Dear Health Director,
We recently inspected the septic system installation at 7 -9 Lake Elizabeth Road
in Centerville,MA. The system was designed by A&M Land Services,Inc. and was
installed by Mid-Cape Septic on or-about June 9, 1999.
All of the systems components were in place at the time of the inspection prior to
the system being back filled. There was a small railroad tie wall included on the top of
the SAS portion near the d-box. In my opinion,the installation is in accordance with the
approved engineering plans.

SUBSURFACE DISPOSAL QZ SANITARY SEWAGE
The properties owned by you located at 7-9 Lake Elizabeth
Drive and 19-21 Lake Elizabeth Drive Centerville , were
inspected on June 28 , 1988 and July 8 , 1988 by Donna Miorandi
and Thomas McKean, Health Inspectors for the Town of
Barnstable because of complaints . The following violations
of 105 CMR 410 . 00 , State Sanitary Code, Chapter II , and 310
CMR 15 . 00, the State Environmental Code, Title 5 , were found :
Regulation 410 . 300 af Chapter 11 and Regulation 15 . 02
( 19) (20) Q-t Title �: Sewage was observed overflowing
onto the ground at both duplexes . No sanitary sewage shall
be allowed to discharge or spill onto the surface of the
ground.
You are directed to submit sewage construction plans
within seven (7 ) days to this office upgrading this system to
meet the requirements of Title 5 and the Town of Barnstable
Health regulations . You are further directed to keep the
system pumped, daily if necessary.
In the event these orders are not complied with, serious
consideration will be given to the emergency condemnation of
this dwelling.
You may request a hearing before the Board of Health if
written petition requesting same is received within seven (7)
days of receipt of this notice .
Non-compliance could result in a fine of up to $500 . Each
day's failure to comply shall constitute a separate
violation.
You are also subject to a ticket citation for each day
violations are observed. There is a $25 . 00 fine for each
ticket issued. Tickets will be issued daily until the
violations are corrected.

Dear Mr. Aucoin:
You are granted multiple variances, on behalf of your client Joseph Frederico, to install a
replacement onsite sewage disposal system at 7-9 Lake Elizabeth Road, Centerville.
The variances granted are as follows:
• CMR 15.211 O Setbacks: To install a leaching field only one foot away from
the northerly property line, seven (7) feet out from
the westerly property line, and only three (3) feet
away from the easterly property line, in lieu of the
ten feet minimum separation distance required.
• 310 CMR 15.211 (1) Setbacks: To install a leaching field only seven (7) feet away
from the crawl space of the building in lieu of the
ten (10) feet minimum separation distance required.
• 310 CMR 15.211 (1) Setbacks: To install a septic tank only five (5) feet away from
the westerly property line, and only eight (8) feet
away from the dwelling, in lieu of the ten (10) feet
minimum separation distance required.
• 310 CMR 15.211 i 1) Setbacks: To install a pump chamber only eight feet away
from the dwelling in lieu of the minimum ten feet
separation distance required.

310 CMR 15.212 (1) Setbacks: To construct a leaching facility only four feet above
the maximum adjusted water table elevation, in lieu
of the minimum five feet vertical separation
distance required.
These variances are granted with the following conditions:
(1) No more than four (4) bedrooms are authorized at this property. Dens, study
rooms, finished attics, sleeping lofts, and similar type rooms are considered
bedrooms according to MA Department of Environmental Protection.
(2) The applicant shall record a deed restriction at the Barnstable County Registry of
Deeds in regards to the maximum number of bedrooms allowed at this site (four
bedrooms).
(3) The designing engineer shall supervise the construction of the onsite sewage
disposal system and shall certify in writing to the Board of Health that the system
was installed in strict accordance with the submitted plans dated February 3,
1999.
(4) The dwelling shall be connected to town sewer when available.
These variances were granted because the septic system will meet the maximum feasible
compliance standards of Title V. Also, the existing cesspools are located in close
proximity to groundwater and on the adjacent property. Therefore, the replacement septic
system may alleviate a source.of pollution to the groundwater in the area.
