(a) 310 CMR 7.26(50)-(54) applies to any.person who owns, operates,
manufactures, supplies, distributes or sells, or any person who intends to
distribute or sell, or market an outdoor hydronic heater for use in the Z ct G/
Commonwealth of Massachusetts (Commonwealth), except outdoor hydronic J
heaters fated with a heat input of 1 MMBtu/hr or greater that are subject to the
Comprehensive Plan,Application provisions at 310 CMR 7.02(5)(a)4.
(b) In addition to 310 CMR 7.26(50)-(54), Outdoor hydronic heaters may also be
required to comply with other regulations governing design, manufacture and
installation of boilers, including, but not limited to:
1. 522 CMR 5.00, Heating Boilers;
2. 522 CMR 6.00, Low-Pressure Heating Boilers;
3. 527 CMR 4.00, Oil Burning Equipment, for outdoor hydronic
heaters that are dual-fuel units; and _
4. 780 CMR 6007, Solid Fuel-Burning Appliances of the State
Building Code;
(51) Definitions. The following words and phrases shall have the following meanings
as they appear in 310 CMR 7.26(50)-(54). Where a term is defined in 310 CMR
7.00 Definitions and the definition also appears in 310 CMR 7.26(51) for
purposes of 310 CMR 7.26(50)-(54) interpretation, the definition found in 310
CMR 7.26(51) shall govern.
At Retail means the sale by a commercial proprietor of an outdoor hydronic
heater.
Clean wood means-wood that has no paint, stains, or other types of coatings, and
wood that has not been treated with preservatives, including but not limited to,
copper chromium arsenate, creosote, or pentachlorophenol.
Commercial-size outdoor hydronic heater means a heater with a rated thermal
,output greater than 350,000 Btu/hr and a heat input design capacity less than 1
MMBtu/hr as rated by the test method identified in 310 CMR 7.26(54)(c)2.
Distribute or sell means to distribute, sell, advertise for sale, offer for sale, lease,
ship, deliver for shipment, release for shipment, or regeive and (having so
received) deliver or offer to deliver for use in the Commonwealth.
EPA'.s ETV Program means U.S. Environmental Protection Agency's
Environmental-Technology Verification Program.
Executive summary means report submitted to the Department that summarizes
the results of testing compiled using tables 1, 2a and 2b, heating season and year-

heat input of the hydronic heater measured by the same test method.
Heatingseason eason means the period beginning October 1 and ending May 15
inclusively.
Manufactured means built and operational, and subsequently ready for shipment
(whether packaged or not).
Manufacturer means any person who constructs or imports into the United States
an outdoor hydronic heater for use in the Commonwealth.
Model.means all outdoor hydronic heaters offered for distribution or sale by a
single manufacturer"that are the same design and output capacity.
Opacity means the degree to which emissions other than water reduce the
transmission of light and obscure the view of an object in the background.
Outdoor hydronic heater or heater means a fuel burning device: (1) designed to
burn wood or other approved solid fuels; (2)that the manufacturer specifies for
outdoor installation or installation in structures not normally occupied by humans
(e.g., garages); and (3) that heats building space and/or water via the distribution,
typically through pipes, of a fluid heated in the device, typically water or a
water/antifreeze mixture.
Operator means any person who owns or operates an outdoor hydronic.heater in
the Commonwealth.
Particulate matter.or PM means the total particulate matter measured in
accordance with the test methods specified in 310 CMR 7.26(54)(c)2.
Residential-size outdoor hydronic heater means a heater with,a rated thermal
output of'350,0.00 Btu/hr or less as rated by the.test'method identified in 3.10
CMR 7.26 (54)(c)2.
Sale means the transfer of ownership or control.

Please answer. all of the following questions, as fully and
completely as possible. Attach copies of any relevant
documentation. Failure to respond timely and adequately to this
request for information, or submission of false, misleading or
incomplete information may subject you to legal action._
1. List all the names of the businesses you owned or operated at
the Property and the dates of such ownership or operation. If
known, also list the names and addresses of past
owners/operators and the nature of their businesses.
2 . Describe your current and past use of any oils or hazardous
materials generated, stored, treated, released, managed,
disposed of, or transported to or from your property/place of
operation, such description should include but not be limited
to the following;
a. name (trade, chemical and CAS #) , composition, and
quantity(ies) of each oil and/or hazardous material (e.g.
waste oil, fuel oil, solvents, freon, etc. ) ;
b. the purpose and use of such material;
C. the type(s) of containers/vessels used to - store the
material; and
d. location, practices and procedures for storage and
disposal of the material.
3 . Describe each and every storage tank, both underground and
above ground, located at the property during your operation
and/or ownership of the property. The description should
include, but should not be limited to:
a: the date on which each tank was installed at the
property;
b. the capacity and location of each tank(s) ;
C. the type or types and quantities of oil and/or hazardous
material (s) stored in each tank;
d. a description of the maintenance, repair, or testing
performed on each tank during the period of time it was
located on the property; and
e. include receipts of any maintenance, repairs or testing
or any other documents that pertain to these activities.

