This letter contains information from that visit that will help you, as a business owner/manager,become compliant with hazardous waste regulations. Enclosed are copies of Article 39: Control of Toxic and Hazardous Materials ordinance and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your shop. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding recommendations listed below: PROBLEM: • Industrial strength degreaser/cleaner is used to routinely wash/mop down your vehicle repair shop floor. The waste water from this process is then poured down the drain at this location. • This is a violation of the Town of Barnstable General Ordinance,Article 39: Control of Toxic and Hazardous Materials, Section 3-2.7 and 9-1. • This is also a violation of the Town of Barnstable Vehicle Washing Policy(enclosed) • Discharging this waste water threatens the quality of groundwater supplies and related water resources on Cape Cod and other Massachusetts towns,posing substantial public health and safety hazards and threatening economic losses to the affected communities. ORDER: • DO NOT use corrosive degreasing/cleaning products with water to routinely clean or soak up spills of hazardous materials off your shop floor and DO NOT pour waste water containing corrosive degreasing/cleaning products down any drain at this location. • Alternatives to this problem,when cleaning the shop floors, consist of the following: 1) The waste water should be disposed of as hazardous waste. 2) You have an approved car wash system(oil-water separator)which meets all of the requirements of the MA Department of Environmental Protection and the Town of Barnstable General Ordinance,Article 39. 3) You switch your cleaning product to one which is not corrosive (i.e.biodegradable)AND you use a minimal amount of soap and water to clean your shop floor. 4) Use more absorbent pads on your shop floor to properly clean up spills and releases of hazardous materials. PROBLEM: • Motor oil was observed(a 2' x 1' puddle)next to the engines stored on the service shop floor with no absorbent, spill pallet,or catchment pan to contain this release. • Because of this,you are in violation of Section 9-1 of Article 39: Control of Toxic and Hazardous Materials,which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground,or into any surface...within the Town of Barnstable,is prohibited." ORDER: • Starting immediately, advise your staff to use caution and consistently use proper spill containment pans/trays, absorbent pads or Speedy Dry while working on engines in the shop or draining fluids from all vehicles. • Absorbent materials used to soak up oil and antifreeze should be cleaned off the shop floor and disposed of as hazardous waste. PROBLEM: • An uncovered/uncapped container of hazardous material(approximately 15 gallons of parts solvent)was observed in the hazardous materials storage room next to your shop. • This is a violation of the Town of Barnstable General Ordinance,Article 39: Control of Toxic and Hazardous Materials, Section 5-2, which states, "Provisions shall be made to contain the product(i.e.hazardous materials)in the case of an accidental release." ORDER: • Please advise your staff to cap/contain all hazardous material storage containers. • During a repair,cap temporary storage containers after draining hazmat from vehicles and setting it aside until it is put back into a vehicle. PROBLEM: • The Town of Barnstable requires all businesses to register their hazardous materials and to submit a contingency plan prior to obtaining their Hazardous Materials Storage and Handling Permit(TOB General Ordinance, Article 39, Sect. 6-5,A,B,C,D,E). ORDER: • Please design and submit an Emergency Contingency Plan for hazmat spill preparedness and response within the next 30 days (you can submit this plan along with your application for a Hazardous Materials Permit). • This plan should be posted and visible in your shop and office areas. PROBLEM: • Shop rags were observed on the floor or on work benches in your shop. • No metal shop rag can was observed in the shop or in use. RECOMMENDATION: • Please obtain and use a metal shop rag can with a metal lid. • All shop rags that contain petroleum and hazardous material residue are considered potentially flammable and need to be contained in a shop rag can and emptied daily. K� PROBLEM: • The waste solvent drum is not labeled correctly because it does not indicate the type of waste contained in the barrel and the health hazard it can have. RECOMMENDATION: • Please label all hazardous waste storage containers/drums, "TOXIC"and "HAZARDOUS WASTE", as well as the type of waste it is (e.g. "Waste Solvent"). On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from August 27,2004 shows that you have approximately gallons of toxic and hazardous materials being used, stored,generated and disposed of at Land Rover Cape Cod(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). The Board of Health has determined that the using,storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. This license should be purchased within the next 30 days from the Town of Barnstable Town Offices,200 Main Street,Hyannis,MA 02601 (application enclosed). Why are these recommendations being made for Land Rover Cape Cod? • This information is intended to educate you,a business owner/operator in the Town of Barnstable,in order to keep your business operations in compliance with local, state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. • Complying with the Control of Toxic and Hazardous Materials ordinance (Article 39)can prevent contamination of Barnstable's existing and future drinking water supply,prevent environmental contamination which can bankrupt site owners, lower or destroy land values, drive out residents and industry, depress local economies and endanger public health. To increase oil removel efficiency, (10 ppm) a polypropylene coalescence pack will be added. Note: This separator will separate to 10 ppm with a minimum globule size of.90 mircons. As mandated under the Federal Safe Drinking Water Act, the state Underground Injection Control (UIC) regulations prohibit potentially polluting discharge to injection wells. Vehicle maintenance operations commonly use unauthorized injection wells, such as floor drains leading to a septic system, dry well, or oil/water separator which leads to any subsurface leaching structure. Under the State Plumbing Code(248 CMR 2.09 (1)(c) (3),owners/operators of facilities with floor drains tied to injection wells(or discharging to any surface point)have three options: 1. Excavation and inspection of the storage tank revealed several holes due to corrosion. Subsequent installation of observation wells on the property confirmed that approximately 1000 gallons of gasoline had been released from the tank and was located in the immediate subsurface area of the tank.
