1989 or 1990 had the remaining oil pumped out into a new basement storage tank. The tank has never been properly abandoned or removed, the TOB wants proof that the tank was not leaking. This can be done through a soil vapor analysis of the surrounding soil. Upon inspection found soil testing pipe near existing ust, also noted vent for tank still in place on side B of house. Met with homeowners regarding ongoing issue with ust on their property.They have received several letters from the TOB Health Dept on the status of the tank. After discussion apparently the homeowners stopped using the tank in 1989 or 1990 had the remaining oil pumped out into a new basement storage tank.The tank has never been properly abandoned or removed,the TOB wants proof that the tank was not leaking.This can be done through a soil vapor analysis of the surrounding soil. Upon inspection found soil testing pipe near existing ust, also noted vent for tank still in place on side B of house. I explained to homeowners that even after satisfying the BOH they still have the responsibility to properly abandon or remove the ust. Just another FYI —this time regarding two phone calls from the Remmers of Centerville. I received the fist call this morning from Jean Remmers, not John, of Centerville. I then talked with Martin MacNeely of COMM FD to get some background on his site visit with them. He and I are on the same page in general —we both have recommended to these folks that they remove their un-used UST and not abandon it. I am guessing that the Remmers have been non-compliant with the Town on this issue for some time - based on her unwillingness to listen to the professionals who are giving sound advice, her argumentative attitude, and her insistence to blame our three departments in several ways for any action or non-action regarding their UST. Here are the highlights from the two calls I had from Jean Remmers today: . Jean Remmers explained that she had COMM FD/Martin MacNeely out to her property to discuss her UST. . She said that Martin told her that the vapor well installed for her UST was "done by the County." . I corrected her and told her that this was not accurate and she was taking what he said out of context. . 1 told her that at the time (1991) The County most likely recommended they install a vapor monitoring well to their UST. A company in Falmouth did the install. I have the paperwork that documents the install of the well. . Even when I read the full install summary sheet to her, she still insisted that the County arranged the well install and hired the contractor to complete this! . I told her this was inaccurate. f . Jean Remmers then tried to imply that the fuel oil company that used to fuel their UST % installed the vapor well (!). . I told her this made no sense that a private fuel oil company would pay for another company to trespass on her private property and pay for and install a vapor monitoring well connected to a UST they were no longer going to fill. . I also told her this was "arranged for and paid for by you, the property owner", and the Remmers are probably not remembering the particulars. . I made a copy of the one vapor test that was conducted by our department in 1991 (passed). I also gave her the copy of the vapor well install specs. . She picked these documents up today from our offices. . I told her I had searched all the databases and no other records, vapor tests or actions by our department exist for the Remmers' UST after 1991. . Jean Remmers told me they are "not interested at all" in the County's 0% interest UST 8/20/2012 Page 2 of 2 Removal Loan Program. . Her final comments to me were that she is going to "get the Fire Department, the Health Department and the County Health Department all on the same page and then she will determine what she will do with her UST." Information provided by you indicates that the underground storage tank was abandoned in place. Please be aware that Barnstable Code Chapter 326, Section 20 does not allow for a tank to be abandoned in place unless it is either located under a building and cannot be remove from the ground without first removing the building or which is so located that in cannot be removed from the ground without endangering the structural integrity of another tank. I understand he is looking into removing his old UST. I told him about our new program Oust was announced—more details to come) on 0% interest loans from BCDHE for removal of USTs, replacement of USTs and replacement of UST lines. He said he would think about it. He said he didn't remember when his tank went in and didn't have any information about it. I referred him to TOB Health or COMM Fire for a copy of his UST tag#, age and BOH regs for removal. I'll send more information about our UST loan program to you as it becomes available.