4 . If storage tanks have been removed from the property,
describe the removal of each . and every storage tank(s) ,.
including the removal of the contents of each • and every
storage tank(s) . Such statement should include, but should
not be limited to:
a. the date on which each tank was removed from the
property;
b. the name(s) and address(es) of the company(s) ,
principle(s) , and town and state officials) involved in
the removal of the tanks;
c. a description of where each tank and its contents was
disposed of;
d. a description of the condition of the tank(s) upon
removal, including, without limitation, any holes, rust,
defects, evidence of spillage, soil discolorations,
odors or leakage;
e. a description of all releases that had occurred at or
from above and/or underground storage tanks and
associated piping,. i.e. , leaks from unions, couplings,
overfills, holes in tanks, and/or any other system
failure; and
f. , the reasons .removal of the tank(s) was/were necessary.
5. Describe any oil and/or hazardous materials) releases) which
occurred during your ownership or operation of the property.
Include, without limitation, a description of any release(s)
from holes or leaks from any storage containers, pits,
lagoons, equipment or tanks and from accidents, overfills or
delivery spills. In such description please include:
a. the date of each such release(s) ;
b. • the quantity and type of oil and/or hazardous
material(s) ;
c. the location of each release;
d. the cause and source of such release(s) ;
e. any cleanup activities undertaken as a result of such
release(s) ; and .
f. the identity of each and every person by name(s) ,
address'(es) and job description(s) , and the identity of
each such persons' employer(s) , who participated in
cleanup activities.

were on the property, or any event that you became aware of
that occured previous to your ownership or operation of the
property, relative to any release of hazardous material(s) and
the dates of such events. Also, if known, identify any
release(s) on adjoining or nearby property which you believe

other pertinent features, of any on-site septic system(s) , dry

8. Identify and submit all environmental surveys, studies, or .

Please answer all of the following questions as fully and
completely as . possible. Attach copies of any relevant
documentation. Failure to respond timely and adequately to this
request for information, or submission of false, misleading or
incomplete information may subject you to legal action.
1. List all the names of the businesses you owned or operated at
the Property and the dates of such ownership or operation. If
known, also list the names ) and addresses of past
owners/operators and the nature of their businesses.
2 . Describe your current and past use of any oils or hazardous
materials generated, stored, treated, released, managed,
disposed of, or transported to or from your propertylplace of
operation, such description should include but not be limited
to the following;
a. name (trade, chemical and CAS #) , composition, and
quantity(ies) of each oil and/or hazardous material (e.g.,
waste oil, fuel oil, solvents, freon, etc. ) ;
b. the purpose and use of such material;
C. the type(s) of containers/vessels used to store the
material; and
d. location, practices and procedures for storage and
disposal of. the material.
3 . Describe each and every storage tank, both underground and
above ground, located at the property during your operation
and/or ownership of the property. The description should
include, but should not be limited to:
a. the date on which each tank was installed at the
property;
b. the capacity and location of each tank(s) ;
C. the type or types and quantities of oil and/or. hazardous
material(s) stored in each tank;
d. a description of the maintenance, repair, or testing
performed on each tank during the period of time it was
located on the property; and
e. include receipts of any maintenance, repairs or testing
or any other documents that pertain to these activities.
4. If storage tanks have been removed from the property,
describe the removal of - each and every storage tank(s) ,
including the removal of the contents of each and every
storage tank(s) . Such statement should include, but should
not be limited to:
a. the date on which each tank was removed from the
property;
. b. the name(s) and addresses) of the , company(s) ,
principle(s) , and town and state officials) involved in
the removal of the tanks;
c. a description of where each tank and its contents was
disposed of;
d. a description of the condition of the tank(s) upon
removal, including, without limitation, any holes, rust,
defects, evidence of spillage, soil discolorations,
odors or leakage;
e. a description of all releases that had occurred at or
from above and/or underground. storage • tanks and
associated piping, i.e. , leaks from unions, couplings,
overfills, holes in tanks, and/or any other system
failure; and
f. the reasons removal of the tank(s) was/were necessary.
5. Describe any oil and/or hazardous material(s) release(s) which
occurred during your ownership or operation of the property.
Include, without limitation, a description of any release(s)
from holes or leaks from any storage containers, pits,
lagoons, equipment or tanks and from accidents, overfills or.
delivery spills. In such. description please include:
a. the date of each such release(s) ;
b. the quantity and type of oil and/or hazardous
material (s) ;
C. the location of each release;
d. the cause and source of such release(s) ;
e. any cleanup activities undertaken as a result of such.
release(s) ; and
f. the identity of each and every person by name(s) ,
address(es) and job description(s) , and the identity of,
each such persons' employer(s) , who participated in
cleanup activities.
6. Please identify and describe any event that occurred while you
were on the property, or any event that you became aware of
that occured previous to your ownership or operation of the
property, relative to any release of hazardous material(s) and
the dates of such events. Also, if known, identify any
release(s) on adjoining or nearby property which you believe
may be impacting your property.
7 . Please provide a description, including the location, size and
other pertinent features, of any on-site septic system(s) , dry
well(s) or other underground injection points.
8. Identify and submit all environmental surveys, studies, or
collections of data conducted for your property. Such

