Hi David, I came back in today because I needed to get some road permits out before the contractors run out of work! I'll tell ya, "The things you see when you haven't got a gun!"This property was mapped by Avis Airmap back in 1968 and nothing has changed on it since then. I pulled a copy of the deed which identifies the plan that is used to describe the land. Even though the plan was drawn for the owner of the property in 1963, there is no area or square footage listed on the plan! Using the standard procedures for mapping and calculating the area with a planimeter, I almost agree with the PE. I calculated the area to be 1.25 ac. +/-. This is much closer to the PE plan and way off compared to the town maps. At the cost of taxes, you'd think the owner would have complained sooner about the area shown on the town tax maps! I hope to get the maps corrected for next year FY 09. 1 can't get it into the town system before then. Could you either email or fax (508) 862-4799 me a copy of the PE's plan? It would help to have a copy in my files of that plan you have. Chances are your plan will never be recorded at the registry of deeds so you probably have one of the few copies in existence! I can use that plan when it comes time to map the correction. The differences between 1.23 & 1.25 acres is a minimal 2 hundredths of an acre so I would like to use your plan because it came in a little lower that what I calculated from the recorded plan. It will also be handy if the owner calls to complain that the town lowered their acreage. The acreage of lots abutting water ways will always be a little different when more than one person calculates the area because the water line is not constant. Even Land Court won't certify the location of a water line. I never know what I'm going to find when someone asks questions on an older piece of land like this that never had a complete description by the ones legally responsible. I hope this helps! Good afternoon Frank, I have a question about 429 Phinney's Lane, Centerville (Parcel ID 230-099, owner Parks, Nancy) Assessors records show the property as being 1.65 Acres. However an PE recently stamped a set of plans for a septic system upgrade and he claims the property is only 1.23 acres. On occasion there is a difference in acreage based upon a true acre (43,560 sq ft) and a builders acre (40,000 sq ft), however in this case that does not seem to reflect the difference in numbers. The problem we are having is that a town by-law limits the number of bedrooms a property can have based on the amount of land, and in this case, 1.33 acres is the limiting factor, which falls between the two numbers we have for the property, so we need to determine who is correct.