First aid and emergency procedures:
a Inhalation: Remove patient to fresh air and assist with respiration if necessary. Obtain medical attention. Careful attention to acidosis and possible ethanol
therapy.
b. Skin: Remove contaminated clothes and flush with water for 15 min.If irritation persists,get medical attention.
c. Ingestion: Get medical attention. Do not induce vomiting. If spontaneous vomiting occurs,keep head below hips to avoid aspiration of liquid into lungs.
May cause severe burns to mouth,throat and stomach. Physician may use 1-2%sodium bicarbonate lavage. Blood methanol levels over
50 mg/100 ml indicates hemodialysis.
d. Eyes: Wash with large amounts of water for 15 minutes lifting lids occasionally for complete washing. Get medical attention. May cause tissue
destruction leading to permanent eye damage.
NOTE TO PHYSICIAN: Adrenahn should never be given to persons overexposed to methylene chloride.
CHRONIC TOXICITY
Chronic overexposures to methylene chloride have caused liver and kidney disease in experimental animals.
Carcinogenicity: Methylene chloride has been evaluated for possible concern causing effects in laboratory animals. Inhalation studies at concentrations of
2,000 and 4,000 ppm increased the incidence of malignant liver and lung tumors in mice. Three inhalation studies of rats have shown increased incidence of be-
nign mammary gland tumors in female rats at concentrations of 500 ppm and above and increases in benign mammary gland tumors in males at concentrations of
1,500 ppm and above. Rats exposed to 50 and 200 ppm via inhalation showed no increased incidence of tumors.Mice and rats exposed by ingestion at levels up to
250 mg/kg/day lifetime and hamsters exposed via inhalation to concentrations up to 3,500 ppm lifetime did not show an increased incidence of tumors.
The International Agency for Cancer Research considers liver and lung tumors in mice as limited evidence of animal carcinogenicity. The significance of be-
nign mammary gland tumors is unknown.
Epidemiology studies of 751 humans chronically exposed to methylene chloride in the workplace for a minimum of 20 years did not demonstrate any increase in
deaths caused by cancer or cardiac problems. A second study of 2,227 workers confirmed these results.
Methylene chloride has been identified as an an animal carcinogen by NTP. Methylene chloride is listed on the IRAC and NTP carcinogen list but not by OSHA.
Reproductive Toxicity: Reproductive toxicity tests have been conducted to evaluate the adverse effects methylene chloride may have on reproduction and
offspring of laboratory animals. The results indicate that methylene chloride does not cause birth defects in laboratory animals.
Section VII-Special Protection —_
a Inhalation: None if used in ventilation that keeps vapor concentration less than 100 ppm(TWA). Use is not recommended in lesser ventilation.
b. Skin: Rubber gloves,apron and boots should be worn. Wash with soap and water after use.
c. Ingestion: Do not eat,drink,or smoke in Oe work area. Wash thoroughly before eating,or drinking.
d. Eyes: Safety goggles should be worn. Contact lenses should not be worn. Eyewash should be available.
Section VIII-Spill or Leak Procedure
Steps to be taken in case material is released or spilled:
Remove all sources of ignition and provide ventilation.
Small spills Take up with absorbent material and place in a nonleaking container.Evacuate and ventilate the area.
Large spills- Evacuate the area Wear the appropriate respiration equipment. Stop source of leak if possible. Dike and contain. Knock down vapor cloud with
water bag. Clean up with vacuum truck. Flush area with water.
Waste disposal method: Recovered material should be sent to licensed reclaimer or incinerated.
Section IX-Special Precautions
Precautions to be taken in handling and storage: Avoid contact with skin and eyes. Avoid breathing vapors. Wash with soap and water before eating,drinking or
smoking.Launder contaminated clothes before reuse.
Other precautions: Keep out of reach of children. Do not transfer contents to bottles or other unlabeled containers for storage. All warranties void if repackaged.
Close container after each use. Store in cool,dry place. Do not store in direct sunlight. Keep container cool. Open container slowly to allow venting.DO NOT
USE NEAR HEAT.FLAME OR SPARKS. VAPORS MAY IGNITE OR EXPLODE. Fumes are heavier than air and will collect near the floor. Air movement can cause
fumes to travel among rooms and fall to lower levels. Use in area equipped according to local building codes and/or as outlined in the Kwick Kleen Operations
Manual. For on site use:TURNOFF all gas appliances,stoves,water heaters,furnaces,and plot lights. VENTILATE area until ail odor of fumes are gone before
turning on electric and gas service. DO NOT smoke while in use. Vapors may produce toxic gas when in contact with hot surfaces. Destroy rags,newspapers or
drop cloths after use to prevent spontaneous combustion.
